The County Attorney is elected every four years. The County Attorney's Office prosecutes all felony and misdemeanor offenses in Duchesne County except misdemeanor offenses that occur within Roosevelt City limits

To qualify for appointment of counsel, the defendant must meet criteria set forth by the Court. The defendant must appear before the Judge to testify about his ability to retain his own counsel, and the Judge will order the appointment of counsel or require that the defendant retain his own attorney if he desires to be represented by an attorney.
The Public Defender can also be retained privately as with any of the other defense attorneys in the County.
The Public Defender contract is renewed yearly.
