UTAH CANDIDATE FILING QUALIFICATIONS
Before
the filing officer accepts any candidacy, he shall read to the candidate the
constitutional and statutory requirements for candidacy, and the candidate shall state
whether he fulfills the requirements of candidacy. If the candidate indicates that
such candidate does not qualify, the filing officer shall decline such person's candidacy.

County Commission

U.S. Citizen at time of filing.
Elector (registered voter 20A-2-101 & 104) of the county which
he represents for one year immediately preceding his election.
At least one year resident of the county immediately before the date
of the election.
County Clerk, Auditor, Recorder, Treasurer
(Utah Code 17-16-1; 20A-9-201; 20A-9-202)
U.S. Citizen at time of filing.
A registered voter in the county.
At least one year resident of the county immediately before the date
of the election.
County Assessor
(Utah Code 17-16-1; 17-17-2(2)(a); 20A-9-201;
20A-9-202; 61-2b)
U.S. Citizen at time of filing.
A registered voter in the county.
At least one year resident of the county immediately before the date
of the election.
The elected county assessor must become
a licensed appraiser by the Division of Real Estate within 36
months of taking office. The requirements are:
1. Complete 75 hours of qualifying education to
become an appraiser trainee.
2. Complete an additional 15 hours of education (90 hours
total; 150 hours after 1/1/2008)
3. Obtain 24 months appraisal experience after becoming an
appraiser trainee.
4. Complete a criminal/civil judgment background
questionnaire.
5. Pass a comprehensive appraisal examination.

The elected county assessor must also become
a designated appraiser by the State Tax Commission before
appraising for property tax purposes. The requirements
are:
1. Become a licensed appraiser.
2. Complete additional required appraisal education.
3. Complete and pass an appraisal practicum.

Utah Code Title 61, Chapter 2b and Section
17-17-2 are the code sites that detail specific requirements
that must be met for persons appraising real property and for
County Assessors in the state of Utah.

In addition UCA paragraph 17-17-2(2)(a)
states that, "If an assessor fails to meet the requirements of
this section, the assessor's office is automatically vacant."
County Sheriff
(Utah Code 17-16-1; 17-22-1.5; 20A-9-201;

U.S. Citizen at time of filing.
A registered voter in the county.
At least one year resident of the county immediately before the date
of the election.
Must be certified as a peace officer prior to taking office the
first Monday of January after the election.
County Attorney
(Utah Code 17-16-1; 17-18-5; 20A-9-201; 20A-9-202)
U.S. Citizen at time of filing.
An attorney licensed to practice law in Utah who is an active member
in good standing of the Utah State Bar
A registered voter in the county.
At least one year resident of the county immediately before the date
of the election.
If there is no qualified attorney residing in the county, or a
qualified attorney does not file, the county commission will fill the office by
appointment.
County Surveyor
(Utah Code 17-23-1; 20A-9-201; 20A-9-202)
U.S. Citizen at time of filing.
A registered voter in the county.
At least one year resident of the county immediately before the date
of the election.
Any person elected exclusively as the county surveyor shall be a
registered professional land surveyor in the state of Utah.
Justice Court Judge
District Attorney
(Utah Code 17-15-5; 20A-9-202(2))
U.S. Citizen at time of filing.
An attorney licensed to practice law in Utah who is an active member
in good standing of the Utah State Bar.
A registered voter in a county or prosecution district in which he
is seeking office.
A current resident of the prosecution district in which he is
seeking office and has been a resident of that district for at least one year.
Utah Senate and Representative
(Utah Constitution Article VI, Section 5 and 6;
Utah Code 20A-9-201)
U.S. Citizen at time of filing.
25 years old at the filing deadline time.
3 year resident of Utah at the filing deadline time.
6 month resident of the senate or representative district from which
elected at the filing deadline time.
Qualified voter (registered voter 20A-2-101 & 104) of the senate
or representative district from which elected.
No person holding any public office of profit or trust under
authority of the United States, or of this State, shall be a member of the Legislature;
provided, that appointments in the State Militia, and the offices of notary public,
justice of the peace, United States commissioner, and postmaster of the fourth class,
shall not, within the meaning of this section, be considered offices of profit or trust.
