MINUTES FOR REGULAR COMMISSION MEETING HELD
NOVEMBER 15, 2004 BEGINNING AT 1:00 P.M.

IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger (absent), Commissioner Kent R. Peatross, Road Department Supervisor Forrest Bird, Therena Morrill of the Uintah Basin Standard and Andrea Arnold Commission Assistant taking minutes of the meeting.

Opening Comments: Commissioner Ross gave prayer.  Commissioner Ross asked if there were any further comments and none were spoken.

Pledge of Allegiance:  Any wishing to participate.

Road Items
Mr. Forrest Bird stated the road department has finished the reconstruction of County Road Three Hundred Seventy-One (CR#371) by Lee Miles and have begun to center stripe the roads. He stated the road department has started to re-deck the bridge south of Altonah.

Mr. Bird presented Partial Payment Request Twenty (#20) for design engineering for Project No. BHO-LC13(4) on the Bridgeland/Duchesne River Bridge. The amount of the request is three thousand, four hundred eighty-three dollars and eighty-one cents ($3,483.81). Commissioner Peatross motioned to approve Partial Payment Request #20. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Mr. Bird presented Partial Payment Request Four (#4) for construction engineering for Project No. BRO-LC13(5) on the Myton Lake Fork Bridge. The amount of the request is fourteen thousand, one hundred ninety-two dollars and five cents ($14,192.05). Commissioner Peatross motion to approve Partial Payment Request #4. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Commissioner Peatross asked what the repair schedule for the County Road Twelve (CR#12) on the Duchesne River Bridge was. Mr. Bird stated the road department would begin work in the next couple of weeks. Commissioner Peatross asked if the bridge was metal or wood. Mr. Bird stated it had a wood deck and the road department has the materials to replace it.

...Deputy County Attorney Roland Uresk joined the meeting...

Commissioner Ross stated there was a meeting with the Utah School and Institutional Trust Lands Administration (SITLA) concerning a road maintenance agreement (see minutes of morning meeting). He stated Attorney Uresk should prepare a draft agreement for approval. Commissioner Peatross suggested the county require twenty-five thousand dollars ($25,000) for a bond by Carbon County Lumber Company for road repairs. Mr. Bird stated that amount should be sufficient. Commissioner Ross stated he would be more comfortable with a fifty thousand dollar ($50,000) bond when considering the road is a Class ‘B’ Road. Commissioner Peatross stated his approval of that amount.

Consideration of Resolution 04-17 to Adopt National Incident Management System (NIMS)
Attorney Uresk presented the following resolution:

RESOLUTION NO. 04-17
A RESOLUTION ADOPTING THE NATIONAL INCIDENT MANAGEMENT SYSTEM (NIMS), A SYSTEM OF MINIMUM REQUIREMENTS FOR STATES, COUNTIES, CITIES, TRIBES AND OTHER LOCAL ENTITIES TO STANDARDIZE APPROACH TO INCIDENT MANAGEMENT AND RESPONSE

WHEREAS, natural and man-made disasters have and may occur in any part of the County, and

WHEREAS, the majority of emergency incidents are mitigated by local responders, and

WHEREAS, state agencies may be called upon to respond to and/or assist in recovery from the effects of emergency incidents and disasters, and

WHEREAS, the County of Duchesne is committed to achieving a system that will provide a consistent statewide and countywide approach for federal, state, local, and tribal governments to work effectively and efficiently together to prevent, prepare for, respond to and recover from domestic emergency and disaster incidents, regardless of cause, size, or complexity, and

WHEREAS, The Homeland Security Presidential Directive (HSPD-5) requires federal departments and agencies to adopt the National Incident Management System (NIMS), and

WHEREAS, in times of disaster, state, local, and tribal agencies work closely with federal agencies, and

WHEREAS, NIMS provides a consistent nationwide template for all agencies to work together to prevent, prepare for, respond to, and recover from all hazards, and

WHEREAS, as a condition for federal preparedness assistance, beginning in Fiscal Year 2005, state and local organizations are mandated by HSPD-5 to adopt NIMS as the model for incident management in times of disaster,

BE IT HEREBY RESOLVED by the Board of Duchesne County Commissioners that:

1. All county agencies which may be required to participate in the management of emergency incidents and disasters shall comply with the requirements of the National Incident Management System (NIMS) as the model for preparing for, responding to, and recovering from emergency incidents and disasters.
2. The Duchesne County Department of Emergency Management shall be the lead agency for determining overall county compliance with the requirements of NIMS and oversee the planning, training, and implementation of NIMS within the county.
3. County agencies shall review their agency Emergency Operations Plan to ensure compliance with the requirements of NIMS.
4. All county agencies shall maintain an internal inventory of resources that may be needed in the event of an emergency or disaster and shall establish a process that provides for the expeditious identification and procurement of external resources needed in an emergency or disaster.

Dated this 15th day of November 2004.

Commissioner Ross asked the attorney if he had reviewed the language of the agreement. Attorney Uresk stated he had and there doesn’t seem to be any issues of concern. Commissioner Peatross asked if the agreement identified a process. Attorney Uresk stated it identifies a general process. Commissioner Peatross stated it is necessary to adopt Resolution 04-17 in order to obtain federal grants. Commissioner Ross stated it would be helpful for the county to adopt the resolution and be included in the nation’s network of incident management. Commissioner Peatross motioned to adopt Resolution 04-17 NIMS. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Vouchers
Andrea Arnold presented vouchers #90488 through #90584 in the amount of one hundred nineteen thousand, two hundred seventy-three dollars and thirty-four cents ($119,273.34) for approval. Commissioner Peatross motioned to approve the vouchers. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Consideration of Morning Agenda Items
There were no issues to consider.

Other Business
There was no other business discussed.
