MINUTES FOR REGULAR COMMISSION MEETING HELD
NOVEMBER 8, 2004 BEGINNING AT 1:00 P.M.

IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, Commissioner Kent R. Peatross, Road Department Supervisor Forrest Bird and Andrea Arnold taking minutes.

Opening Comments: Commissioner Ross gave prayer.  Commissioner Ross asked if there were any further comments and none were spoken.

Pledge of Allegiance:  Any wishing to participate.  

Road Items
Mr. Forrest Bird stated the road department has began work on the Lee Miles Road in Altamont and the contractors for the Lake Fork Bridge Project have poured the deck for the bridge.  He stated striping of the roads has been delayed due to the weather.  Commissioner Peatross asked what temperature it needed to be in order to be able to stripe the roads.  Mr. Bird stated approximately forty (40) to (50) degrees.  Commissioner Ross stated he has received a concern with the road by Marilyn Draney west of Neola.  Mr. Bird will look into it.  Mr. Bird stated he has received some complaints about the Cedarview Road and will look into that as well.

Tax Adjustments – Assessor
Andrea Arnold presented the following tax adjustment from the Assessor’s Office for approval:

Commissioner Peatross motioned to approve the tax adjustment.  Commissioner Stradinger withdrew her position to vote due to a conflict of interest.  Commissioner Ross seconded the motion.  Both commissioners voted aye and the motion passed.

Department Head Time Sheets
Deputy Stewart presented department head time sheets.  All were approved.

Vouchers
Andrea Arnold presented vouchers #90361 through #90487 in the amount of two hundred fourteen thousand, six hundred sixty-five dollars and eighty-seven cents ($214,665.87) for approval.  Commissioner Stradinger motioned to approve the vouchers.  Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Consideration of Resolution 04-17 to Adopt National Incident Management System (NIMS)
The approval of Resolution 04-17 Adopting NIMS has been tabled until more information can be gathered.

1:30 p.m. Public Hearing Resumed – Randy and Leslie Woods Rezone Request
Commissioner Ross re-opened the public hearing.  Mr. Mike Hyde stated the planning commission has recommended denial of the Wood’s rezone request because the Wood’s applied for a conditional use permit and that was approved.  He stated the rezone is no longer needed.  Commissioner Ross asked if there was any opposition to the conditional use permit hearing before the planning commission.  Mr. Hyde stated that no one appeared at the planning commission meeting to object the conditional use permit and that the rezone is what they were in opposition to.  Commissioner Peatross motioned to accept the planning commission’s recommendation to deny the Wood’s rezone request.  Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Minutes of Meeting Held November 1, 2004
Commissioner Peatross motioned to approve the minutes as amended.  Commissioner Ross seconded the motion.  Both commissioners voted aye and the motion passed.

Final Plat of Lee Giles Subdivision; Section 11, Township 1 South, Range 8 West; Northeast of Hanna
Mr. Hyde stated Lee Giles has proposed to create five (5) lots by Hanna in a two point five (2.5) acre zone.  He stated water is available and Tri County Health Department has approved the land for waste water systems.  He stated the planning commission has recommended approval.  Commissioner Ross asked how wide the county road going north toward the property was.  Mr. Giles stated it is sixty-six feet (66’) wide along his frontage.  Commissioner Peatross motioned to adopt the findings and conclusions of the planning commission and approve the final plat of the Lee Giles Subdivision.  Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Final Plat of Silver Moon Ranch Subdivision (Phase 1); Sections 14, 15, 21, 22, 23, 27, 28, 29, 31, 32, 33 and 34, Township 4 South, Range 4 West; and Sections 4 and 5, Township 5 South, Range 4 West, USB&M; Southeast of Duchesne
Mr. Hyde stated that Utah Land and Ranches (ULR) has been working with the county for approximately six (6) months.  He stated they have asked for one (1) variance to the perk test requirement because the phase is part of a dry subdivision with all lots being over forty (40) acres in size.  Commissioner Peatross asked what would happen if someone decided to put in a septic system.  Mr. Hyde stated they would need approval from Tri County Health Department.  Mr. Hyde stated the developers are making provisions for the extension of the roads farther north and southeast.  He stated they have posted a half million-dollar bond for road improvements and an additional bond to cover future road improvements to Highway Forty (Hwy 40).  Mr. Hyde stated they have made an agreement with Duchesne City for water because when they drilled a well on the property the water was not potable.  Commissioner Ross asked what the quality of the well water was.  Mr. Butler stated they did not have a test done because Leon Ross said it was not needed.  He stated Mr. Ross could tell by the smell of the water.  Commissioner Ross asked how deep they drilled the well.  Mr. Butler stated the well was approximately four hundred sixty-five feet (465’) deep.  Mr. Hyde stated there was little concern from the public shown at the planning commission meeting.  He stated there was a concern about trailers being moved in and a concern from Jay Abbott because of an easement he holds for his cattle drive.  Commissioner Ross asked how many acres were in Phase #1.  Mr. Hyde stated approximately three thousand two hundred (3,200) acres.  Commissioner Stradinger asked if there would be full time residents.  Mr. Butler stated they anticipated mostly recreational properties and few residents.  Commissioner Ross asked if the roads were built to county specification and if there were covenants to the quality of homes.  Mr. Butler stated the roads were and that if manufactured homes were brought in they would need to be a new doublewide on a permanent foundation.  Commissioner Stradinger motioned to adopt the findings and conclusions of the planning commission and approve the final plat of the Silver Moon Ranch Subdivision, Phase #1.  Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Consideration of Morning Agenda Items
There were no issues to consider.

There was no other business discussed.

The commission adjourned the meeting at 2:30 p.m.
