Commissioner Stradinger gave a prayer. Commissioner Peatross
asked the public for further comment. There were none.

Road Items
Mr. Nielsen stated he has followed up with Mr. Leroy Pectol’s
request for the county to assist with having the school bus
include his road in their route. He stated he talked to Tim
Trujillo of the Duchesne County School District Transportation
Department and he was told that the easement to the school
district has been revoked. Commissioner Peatross stated there
was nothing the county could do until the school district is
given an easement to the road.
Mr. Nielsen stated he has completed a second count on the
Mountain Home intersection at 21000 West and 6750 North during a
regular week. He stated the count was almost the same as the
first. Commissioner Stradinger asked if he had obtained an
opinion from the Utah Department of Transportation regarding
specifications for intersections. Mr. Nielsen stated the Manual
of Uniform Traffic Control Devices (MUTCD) suggests a stop sign
is needed if an intersection has at least five hundred (500)
cars travel through it within an eight (8) hour period. Mr.
Nielsen stated using these standards it is not necessary to
install a stop sign at the intersection or to review the issue
again. Commissioner Stradinger motioned to deny the request to
install a stop sign at the 21000 West and 6750 North
intersections in Mountain Home because the commission has
reviewed this issue twice and it does not meet the MUTCD
criteria. Commissioner Ross seconded the motion. All
commissioners voted aye and the motion passed.
Mr. Nielsen stated he has reviewed the two (2) roads located in
Equestrian Estates. He stated the first is two hundred and fifty
(250) feet and the second is four hundred and sixty (460) feet
from the water. He stated the roads are public. Commissioner
Ross stated that Lauren Timothy would like to gate the roads to
control public access. Commissioner Peatross stated the county
could vacate their interest in the roads. Commissioner Ross
stated the county should leave the issue alone until the public
officially requests the county to take action.
Mr. Nielsen stated he has received a payment request number
sixteen (16) for the Lake Fork Bridge Project in the amount of
three thousand, five hundred eighty-seven dollars and fifty
cents ($3,587.50). He stated the project would be one hundred
percent (100%) paid with forty-seven percent (47%) of the work
completed. Commissioner Ross stated the percentages for the work
billed and the work completed should be closer together.
Commissioner Stradinger stated that Mr. Nielsen should write a
letter to Horrocks Engineers stating that the county will not
pay anymore for the Lake Fork Bridge Project until more work has
been completed. Commissioner Ross stated he should contact UDOT
with the same message.

Vouchers
Andrea Arnold presented vouchers #88420 through #88593 in the
amount of one hundred eighty thousand, two hundred thirty-five
dollars and eighty-five cents ($180,235.85). Commissioner
Stradinger motioned to approve the vouchers. Commissioner
Peatross seconded the motion. Both commissioners voted aye
and the motion passed.
Minutes of Meeting Held June 21, 2004
Commissioner Stradinger motioned to approve the minutes as
corrected. Commissioner Peatross seconded the motion. All
commissioners voted aye and the motion passed.

Animal Control Title 6
Mr. Hyde stated a section was added allowing the county to
update the fee schedule by resolution. He stated in section
06.02.060 he changed “fierce and dangerous” to “vicious”. He
stated in section 06.03.051 he added “or in other public
places”. In section 06.04.012 he changed the requirement of
kennels to be two hundred (200) feet from the home and one
hundred fifty (150) feet from the road right-of-way. Attorney
Uresk stated the definition of kennel would be the same as the
definition used in the zoning ordinance. He stated anyone having
more than three (3) dogs would need to have a kennel permit.
Commissioner Stradinger motioned to approve the animal control
ordinance with corrections and to be effective July 1, 2004.
Commissioner Peatross seconded the motion. Both commissioners
voted aye and the motion passed.
