Road Items
Mr. Douglas Nielsen stated the road department is moving right
along with the summer projects. Commissioner Stradinger stated
that Road #29 is rough again. Mr. Nielsen stated that was due to
lack of moisture and speeding traffic on the road. Commissioner
Stradinger stated the road might need to be considered for
paving in the future. Commissioner Peatross stated he agreed
because of the rate of growth in the area.
Mr. Nielsen stated the company working on the Sandwash Reservoir
Project, WW Clyde Construction, is requesting approval to close
Highway 87 and re-route traffic through Bluebell. He stated that
the Utah Department of Transportation (UDOT) has given approval.
Commissioner Peatross asked the date of the closure. Mr. Nielsen
stated from July 6 to July 12. Commissioner Ross asked if there
were any concerns with heavy trucks being re-routed. Mr. Nielsen
stated there were none. The commission is agreeable to a detour
of Highway 87 for construction purposes.
Mr. Nielsen stated he has completed the fuel containment
structure. Commissioner Ross asked if all the powder magazines
had been properly removed from the Fillingim property. Mr.
Nielsen stated there is approximately one hundred (100) pounds
of explosives left and he will be removing them soon.

1:30 p.m. Public Hearing – Roger Bennett Request for
Amendment to Equestrian Estates Subdivision, Lots 25 and 26
Equestrian Estates Subdivision Section 16 Township 2 South Range
3 West USB&M.
Mrs. Teresa Nielsen stated that Mr. Bennett has proposed to
amend two (2) lots by the Sandwash Reservoir. Commissioner
Stradinger asked where the water line was located. Mr. Roger
Bennett stated it was two (2) lots away. Mrs. Nielsen stated he
would be changing the acreage of the two lots. She stated the
health department has given approval for the amendment. The
commission reviewed the plat map of the property. Commissioner
Stradinger motions to approve the amendment to Equestrian
Estates Subdivision, Lots 25 and 26 Equestrian Estates
Subdivision Section 16 Township 2 South Range 3 West USB&M.
Commissioner Peatross seconded the motion. All commissioners
voted aye and the motion passed.

Accept Memorandum of Understanding (MOU) Between the United
States Forest Service/Ashley National Forest and Duchesne County
Commissioner Peatross stated the MOU looks good except that
there was not any reference to agriculture in section eight (8).
Commissioner Stradinger stated she agreed and that there should
also be a reference to timber production in section 8. She
stated that the phrase “not exclusive of” should be added to
section 8. Commissioner Stradinger motioned to approve the MOU
with the United States Forest Service as corrected. Commissioner
Peatross seconded the motion. All commissioners voted aye and
the motion passed.
Minutes of Meeting Held June 7, 2004
Commissioner Peatross motioned to approve the minutes as is.
Commissioner Stradinger seconded the motion. All
commissioners voted aye and the motion passed.
Resolution 04-10 Increasing the E-911 Levy
Commissioner Ross stated this resolution is being passed at the
commission’s discretion given by the legislature. Commissioner
Stradinger stated it is not mandated. (Copy of resolution is on
file in the clerk’s office.) Commissioner Peatross motioned to
approve Resolution 04-10 Increasing the E-911 levy from
fifty-three cents (.53) to sixty-five cents (.65). Commissioner
Stradinger seconded the motion. All commissioners voted aye
and the motion passed.
Request from Roosevelt City for E-911 Funds
This item has been postponed until Deputy Attorney Uresk can
research the legitimacy of Roosevelt City’s request.
Lease Agreement With Attorney Marea Doherty
This item has been postponed for further negotiation based on
this morning discussion.

2:30 p.m. Public Hearing - Changing the Status of a County
Class ‘D’ Road to a Class ‘B’ Road located in Township 4 South
Range 4 West USM, South East of the Duchesne Area.
Commissioner Ross stated the purpose of the hearing was to
gather information regarding the intent to classify the Class
‘D’ Road located in Township 4 South Range 4 West to a Class ‘B’
Road. Mr. Gordon Moon stated the road dead ends at an oilfield
location. Commissioner Ross stated that Mr. Moon has invited
this issue for discussion. Mr. Moon stated he is in the process
of selling his property that is located near the road. He stated
he had always assumed the road was a Class ‘B’ Road but has been
unable to find a documented trail stating the class of the road.
He stated that was the purpose of this hearing. Mr. Clancy
Butler stated he was in agreement with the intent to classify
the road as a Class ‘B’ Road. Commissioner Ross asked if there
were any objections. There were none. Commissioner Peatross
motioned to approve the status change of a county Class ‘D’ Road
to a Class ‘B’ Road located in Township 4 South Range 4 West USM.
Commissioner Stradinger seconded the motion. All
commissioners voted aye and the motion passed.
Consideration of Morning Agenda Items
Commissioner Ross stated that the discussion this morning with
Highland Development concerning the issuance of building permits
for the development of Utah Mini Ranches does not warrant a
motion from the commission. The Building Department and Planning
and Zoning are following code in this matter.
Commissioner Peatross stated that the employees who were unable
to take the National Day of Mourning under President Bush’s
directive will be able to benefit from an eight (8) holiday to
be used by December 31, 2004. Commissioner Stradinger stated
that the nature and spirit of that day has been misinterpreted
and for future purposes the commission should consider allowing
the employees to close the offices with the knowledge they will
need to use vacation pay.
Vouchers
Andrea Arnold presented vouchers #88289 through #88330 in the
amount of one hundred forty-five thousand, five hundred
forty-four dollars and twenty-three cents ($145,544.23).
Commissioner Stradinger motioned to approve the vouchers.
Commissioner Peatross seconded the motion. All commissioners
voted aye and the motion passed.
