MINUTES FOR REGULAR COMMISSION MEETING HELD
APRIL 26, 2004 BEGINNING AT 1:00 P.M.
IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, Commissioner Kent Peatross, Road Supervisor, Doug Nielsen and Andrea Arnold taking minutes.

Prayer: Commissioner Peatross
Pledge of Allegiance:  All wishing to participate.

Road Items
Mr. Douglas Nielsen stated the road department has begun to haul gravel for the Red Creek Road and the project should be finished by the end of the week. Commissioner Peatross asked about the road department installing culverts beyond the new road. Mr. Nielsen stated it works well to put the culverts in the water under the road and then cover the culverts with fabric. Commissioner Ross asked about the Lakefork Bridge Project. Mr. Nielsen stated he has spoken with Mr. Rex Harrison of Horrocks Engineers. Mr. Harrison will be able to put the project to bid soon. Commissioner Ross stated that everything sounds good.

Award Telephone System Bid
Commissioner Ross asked what the financial figures were for each bid. Mr. Michael Brennan stated the original bid from UBET/Netpath was in the amount of fifty-seven thousand, three hundred seven dollars and eighty-three cents ($57,307.83) with an additional cost of three thousand six hundred dollars and no cents ($3,600.00) for the purchase of network switches. The total bid for UBET/Netpath is in the amount of sixty thousand, nine hundred seven dollars and eighty-three cents ($60,907.83). He stated the bid from Protel was in the amount of fifty-five thousand, six hundred sixty-three dollars and twenty-four cents ($55,663.24). He stated the UBET/Netpath bid was approximately eight percent (8%) more than Protel, but the Duchesne County Procurement Policy allows for bids to be awarded to local vendors if they are within ten percent (10%) of the lowest bidder. Commissioner Peatross asked if Mr. Brennan had any further comments. Mr. Brennan stated after the presentations given by the vendors last week, the committee and employees recommended UBET/Netpath to the commission. He stated the committee and employees believe county funds should be spent locally and future relationships within the county could be better met by working with UBET/Netpath. Additionally, they are supportive of future growth and services within the county. Commissioner Ross asked if there were any further comments. He stated the commission has gone through a considerable process to obtain the bids and follow the county procurement policy. Commissioner Stradinger motioned to award the telephone system bid to UBET/Netpath in the amount of $60,907.83. Commission Peatross abstained from the motion due to a conflict of interest. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

...County Assessor Greg Garff and Kim Mullins joined the meeting...

Tax Adjustments – Assessor’s Office
Commissioner Stradinger stated she had received a phone call from Mr. Kim Mullins with a concern that he has been overpaying his personal property taxes for a boat and would like a refund. Commissioner Ross asked Mr. Mullins to explain the situation. Mr. Mullins stated when he came in last week to pay the taxes for his boat; he was in question of the value the Assessor’s Office listed the boat as. The Assessor’s Office listed the value at sixteen thousand dollars ($16,000) and when Deputy Assessor Meleena Swasey researched the value and found that it should have been assessed at five thousand, six hundred dollars ($5,600). Assessor Garff stated the Utah State Tax Commission uses a MSRP to formulate a value. Mr. Mullins stated the adjustment in the value has changed his taxes from being one hundred and eleven dollars ($111) a year to approximately forty dollars ($40) a year. Mr. Mullins asked that the overpayment of taxes for the previous four (4) years be refunded. Commissioner Ross stated he felt that decision should be at the discretion of the Assessor to determine. Assessor Garff stated that this was the first he has been told of the situation and would need time to research. This item will be on next Monday’s tax adjustments.

Adopt Resolution 04-09 TriCounty Health Interlocal Agreement
Attorney Uresk stated this resolution is not complete because he has been unable to meet with Wes Baden to discuss the changes. He asked that this item be put on the May 3 agenda.

Adopt Resolution 04-10 Utah Association of Counties Transient Room Tax Agreement
Commissioner Ross asked if this resolution was complete. Attorney Uresk stated that the commission could approve it today but they need to appoint someone from the commission to be on the board representing this issue. Commissioner Ross stated that this item be put on the May 3 agenda.

Minutes of Meeting Held April 19, 2004
Commissioner Stradinger motioned to approve the minutes. Commissioner Peatross seconded the motion. All commissioners voted aye and the motion passed.

Vouchers
Andrea Arnold presented vouchers #87746 through #87794 in the amount of sixty-nine thousand, four hundred ninety-nine dollars and one cent ($69,499.01). Commissioner Peatross motioned to approve payment of the vouchers. Commissioner Stradinger seconded the motion. All commissioners voted aye and the motion passed.

Department Head Time Sheets
Deputy Stewart presented department head time sheets. All were approved.

Executive Session – Personnel Issues
Commissioner Peatross motioned to go into executive session at 1:45 p.m. Commissioner Stradinger seconded the motion. All commissioners voted aye.

Regular meeting resumed at 2:00 p.m.

Adjournment
The commission adjourned the meeting at 2:00 p.m.
