MINUTES FOR REGULAR COMMISSION MEETING HELD
APRIL 12, 2004 BEGINNING AT 1:00 P.M.
IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Present:  Commission Chairman Larry S. Ross, Commissioner Kent Peatross, Road Supervisor, Doug Nielsen, Deputy County Attorney Roland Uresk and Andrea Arnold taking minutes.

Prayer: Commissioner Ross
Pledge of Allegiance:  All wishing to participate.

Road Items
Mr. Douglas Nielsen stated the roads are rocked that need to be paved. He stated the road department would need to gravel the roads next and put out approximately fifteen thousand (15,000) tons of gravel. He stated the road department crew started work on the Redcreek Road. They have hauled a dozer there and in approximately one week they will be able to put gravel on it and install thirteen (13) culverts. He stated they are relining two thousand, eight hundred (2,800) feet of the road. Commissioner Peatross asked how long the project would take. Mr. Nielsen stated approximately two (2) weeks. Commissioner Ross asked about the status of the cattle guard Ms. Gloria Fasselin has requested to put in Nine Mile Canyon. Mr. Neilsen stated she has requested to install a twenty (20) foot cattle gaurd that does not follow county specifications. He will follow up with her to make sure of the width. Commissioner Peatross stated he has been contacted by a gentleman that would like to compliment the county road department crew for their good work and efficiency on the Utahn River Road Bridge #92.

Mr. Nielsen presented two letters addressed to Horrocks Engineers from the county accepting the agreements for engineering services for the following two road projects: Project No. BHO-LC13(3) – Bridgeland Bridge Replacement in the amount of eighty-eight thousand, one hundred dollars ($88,100); and Project No. STP-1584(1)0 – Bluebell Connector Road in the amount of one hundred sixty-one thousand, seven hundred forty dollars ($160,740). Commissioner Peatross motioned to accept the agreements. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed. Duchesne County will pay 20% of the $88,100 and 6.77% of the $160,740.

Agreement of Engineering Services by Horrocks Engineering
Mr. Nielsen stated he gave the contract for services by Horrocks Engineers to Attorney Uresk for review. Attorney Uresk stated he has found a section in the agreement that needs to be clarified. He stated the contract is phrased to where it leaves the agreement open to all road projects. It will need to be corrected to list the four (4) road projects that the county has agreed to with Horrocks Engineering, which are: Bridgeland Bridge Replacement, Lakefork Bridge, Bluebell Connector Road and the Arcadia Road. Commissioner Peatross motioned to approve the contract with the corrections to the listed road projects. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

National Library Week Proclamation
Mrs. Lorie Womack stated that next week would be National Library Week. She stated she would like to thank the commission for their support in the library and asked that they sign the following proclamation:

Proclamation

WHEREAS, our nation's public, academic and school libraries provide equity of access to library users nationwide no matter their age, income and socioeconomic background;
WHEREAS, libraries play a vital role in providing millions of people with the resources they need to live, learn and work in the 21st century;
WHEREAS, libraries are changing and dynamic places and librarians are the ultimate search engine, helping people of all ages find the information they need in print and online;
WHEREAS, libraries are part of the American Dream - places for opportunity, education, self-help and lifelong learning;
WHEREAS, libraries bring you a world of knowledge both in person and online, as well as personal service and assistance in finding what you need, when you need it;
WHEREAS, libraries are a key player in the national discourse on intellectual freedom, equity of access, and narrowing the “digital divide;”
WHEREAS, awareness and support must be increased for libraries, librarians and library workers by raising their visibility in a positive context and by communicating clearly and strongly why libraries are both unique and valuable and how librarians provide the information literacy skills that people need to succeed throughout life;
WHEREAS, more individuals must be recruited to the profession of librarianship and to work in libraries to maintain their vitality in today’s changing workplace;
WHEREAS, libraries, librarians, library workers and supporters across America are celebrating National Library Week with @ your library®, The Campaign for America's Libraries.
NOW, THEREFORE, be it resolved that We , the members of the Duchesne County Commission, proclaim National Library Week, April 18-24, 2004. We encourage all residents to take advantage of the variety of library resources available at their school, campus or public library. We also urge them to thank both librarians and library workers for providing valuable services and making information accessible to all who walk through the library’s doors. Come see why there’s something for everyone @ your library.

Commissioner Peatross motioned to accept the proclamation and wished to thank the librarians for their work on behalf of the commission. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Acceptance of Legal Contracts
Attorney Uresk presented three contracts for legal service to fill the vacancy of public defender. The contracts are with Cindy Barton-Coombs, Marea Doherty and Herbert Gillespie. Ms. Coombs and Ms. Doherty will be splitting the district court caseload and Mr. Gillespie will be handling the juvenile cases. Commissioner Peatross motioned to accept the legal contracts. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Vouchers
Clerk/Auditor Freston presented vouchers #87540 through #87677 in the amount of one hundred sixty-seven thousand, six hundred thirty-five dollars and twenty-nine cents ($167,635.29) and predraws #87446 and #87539 in the amount of two hundred and twenty dollars ($22). Commissioner Peatross motioned to approve payment of the vouchers. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Department Head Time Sheets
Deputy Stewart presented time sheets for signatures. All were signed.

Minutes of Meeting Held April 5, 2004
Commissioner Peatross motioned to approve the minutes as is. Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Adjournment
The commission adjourned the meeting at 2:15 p.m.
