MINUTES FOR REGULAR COMMISSION MEETING HELD
FEBRUARY 9, 2004 BEGINNING AT 1:00 P.M.
IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, Commissioner Kent Peatross, Road Supervisor, Doug Nielsen Uintah Basin Standard Reporter Phil Johnson and Andrea Arnold taking minutes.

Prayer: Commissioner Peatross
Pledge of Allegiance:  All wishing to participate.

Road Items
Mr. Doug Nielsen stated he has spoke with Mr. Rex Harrison of Horrocks Engineers asking for a meeting on February 23, 2004 at 10:00 a.m. to discuss the Bluebell Road extension.   Commissioner Ross stated Mr. Nielsen should also invite Roosevelt City to the meeting.  Commissioner Ross stated there were a few other issues concerning roads that might be discussed.  Mr. Nielsen stated the Lake Fork Bridge right-of-way is almost complete.  He stated the road department is currently working on the Midview Reservoir Road.

Appointment of County Attorney
Commissioner Ross read the following press release:

The Duchesne County Republican Party Central Committee submitted to the Duchesne County Commission three (3) candidates for consideration as the appointee to the Duchesne County Attorney's Office.  The office became vacant when the elected County Attorney, Cleve Hatch, resigned his position.  The names submitted were: Herbert Gillespie, Karen Allen and Keith Eddington.  All are residents of Duchesne County and are qualified to hold the title and office of County Attorney.  All three candidates are experienced in the areas of responsibility.  The county commission has appointed Karen Allen as Duchesne County Attorney to fill the un-expired term of the former attorney.   Attorney Allen will begin her service February 23, 2004.

Commissioner Stradinger made a motion to appoint Karen Allen to fill the vacancy of County Attorney.   Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

2004 Beer License Approval
Andrea Arnold presented an application for 2004 beer license from Moon Lake Resort.   Commissioner Peatross asked if a background investigation had been completed.   It had.  Commissioner Peatross motioned to approve the 2004 beer license for Moon Lake Resort.  Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Consideration of Morning Agenda Items
During morning meeting, Ms. Katherine Larson of the Roosevelt Family Support Center joined the meeting to discuss the operations of the facility and to request a donation.   Commissioner Stradinger motioned to approve a two thousand dollar ($2000) donation to the Roosevelt Family Support Center.  The request did not come during budget time so the donation will come from the county discretionary fund.  The county commission appreciates the work the facility does for the community.  Commissioner Peatross seconded the motion.   All commissioners voted aye and the motion passed.

Commissioner Stradinger stated the commission has created a committee to draft an animal control ordinance for the community.   There has been an increasing problem of animal control in unincorporated areas of the county with a need for resolve.

Vouchers
Andrea Arnold presented vouchers #86885 through 87000 in the amount of two hundred twenty-seven, nine hundred forty-one dollars and seventeen cents ($227,941.17).   Commissioner Peatross motioned to approve payment of the vouchers.   Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Joe Steed, Utah Mini Ranches, Final Plat Approval
Mrs. Teresa Nielsen presented plat maps for Utah Mini Ranches; Phase 7; Lots 285-342; Sections 8, 9, 16 and 17; Township 4 South; Range 4 West; USB&M (located near Duchesne City).  She stated the plat had come before the Planning Commission and they did approve the phase.  Commissioner Peatross asked if the water supply was sufficient.   Mr. Clint Peatross stated it was at capacity.   Commissioner Stradinger asked if the water contained fluoride.  Mrs. Nielsen stated it did not.  Mr. Clint Peatross stated it was chlorinated.  He stated the water line would need to be enlarged when starting the next phase.  Mrs. Nielsen stated the Road Department Supervisor Douglas Nielsen has inspected and approved the roads.  The roads within the subdivision will remain private and will be the responsibility of the developer or homeowners association.  Commissioner Peatross motioned to approve the final plat for Phase 7; Lots 285-342; Sections 8, 9, 16 and 17; Township 4 South; Range 4 West; USB&M.  Commissioner Stradinger withdrew from the vote due to a conflict of interest.  Commissioner Ross seconded the motion.  Two   commissioners voted aye and the motion passed.

Minutes of Meeting Held February 2, 2004
Commissioner Peatross motioned to approve the minutes.   Commissioner Stradinger seconded.  All commissioners voted aye and the motion passed.

Other Business
Commissioner Ross stated a need to advertise for a Public Defender to replace Karen Allen.   The commission will ask Deputy County Attorney Roland Uresk to draft an advertisement.  Commissioner Stradinger motioned to advertise for Public Defender.   Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

The commission adjourned the meeting at 2:00 p.m.
