MINUTES FOR REGULAR COMMISSION MEETING HELD JANUARY 5, 2004 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Road Supervisor Douglas Nielsen and Andrea Arnold taking minutes

Prayer: Commissioner Ross
Pledge of Allegiance All wishing to participate.

Road Items
Doug Nielsen presented to the commission mylars of right-of-ways on County Road #145 in Clay Basin for approval. Commissioner Ross question if the county is intending to purchase more right-of-ways. Mr. Nielsen stated currently there is not a need to purchase more right-of-ways for this road. All mylars were approved and signed by the commission.

Commissioner Peatross mentioned there have been some comments regarding snow being pushed into driveways when the plows are running. Mr. Nielsen asked what the commission would like to do to solve the problem. Commissioner Peatross stated if time permits the plow could swing into the driveways and push the snow out.

Commissioner Ross asked if the road department employees have been gaining over-time hours. Mr. Nielsen stated they have been due to the bad weather.

Weed Board Appointment
Motion: Commissioner Stradinger motioned to appoint Mr. Todd Moon to fill the vacancy on the Duchesne County Weed Board. (Commissioner Peatross withdrew his position to vote due to conflict of interest). Commissioner Ross seconded the motion. Both commissioners voted aye and the motion passed.

Planning Commission Appointment
Motion: Commissioner Peatross motioned to appoint Mrs. Shelly Fabrizio to fill the vacancy on the Duchesne County Planning Commission. Commissioner Stradinger seconded the motion. All commissioners voted aye and the motion passed.

..........Clerk/Auditor Diane Freston, Treasurer Colene Nelson, Recorder Carolyne Madsen and Deputy Attorney Roland Uresk joined the meeting..........

Hay Property
Attorney Uresk stated he had received a phone call from the Federal Marshall's office concerning back taxes owed to Duchesne County for property #00-029-3179 and #00-0006-7946. He stated the property has back taxes from the years 2001, 2002 and 2003. The property was forfeited to the federal government by court order on February 14, 2003. The Marshall's office is offering to pay taxes, penalties and interest owed prior to the time they took ownership and would like the remaining to be put on exempt status. Attorney Uresk stated this is within the law. Motion: Commissioner Peatross motioned to exempt the property beginning February 14, 2003 and request the previous taxes, penalties and interest be paid. Commissioner Stradinger seconded the motion. All commissioners voted aye and the motion passed.

Organization of Board of County Commission for 2004
Motion: Commissioner Peatross motioned to leave commission assignments as they were for the year 2003 with the exception of the Personnel Department and Wellness Committee will be assigned under Commissioner Stradinger's supervision. Commissioner Stradinger seconded the motion. All commissioners voted aye and the motion passed.

Motion: Commissioner Peatross motioned for Commissioner Ross to remain as Commission Chairman for the year 2004. Commissioner Stradinger seconded the motion. All commissioners voted aye and the motion passed.

Department Head Timesheets
Leann Stewart presented department head timesheets for commission approval and signatures. All were approved.

..........Johnson Water District Representative Bud Steffan, Adelia Richens, Becky Rasmussen, Lanny Ross, and Wayne Hanberg joined the meeting..........

Resolution 04-01 Johnson Water Annexation
Commissioner Ross asked Mr. Bud Steffan to present maps outlining proposed areas to be annexed into the Johnson Water District for the commission and community members to review. Mr. Steffan presented the maps of Township 4 South Range 2 West USM Sections 5, 8,9, & 17. He stated the district plans to annex four (4) sections (approximately 640 acres a section) into the district. He stated these four (4) sections had been left out of both Johnson Water District and East Duchesne Culinary Water District. Commissioner Ross asked why it was left out of both districts. Mr. Steffan stated originally Johnson Water District did not have the resources to service this area and now they do. Commissioner Peatross asked if the district had contacted East Duchesne Culinary Water District. Mr. Steffan stated they had not but the intent to annex was publicly advertised. Mr. Wayne Hanberg expressed his opposition to his property in the north-west corner of Section Five (5) being included in the annexation. Motion: Commissioner Peatross motioned to approve the annexation of Township 4 South Range 2 West USM Sections 5, 8, 9 & 17 into Johnson Water District excluding the north-west corner of section 5 and tribal land. Commissioner Stradinger seconded the motion. All commissioners voted aye and the motion passed.

Vouchers
Andrea Higbee presented vouchers #86374 through #86515 in the amount of three hundred eighty-two thousand, seven hundred twenty-seven dollars and eight cents ($382,727.08). Motion: Commissioner Stradinger motioned to approve the vouchers. Commissioner Peatross seconded the motion. All commissioners voted aye and the motion passed.

Minutes of Meeting Held December 22, 2003
Motion: Commissioner Peatross motioned to approve the minutes as corrected. Commissioner Stradinger seconded the motion. All commissioners voted aye and the motion passed.

Adjournment
The commission adjourned the meeting at 3:30 p.m
