MINUTES FOR REGULAR COMMISSION MEETING
HELD DECEMBER 22, 2003 BEGINNING
AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger and Commissioner Kent Peatross.

Others Present:  Road Supervisor, Doug Nielsen and Andrea Higbee taking minutes.

Prayer: Commissioner Peatross
Pledge of Allegiance:  All wishing to participate.

Library Board Appointment
Commissioner Ross asked Mrs. Jeannie Mecham to tell the commission about herself and her interest in sitting on the Library Board.  Mrs. Mecham told about herself and how she was originally interested in the bookmobile position but has a general interest in reading and the library.  Commissioner Peatross motioned to appoint Mrs. Mecham to fill the vacant seat on the Duchesne County Library Board.  Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Road Department Items
Mr. Nielsen reminded the commission of the environmental public hearing scheduled today at 4:00 p.m.  Commissioner Peatross reminded Mr. Nielsen of the SITLA meeting tomorrow at 11:00 a.m.

Mr. Nielsen stated the Road Department would be running the snow plows during bad weather beginning at 4:00 a.m.

Mr. Nielsen asked the commission if the sink and counter that is in the old Roosevelt Senior Citizen's building could be transferred to the Road Department.  Commissioner Ross stated that he would not like anything taken out of the building that prospective buyers have seen when shown the building.  Commissioner Ross would like to get a clarification of whether or not the sink and counter are included with the sale of the building and then will let Mr. Nielsen know if he can transfer them.

Mr. Nielsen asked if an offer from the county of two thousand dollars ($2,000) for the purchase of a right-of-way on Road #29 was acceptable.  This amount will purchase 1.5 acres from Mr. Milton Moon for county use.  Commissioner Peatross motioned to approve the acquisition.  Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Ordinance 03-214
Attorney Uresk presented Ordinance 03-214 to vacate Class 'D' Roads in Township 2 South Range 9 West USM (Bandana Ranch). He stated that the descriptions for sections 34 and 35 have been corrected.  Commissioner Stradinger motioned to approve the vacation.   Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Ordinance 03-215
Attorney Uresk presented Ordinance 03-215 to vacate Class 'D' Roads in Township 3 South Range 3 West USM (Beck Road).  Mr. Beck has complied with the arrangement to relocate the fence from the south to the north.  Commissioner Peatross motioned to approve the vacation.  Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Resolution 03-16
This item of Library Memorandum of Understanding has been tabled to another date.   Attorney Uresk would like to note for the record that this item should be listed as Ordinace 03-216.

Resolution 03-17
Clerk/Auditor Freston presented Resolution 03-17 Certification of 2004 Budget:

DUCHESNE COUNTY RESOLUTION 03-17
CERTIFICATION OF BUDGET
DUCHESNE COUNTY
Calendar Year Ending December 31, 2004

ADOPTION OF BUDGET INFORMATION:

In compliance with Title 17, Chapter 36, Section 15, Utah Code, which states:

"On or before the last day of each fiscal period, the governing body by resolution shall adopt the budget which, subject to further amendment, shall thereafter be in effect for the next fiscal year.  A copy of the final budget, and of any subsequent amendment thereof, shall be certified by the budget officer and filed with the state auditor not later than thirty days after its adoption.  A copy, similarly   certified, shall be filed in the office of the budget officer for  inspection by the public during business hours."

WHEREAS the legislature of the State of Utah has granted legislation providing for the adoption of said county annual budgets and;

WHEREAS there exists a need to utilize this provision of the State statutes to serve the best interest of the County and the residents thereof and to promote the most efficient and practical operation of county government.  The purpose of this resolution is to adopt the 2003 Duchesne County Budget by revenue and expenses;

NOW THEREFORE, be it hereby resolved as follows;

WE, THE BOARD OF COUNTY COMMISSIONERS of Duchesne County, State of Utah as governing body of this county do enact this resolution to adopt said budget for the year 2004.

PASSED AND ADOPTED THIS 22nd DAY OF DECEMBER, 2003 by the following vote of the Board of County Commissioners.

Commissioner Stradinger stated for the record she has an objection to the Building Department's intention to hire an additional building inspector because the number of permits have declined and the county has already contracted an inspector on a part-time basis to cover excess inspections.  She stated withstanding those issues she supports the remainder of the budget.  Commissioner Peatross motioned to ratify the 2004 Budget.  Commissioner Stradinger seconded the motion subject to her previously stated objections.  All commissioners voted aye and the motion passed.

Resolution 03-18
Clerk/Auditor Freston presented Resolution 03-18 Increase of 2003 Budget:

DUCHESNE COUNTY RESOLUTION 03-18

WHEREAS the legislature of the State of Utah has granted legislation providing for the increase in unencumbered or unexpended appropriations from one department to another
within the same fund, the said legislation being designated as Section 17-36-25 & 26 of the Utah Code annotated, 1953,and amended 1975; and

WHEREAS there exists a need to utilize this provision of the State statutes to serve the best interest of the County and the residents thereof and to promote the most efficient and practical operation of county government.  The purpose of this resolution is to increase the 2003 Duchesne County Budget by revenue and expenses and free up said monies spent;

NOW THEREFORE, be it hereby resolved as follows;

WE, THE BOARD OF COUNTY COMMISSIONERS of Duchesne County, State of Utah as governing body of this county do enact this resolution to increase the following amounts to the listed departments within the following funds for the Budget year
2003.

Resolution 03-19
Clerk/Auditor Freston presented Resolution 03-19 Establishing Salaries for 2004.   Commissioner Ross stated elected officials are required to list their salaries for the public.

RESOLUTION ESTABLISHING SALARIES FOR 2004

Ordinance establishing and affixing the salaries of elected and statutory officers of the County of Duchesne:

WHEREAS, Utah Code Annotated (1953 as amended), Section 17-16-14, provides for the establishment by the Board of County Commissioners of salaries for County Officers; and,

WHEREAS, it is appropriate that said salaries be set forth in the resolution form;

NOW THEREFORE, BE IT ORDAINED and resolved that the annual salaries of the elected and statutory officers of Duchesne County be fixed or established as follows:

Commissioner Peatross motioned to approve 2004 salaries.   Commissioner Stradinger seconded the motion and stated she would like to thank the elected officials and acknowledges their hardwork and contribution to the county.  All commissioners voted aye and the motion passed.

Resolution 03-21
Clerk/Auditor Freston presented Resolution 03-21 Transfers to 2003 Budget.

DUCHESNE COUNTY RESOLUTION 03-21

WHEREAS the legislature of the State of Utah has granted  legislation providing for the transfer of any unencumbered or unexpended appropriation balances from one department to another within the same fund, the said legislation being designated as Section 17-36-23 of the Utah Code annotated, 1953,and amended 1975; and

WHEREAS there exists a need to utilize this provision of the State Statutes to serve the best interest of the County and the residents thereof and to promote the most efficient and practical operation of county government.

The purpose of this resolution is to transfer expenditure monies of the 2003 Duchesne County Budget from one department to another within the various funds.

NOW THEREFORE, be it hereby resolved as follows;

WE, THE BOARD OF COUNTY COMMISSIONERS of Duchesne County, State of Utah as governing body of this county do enact this resolution to increase or decrease the following amounts to the listed departments within the same fund for the Budget year 2003.

Commissioner Peatross motioned to approve adjustments.    Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Clerk/Auditor Freston presented a request from the estate of Ms. Hastings asking the county to forgive any penalties and interest owed because of her death.   Commissioner Stradinger motioned to forgive the penalties and interest.   Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Vouchers
Andrea Higbee presented vouchers #86278 through #86420 in the amount of two hundred one thousand, five hundred eighty-eight dollars and eight cents ($201,588.08) for approval.   Commissioner Stradinger motioned to approve the vouchers with the addition of the Muir's Smokehouse payment for the county employee Christmas party.  Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Minutes of December 15, 2003
Commissioner Peatross motioned to approve the minutes with corrections.  Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Pipeline Bond
This item of a pipeline bond in Bandanna Ranch Subdivision is tabled until further information can be received from Planning and Zoning.

Procedure to Fill Vacancy of County Attorney
Commissioner Ross stated that County Attorney Cleve Hatch has resigned from the position effective December 31, 2003.  The commission is reviewing the process outlined by Utah State Code to fill the vacancy.

Uinta Management Group Computer Contract
Mr. Brennan presented the revised contract for computer services with the changes instructed in morning meeting.  Commissioner Stradinger motioned to approve the contract as amended.  Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Animal Control Concern
Mr. Luke Stradinger stated he stopped by today to express his concern for animal control within Duchesne County.  He explained recently his daughter had been bitten by a stray dog during school at the Neola Elementary's playground.  Mr. Stradinger encouraged the commission to put an ordinance in place for animal control.  The commission stated they would take his request under advisement.
