MINUTES FOR REGULAR COMMISSION MEETING HELD
OCTOBER 27, 2003 BEGINNING AT 1:00 P.M.
IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH
Present:
Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, Commissioner Kent R.
Peatross, Road Supervisor Douglas Nielsen and Andrea Higbee taking minutes.

All wishing to participate.
Road Items:
Douglas Nielsen stated that he had not been able to contact Rex Harrison of Horrocks
Engineering concerning the Arcadia Road. He will keep trying. Mr. Nielsen
stated that he had received a phone call from Iowa Tank Lines informing him that the
Pariette Road was rough. Inland phoned and told Mr. Nielsen that they would provide
the water if the county would be able to grade the Pariette Road. Mr. Nielsen stated
that the unpaved roads were bad this year because of the dry weather. Mr. Nielsen
stated that the road department would be finishing the shoulder work on 4000 South Road at
the end of this week.
Commissioner Ross asked if the road department
had resolved the washboard problem on the 5000 South Road. Mr. Nielsen replied that
they had watered, graded and rolled the road. He stated that they had also installed
a 25 mph (twenty-five miles per hour) sign.
Commissioner Ross asked if Interstate Barricade
had completed painting the roads. Mr. Nielsen replied that they had completed
painting the roads in Fruitland, Bluebell and the East River Road; which amounted to
approximately 53 (fifty-three) miles that have been center striped.
Commissioner Ross asked when the Bridgeland
Bridge project would be going to bid. Mr. Nielsen replied that he would ask Mr.
Harrison when he is able to contact him.
Commissioner Stradinger asked if the road in
Utah Mini Ranches were approved as to bond requirements. Mr. Nielsen replied that
Phases 1 (one) through 5 (five) had been approved.
Commissioner Ross asked what arrangements the
road department had for hauling the salt this year. Mr. Nielsen replied that the
road department would haul approximately 600 (six hundred) tons. Roosevelt City requested
that the county haul the salt the them. The road department will then bill Roosevelt
City for salt cost and truck time.
Appointment of Fair Board Member:
The commission reviewed resumes submitted for consideration of appointment to the Duchesne
County Fair Board. Commissioner Peatross motioned to appoint Janet Jenkins to fill
the vacant seat. Commissioner Ross seconded the motion. Both
commissioners voted aye and the motion passed.
Consideration of Morning Agenda Items:
Commissioner Ross stated the commission had received Northeastern Counseling
Center's (NEC) annual audit. Commissioner Ross feels NEC has been doing well.
Commissioner Stradinger feels the center is a commendable organization.
Auditor's Office:
Deputy Clerk/Auditor Higbee presented vouchers #85509 to #85780 in the amount of
$238,442.16 (two hundred thirty-eight thousand, four hundred forty-two dollars and sixteen
cents) for approval. Commissioner Peatross motioned to approve the vouchers.
Commissioner Ross seconded the motion. Both commissioners voted
aye and the motion passed.

Public Hearing - Vacating Class 'D' Road
in T3SR3W SEC. 17&20 at 2:00 pm
Commissioner Ross stated that the public hearing was being conducted to gather public
comment in response to a proposal from Mr. Beck to vacate the county's interest in the
class 'd' road in Township Three South Range Three West Sections Seventeen and Twenty
(T3SR3W SEC. 17 & 20). Commissioner Ross asked for comments from the citizens.
Mr. Beck stated he would like the county to
vacate its interest because the road runs through the middle of his property and ends at a
trail next to an irrigation ditch. He stated the ditch was not in use. Mr.
Beck stated portions of the road have been washed out and it is basically impassible.
Mr. Beck stated that there are other routes to the Baby Cemetery that is located in
Section Twenty (20). Commissioner Peatross asked if the cemetery bordered
Indian property. Mr. Beck stated the Baby Cemetery is approximately one-half mile
west of Indian property. Commissioner Ross asked how long it had been since the
public had used the road. Mr. Beck stated he had put up a fence seven (7) years ago
and before that the public use was minimal.
Mr. Wilkerson stated that there are several
property owners who use the road as an access even though it is a lot rougher than other
routes. Commissioner Peatross asked what size the other properties were. Mr.
Wilkerson stated they varied from ten (10) to forty (40) acres. Commissioner Ross
asked if the properties bordered Indian property. Mr. Wilkerson stated he believed
some do. Commissioner Ross asked if there were any more comments. No response.
Commissioner Ross stated the commission would have an official response to Mr.
Beck's request within ten (10) days and a notice would be sent to the appropriate parties.
Public hearing closed at 2:20 pm.

Kenneth Morton, Fay Horrocks, Doug Prescott, Ralph Prescott,
Lynn Prescott, Alan Haslem, Keith Bastian, Wanda Bastian
and Leroy Pectol joined the meeting
Public Hearing - Establishment of
Cedarview/Montwell Water District at 2:30 pm
Commissioner Ross stated the public hearing was being conducted in order to
determine which citizens would or would not like to be a part of the proposed
Cedarview/Montwell Water District. Commissioner Ross asked for comments from the
citizens.
Mr. Doug Prescott stated he that there are
approximately sixty-two (62) residents in the Neola/Hayden area to find out if they would
like to participate in the district or not. He stated that he had spoken with three
(3) in favor, forty-two (42) against, sixteen (16) he was unable to contact and two (2)
undecided. Mr. Prescott stated he felt the citizens had not been given enough
information concerning the district. He stated the citizens are concerned about
being taxed for the district.
Mr. Alan Haslem stated he lives in east Neola
and had just learned of the proposed district. Commissioner Peatross asked what his
current water source is and if it is sufficient. Mr. Haslem stated he has a well and
it is sufficient so far. Mr. Haslem stated the community needs more information on
this proposal and he is opposed to his property being included in a new taxing district.
Mr. Leroy Pectol stated he is in favor of the
proposed water district although his property is excluded. He would like the
commission to be aware that the property owners adjoining his property have Roosevelt City
water.
Mr. Karl Schisler stated he doesn't wish to
discourage the water district proposal but he would like his property in Section Nine (9)
and Sixteen (16) to be excluded from the district. He stated that his property is
not in need of the water and he doesn't believe it ever will be in need because of the
natural springs located on his property. He stated that he had not been informed of
the proposed district until recently.
Ms. Monday Taylor stated there was two meetings
held that were noticed in the Uintah Basin Standard. One of those meetings was held
in Roosevelt City and the other at the Neola Elementary School. In addition, there
are meetings held on the fourth (4th) Wednesday of every month at her home. Mr. Mike
Barneck stated the district couldn't be researched any further until it becomes a legal
entity. Ms. Taylor stated Randy Crozier from the Duchesne County Water Conservancy
District was assisting the proposed district with survey of where to obtain the water.
Commissioner Ross asked if they would be holding another meeting. Ms. Talyor
stated there would be another meeting held on November thirteenth (13th) at 6:30 pm at the
Neola Elementary School. Commissioner Ross stated the county does not intend to
conduct another public hearing concerning this issue. It is the property owner's
responsibility to read public notices and attend the meetings with the proposed district.
Commissioner Ross stated after the proposed district held their next meeting,
gather information concerning appropriate boundaries and bring this information back to
the commission during morning meetings. The commission will then make a decision. Public
hearing closed at 3:20 pm.

Commissioner Peatross motioned to approve the minutes with corrections. Commissioner Ross
seconded the motion. Both commissioners voted aye and the motion passed.
