MINUTES FOR REGULAR COMMISSION MEETING HELD
OCTOBER 6, 2003 BEGINNING AT 1:00 P.M.
IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Deputy Attoney, Roland Uresk and Andrea Higbee taking minutes.

Prayer: Commissioner Ross.
Pledge of Allegiance: All wishing to participate.

Consideration and Appointment of Fair Board Member
This item has been tabled to a later date.

Consideration of Cooperative Agreement with UDOT for Right-of-Way
Commissioner Ross read a letter dated September 30, 2003 from the Utah Department of Transportation (UDOT).  The letter outlined instructions to fulfill a cooperative agreement to obtain a right-of-way for project #BRO-LC13(5) (Lake Fork Bridge Project).   The commission noted that there is an incorrect amount of $26,000.00 (twenty-six thousand dollars and no cents) as the amount the county needs to match the agreement.   The correct match amount of $2,600.00 (two thousand six hundred dollars and no cents) is listed in the agreement.  Commissioner Peatross motioned for the approval of the cooperative agreement with UDOT.  Commissioner Stradinger seconded the motion.   All commissioners voted aye and the motion passed.

Ordinance 03-212 - Transient Room Tax and UAC Agreement
Commissioner Ross stated that Ordinance 03-212 is an agreement with the Utah Association of Counties (UAC) to collect the Transient Room Tax.  Currently the Utah State Tax Commission collects this tax for Duchesne County.  Commissioner Stradinger stated that she would like to add a section in the ordinance stating the county will have seventy-five days to withdraw from the agreement.  This section is specified in the agreement with UAC but is not in Ordinance 03-212.  Commissioner Stradinger stated that she would prefer the county to collect the tax in-house through the Auditor's office although she is in agreement with allowing UAC to collet the tax for one year.   Commissioner Stradinger would like to review the agreement in one year.   Commissioner Stradinger motioned for the approval of Ordinance 03-212.   Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Consideration of Tax Abatement Applications
Ms. Stewart stated in the past the commission has abated property taxes for individuals whose annual household income is less than $10,000.00 (ten thousand dollars and no cents).   The criteria for tax abatements is that the individual needs to be sixty-five years or older and one of the following: disabled, a widow/widower, or indigent with an annual household income of less than $24, 246.00 (twenty-four thousand, two hundred forty-six dollars and no cents).

Ms. Stewart stated the applicant for property tax abatement on property HT-91-0412 is under the age of sixty-five and has an annual household income of less than $10,000.00.   Commissioner Peatross motioned to abate current year taxes and back taxes/penalties/interest for property HT-91-0412.  Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Ms. Stewart stated that applicant for property tax abatement on property 00-030-6500 is under the age of sixty-five and has an annual household income in excess of $10,000.00.   Commissioner Stradinger motioned to deny the application for property tax abatement on property 00-030-6500.  Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Ms. Stewart stated that the applicant for tax abatement of property 00-001-6232 is under the age of sixty-five and is disabled. Commissioner Peatross motioned to abate current year taxes and half of back taxes/penalties/interest for property 00-001-6232. Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.

Vouchers
Ms. Higbee presented vouchers 85366 through 85452 in the amount of $70,002.17 (seventy thousand, two dollars and seventeen cents) for approval.  Commissioner Stradinger motioned for payment of vouchers.  Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Tax Adjustments
Ms. Higbee presented to the commission tax adjustments as follows:

HT-22-0185 2003 -$465.50 Refund due to circuit break application.

Commissioner Stradinger motioned to approve the tax adjustments. Commissioner Peatross seconded the motion.  All commissioners voted aye and the motion passed.

Minutes of Commission Meeting
Commissioner Peatross motioned to approve the minutes of commission meeting held September 29, 2003 as corrected. Commissioner Stradinger seconded the motion.  All commissioners voted aye and the motion passed.
