MINUTES FOR REGULAR COMMISSION MEETING HELD AUGUST 18, 2003 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Road Supervisor Douglas Nielsen, Mike Haggard, and Carol Casey taking minutes

Road Items: Mr. Nielsen stated the road department is currently overlaying asphalt on 4000 South and Highway 40. They expect to lay approximately eighteen hundred tons of asphalt a day over the next ten working days. Mr. Nielsen also stated that they still have the cemetery in Duchesne left to pave.

Mr. Nielsen updated Mr. Haggard on the statues of the road on 5000 South he requested to be added to the county road system. A quarter mile of the road will be added to the Class B Road system.

Auditor's Office - Tax Adjustments - Vouchers - Personnel Issues
Personnel Issues: Personnel Director Carrie Mascaro was unable to attend the commission meeting. She asked Commissioner Ross to present the names of the new hire for the road department and a part-time controller for the justice center. Mr. Nielsen has also requested an extension and a pay raise for a part-time person at the landfill until the time change this fall.  Commissioner Stradinger inquired as to what the policy is for part-time personnel raises. Mr. Nielsen will check with Mrs. Mascaro regarding wage structure for part-time employees.

Approval of August 11, 2003 Commission Minutes
The minutes of August 11th were reviewed and corrections made.
Motion: Commissioner Stradinger made a motion to approve the minutes as corrected.  Commissioner Peatross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.
   
Time Sheets: Deputy Clerk/Auditor Leann Stewart presented the department head time sheets for review.
   
Vouchers: Deputy Clerk/Auditor presented vouchers #84596 to #84711 totaling $120,474.14 for approval.  Motion: Commissioner Peatross made a motion to approve the vouchers. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

3:00 PM Public Hearing - Creating Cedarview-Montwell Special Service District
On July 14th the commissioners adopted a resolution declaring the intent to establish a special service district for the purpose of providing water services and performing such duties as are ancillary to the primary purposes of a culinary water system within the boundaries of the district. Description of the proposed district (see attachment)

Present: Val Larsen, Fern Oberhansly Labrum, Irene Hansen, Phil Johnson, Shirley Rogers, Barbara Crozier, Bud Steffen, Mondi Taylor, Evelyn & Gail Loranger, Brad Hancock, Judy & Robert Hamblin, Howard Horrocks, Loraine Richens, Lanny Ross, and Don Winterton.

Commissioner Ross stated that the purpose of the public hearing is to take input or comments for or against the establishment of a Cedarview-Montwell Special Service District. The commission will not make a decision today. The decision will be announced on September 8th during the regular commission meeting.

Sherry Rogers commented that most the well water in the Cedarview and Montwell area is undrinkable. The wells have several filter systems on them and they are still not palatable. The animals are even getting sick, she stated.

Val Larsen stated that he represents North Neola. The water there is good at this time, but in the future the status of their water could change. He is interested in joining the water district.

Brad Hancock, Roosevelt City Manager and Duchesne County Water Conservancy District Board member stated that he is in favor of the forming of a water district to service the area. Prior to DCWCD being involved some residents approached Roosevelt City Water about getting water service to the area. The cost was somewhat prohibitive because the distance for water lines. Now that DCWCD is involved a culinary water feasibility study will be done. The study will identify water sources and distribution. While the Cedarview-Montwell district is being formed it is mandatory that the boundaries are correct. 

Attorney Uresk asked if Roosevelt City Water charges the 1 ½ times water fee allowed by state statue for water supplied to residents outside the city limit. Mr. Hancock answered that they do.

3:50 PM Commission Meeting Resumed
Don Winterton, DCWCD, has concerns about the maps and the descriptions matching. There could be double taxation if it is not cleared up. Roosevelt City Water lines go into some of the area where the district is proposed to be.  Attorney Uresk stated that the legal descriptions were furnished by the other water districts.  Commissioner Ross stated that all the errors will be corrected before the district is legally created.

Fern Oberhansly Labrum asked if the Neola Water District will be left as the Neola Water District.  Attorney Uresk stated that Neola's water district is to remain as is. This hearing is to determine where the other water district boundaries are and to take comments regarding the formation of the Special Service District.

Mrs. Labrum went on to ask why the district is including tribal trust lands. The commission answered that even though the lands will not be taxed in the district tribal members owning land may sign up to receive culinary water.

Loraine Richens asked where the water sources would be coming from.  Val Larsen, DCWCD stated that they will be looking for good water sources, taking into consideration that the entire east side of the county could benefit from the studies.
