MINUTES FOR REGULAR COMMISSION MEETING HELD AUGUST 4, 2003
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Others Present: Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, and Carol Casey taking minutes.

Road Items: Mr. Nielsen made a request that a public hearing be held to include the existing roads in Equestrian Estates into the county Class B Road system. Commissioner Stradinger stated that she would prefer that the subdivision roads continue as private roads. She further stated that the county has enough B Roads to take care of. More B Road funding will result in expanding the road department, which then competes with the private sector.  Commissioner Peatross stated that since Equestrian Estates is next to a recreational area they should be consider including the roads in the county B Road system. A hearing will give the public a chance to voice their opinion.   Commissioner Ross clarified that the subdivision has a fifty-foot right-of-way. Mr. Nielsen stated the county standards for new subdivision roads are sixty-six feet.   Commissioner Stradinger questioned why the county would want to adopt a road that doesn't have the required right-of-way of sixty-six feet. In the past the commission has told people requesting their roads be put on the county system that they must first obtain a sixty-six foot right-of-way. She said that she believed that the county should be consistent in that everyone should be treated the same.  Commissioner Peatross commented that the property owners in the subdivisions will never have the funding it takes to improve their roads. There needs to be guidelines for exception to right-of-ways for dealing with these old subdivision roads in the county.  Commissioner Ross stated that there are many circumstances in the county where roads cannot be the required width.   Attorney Uresk stated that under the grandfather provision it is up to the commission's discretion to accept a smaller right-of-way if they consider the road to be adequate.  Motion: Commissioner Peatross made a motion to have a public hearing on wether or not to accept the roads in Equestrian Estates as county Class B Roads. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Mr. Nielsen stated that the paving in the Fruitland and Tabiona areas is almost complete. They have used 35,000 tons of asphalt so far. The road department will be moving to the Roosevelt area next.

Mr. Haggard asked for a grader to come grade the road at 5000 South on Bluebench. He also stated that when the road is wet the garbage truck can not get in.   Mr. Nielsen will research the status of the road and will review it with the commission next week.

Cattle guard Issues - Argyle Canyon:  Mr. Jay Abbott requested that two cattle guards be installed in Argyle Canyon referencing a 1964 memorandum of Understanding. The county road supervisor and the commission has reviewed the agreement and discussed the issue with the BLM office for their opinion. The BLM according to their opinion furnished furnished the two cattle guards. BLM provided a letter to the county road supervisor stating that an adjoining property owner stated the guards were installed. Because the agreement is thirty nine years old and the letter provided by the BLM office supports that the installations were made it is the position of the county that Mr. Abbotts request be denied. Motion: Commissioner Peatross made a motion that because of the MOU and an agreement dated January 9, 1964, Duchesne County is not responsible to place cattle guards on Jay Abbott's property in Argyle. Commissioner Stradinger second. Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Request of Representation by Officials and Defendants in Duchesne Land LLC vs Duchesne County:  Building Inspector Karl Mott and Deputy Attorney Roland Uresk submitted written requests for legal representation in Duchesne Land LLC vs Duchesne County.      Motion: Commissioner Peatross made a motion to defend Deputy Attorney Roland Uresk and Building Inspector Karl Mott in all aspects of the defense. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Auditor's Office - Tax Adjustments - Vouchers
Approval of July 28, 2003 Commission Minutes:  The minutes of July 28th were reviewed and corrections made.  Motion: Commissioner Peatross made a motion to approve the minutes as corrected.   Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Time Sheets:  Deputy Clerk/Auditor Leann Stewart presented the department head time sheets for review.

Vouchers:   Deputy Clerk/Auditor presented vouchers #84471 to #84504 totaling $44,334.38 for approval.  Motion: Commissioner Stradinger made a motion to approve the vouchers. Commissioner Peatross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.
