MINUTES FOR REGULAR COMMISSION MEETING HELD JULY 14, 2003
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, McClain Miles, Michelle Miles, and Carol Casey taking minutes.

Prayer: Commissioner Peatross
Pledge of Allegiance

Road Items: Mr. Nielsen presented payment request No. four for consultant services on the Lake Fork River Bridge, project No. BRO-LC13(5) in the amount of $25,548.24 from Horrocks Engineers. Mr. Nielsen also presented payment request No. eight for consultant services on the Bridgeland/Duchesne River Bridge, project No. BRO-LC13(4) in the amount of $3,690.06.  Motion: Commissioner Peatross made a motion to approve payment request No. 8 in the amount of $3,690.06. Commissioner Ross second. Motion carried. Roll Call Vote: Two Commissioners Voting Aye.

Commissioner Stradinger stepped out momentarily.

Motion: Commissioner Peatross made a motion to approve payment request No. 4 in the amount of $25,548.24. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Mr. Nielsen stated the road department will finish paving on CR#14 tomorrow. The next projects will be in the Fruitland area. They also plan to finish the Fruitland Cemetery project.

McClain Miles - Eagle Scout Project
Mr. Miles is a member of Scout Troop #249. He stated that for his scout project he would like to place a metal four by four foot sign on the county road as it leaves SR# 87 going to the Altamont Rodeo Grounds. The sign will be painted white with a cartoon cowboy pointing direction to the rodeo grounds. Mr. Nielsen will work with Mr. Miles on proper placement of the sign.  Motion: Commissioner Stradinger made a motion to approve the placement of a sign giving direction to the rodeo grounds by McClain Miles. Commissioner Peatross second. Motion carried.  Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of Ordinance 03-211
AN ORDINANCE VACATING CERTAIN CLASS "D" ROADS IN SECTIONS 1 AND 12, TOWNSHIP 1 SOUTH RANGE 8 WEST USM.  (Refer to Clerk's Office)  Motion: Commissioner Peatross made a motion to approve Ordinance 03-211. Commissioner Stradinger second. Motion carried . Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of Resolution 03-13
A RESOLUTION ANNEXING CERTAIN LANDS INTO
THE UPPER COUNTRY WATER IMPROVEMENT DISTRICT
  (Refer to Clerk's Office).  Motion: Commissioner Stradinger made a motion to approve Resolution 03-13. Commissioner Peatross second. Motion carried . Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of Resolution 03-14
Mr. Barneck stated that citizens in the Montwell/Cedarview area are trying to develop culinary water. By forming a district they become a legal entity and will have a better chance filing on a water source once one is found. Mrs. Taylor stated that her water well is contaminated and unfit for drinking.

A RESOLUTION DECLARING THAT THE PUBLIC HEALTH, CONVENIENCE AND NECESSITY REQUIRE THE CREATION OF A SPECIAL SERVICE DISTRICT, TO BE KNOWN AS THE CEDARVIEW-MONTWELL SPECIAL SERVICE DISTRICT, DEFINING THE BOUNDARIES OF SAID SPECIAL SERVICE DISTRICT AND THE SERVICES TO BE PROVIDED THEREIN, PROVIDING FOR A HEARING ON THE CREATION OF SAID SPECIAL SERVICE DISTRICT AND PROVIDING FOR NOTICE OF SAID HEARING AND RELATED MATTERS  (Refer to Clerk's OfficeMotion:  Commissioner Stradinger made a motion to approve Resolution 03-14. Commissioner Peatross second. Motion carried . Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of Resolution 03-15
A RESOLUTION ESTABLISHING PROCEDURE AND SETTING FEES FOR REQUESTS TO VACATE, OR NARROW PUBLIC ROADS  Motion: Commissioner Peatross made a motion to approve Resolution 03-15. Commissioner Stradinger second. Motion carried.  Roll Call Vote: All Commissioners Voting Aye.

Final Plat Approval for Moose Ridge Subdivision
Teresa Nielsen, Planning & Zoning Director presented the plat for review. She stated that the planning commission has given a favorable recommendation.  Motion: Commissioner Stradinger made a motion to approve the final plat for Moose Ridge Subdivision as recommended by the planning commission. Commissioner Peatross second. Motion carried.  Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of Agreement with Brownie's Excavation, Inc.  This agreement entered into on this 14th day of July, 2003, between Duchesne County, a political subdivision of the State of Utah, hereinafter referred to as the "County" and Brownie's Excavation, Inc., hereinafter referred to as "Contractor". The parties hereby agree as follows:  (Refer to Clerk's Office). 

Motion: Commissioner Peatross made a motion to approve the agreement with Brownie's Excavation. Commissioner Stradinger second. Motion carried . Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of Bookmobile Contract   (See attachment in Clerk's Office).  Motion: Commissioner Stradinger made a motion to approve the Bookmobile Contract. The issue of budget for the Bookmobile is to be moved into the library budget and will be under direction of the Duchesne County Library Board. Commissioner Peatross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

The minutes of July 7th were reviewed and corrections made.  Motion: Commissioner Peatross made a motion to approve the minutes as corrected. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Vouchers: Deputy Clerk/Auditor Becky Norris presented pre-draw 84190 and vouchers #84191- #84285and totaling $379,807.33 for approval.   Motion: Commissioner Peatross made a motion to approve the vouchers. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.
