MINUTES FOR REGULAR COMMISSION MEETING HELD JULY 7, 2003
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Deputy Attorney Roland Uresk, Road Supervisor Douglas Nielsen, Carol & Con Geertsen, Jim Brown and Carol Casey taking minutes.

Prayer: Commissioner Ross
Pledge of Allegiance

Road Items: Mr. Nielsen stated that the road department is currently finishing with the asphalt on two miles on CR #92. They will pave two miles on CR #14 and two miles on CR #15 in Red Creek.

Consideration and Approval of Bid for Concrete at the Fairgound Livestock Building  Two bids were received before the time limit of 10:00 AM. One bid was received after the time limit. The late bid will not be opened or considered.  The commission opened and reviewed the two bids this morning during the commission work meeting. They are as follows: 

Bidder #1 Kielbasa Contracting, Inc. ---- $5,814.00
Bidder #2 Brownie's Excavation, Inc. ---- $5,300.00

Motion: Commissioner Stradinger made a motion to accept the low bid of $5,300 from Brownie's Excavation. Commissioner Peatross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Hope Shaw - Tax Issues
Mrs. Shaw stated that her husband passed away four years ago. Her taxes are behind and she is requesting some consideration of the penalty and interest. Once the taxes are brought current, Mrs. Shaw will qualify for the abatement program.

Motion: Commissioner Peatross made a motion to wave the penalty and interest. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Decision on Request to Vacate Certain Class D Roads in the Sandwash and Hanna Areas  Commissioner Ross stated that the commission will give the oil companies two weeks to present information regarding the roads they use in the Sandwash area.

Motion: Commissioner Peatross made a motion to continue the Sandwash D road decision pending more information.  Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Attorney Uresk stated that the commission could make a decision regarding the D roads in the Hanna area today, then adopt the ordinance next week during commission meeting.

Commissioner Peatross stated that it is not appropriate to vacate the Class D Road used as access to the Terra del Sol Subdivision.

Motion: Commissioner Stradinger made a motion to vacate the county interest in the road going north through Section 12 the portion of the Class "D" road located in the West ½ Southwest ¼ and the North ½ except that portion Northwest corner north of the intersection with the Class "D" road that connects to 42250 West CR 211 in Section 1 the portion of the Class "D" road located in the South ½ Southeast ¼. She also motioned to retain the Class D road in the East ½ Southwest ¼ from 7000 North, north through Terra del Sol Subdivision. Commissioner Peatross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

2:00 PM Public Hearing - On the Proposed Annexing of Certain Properties into Upper Country Water District
There were no comments made.

Ilene Jensen discussed recording the annexed property. She recently learned that annexed property for the last four years has not been recorded. There was a discussion on whose responsibility it is to record the documents. The responsibility usually lies with the party that pays for the recording. She also had questions regarding the taxes on the annexed property. Attorney Uresk stated that the property would be taxed this year.

Consideration and Approval of Agreement With the Eighth Judicial District for Bailiff Services (See attachment in clerk's office).   Motion: Commissioner Stradinger made a motion to accept the agreement for bailiff services with the Eighth Judicial District. Commissioner Peatross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of Property Purchase for Fire Station in Neola  Motion: Commissioner Peatross made a motion to approve the purchase of property in Neola in the amount of $7,575.00. The purchase is contingent upon an active sewer and water connection. The check will be held in escrow by Farm & Home Title. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Final Approval Phase Six - Utah Mini Ranches
Teresa Nielsen, Planning & Zoning stated that Phase Six has received a favorable recommendation from the Planning Commission.

Motion: Commissioner Peatross made a motion to approve Phase Six of Utah Mini Ranches. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Executive Session
Motion: Commissioner Peatross made a motion at 3:05 to go into executive session to discuss pending litigation. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Motion: Commissioner Peatross made a motion at 3:25 to go out of executive session. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Auditor's Office - Tax Adjustments - Vouchers

Approval of June 23, and June 30, 2003 Commission Minutes   The minutes of June 23rd, and June 30th were reviewed and corrections made.  Motion: Commissioner Peatross made a motion to approve the minutes as corrected. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Vouchers: Deputy Clerk/Auditor Becky Norris presented vouchers #84045 - #84187 totaling $176,892.60 for approval.  Motion: Commissioner Peatross made a motion to approve the vouchers. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Time Sheets: Deputy Clerk/Auditor Leann Stewart presented the department head time sheets for review.

Other Business
Bonnie Reynolds wanted to discuss the Class D road vacations in the Sandwash area. She owns lots 96 & 97 in Crescent Lake Estates. Mrs. Reynolds lives out of state and has problems of vandalism on her property. She would like to go on record as being in favor of the road vacation.

County Clerk/Auditor Diane Freston and County Recorder Carolyn Madsen wanted to discuss recording of the annexed property for Upper Country Water. Mrs. Madsen stated that bringing the properties current in time for certification this year could be a problem. They will need to check and see how many parcels are affected. The code states that the cut off date is January 1st . The recorder's office usually stretches the time until April. The affected offices will do extra work to finish in time.
