MINUTES FOR REGULAR COMMISSION MEETING HELD JUNE 30, 2003
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, Clerk/Auditor Diane Freston, and Carol Casey taking minutes

Prayer: Commissioner Kent Peatross
Pledge of Allegiance

County Attorney Cleve Hatch and Personnel Director Carrie Mascaro presented a name for deputy attorney. Mr. Hatch commented that the person has experience and lives in the Basin area.

After a wage offer and working conditions have been agreed to the name of the assistant county attorney will be placed in the files of the personnel director and the public will be advised.

Commissioner Stradinger stated that she encourages the new attorney to become a Duchesne County resident.

Motion: Commissioner Peatross made a motion to accept the person recommended by the county attorney as deputy attorney. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Mr. Mitchell discussed the vacating of one of the Class D Roads in the Sandwash area. There was a public hearing last week during commission meeting addressing several roads in that area. Mr. Mitchell wants to clarify that the road will to be vacated beyond the gate only.

Commissioner Ross stated that the commission will not have a decision today. They are gathering more information regarding the roads.

Seeley, Aycock and Associates - 2002 Duchesne County Financial Audit Report

Mike Miles presented the audit report and management comment responses. The 2002 audit report was presented. The county bookkeeping procedures are in order and the county is in good condition. A copy of the report is attached for public view.

Motion: Commissioner Stradinger made a motion to accept the audit report for 2002. Commissioner Peatross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

The commission discussed the mosquito abatement district and the possibility of changing the status of the district to a pest control district. The reason for the discussion was centered around the recent grasshopper problems in Neola and Mountain Home.

2:00 PM Public Hearing - Intent to Annex Property in Upper Country Water   The hearing is to take comment on the proposed intent to annex certain property in T1S, R4W Sections 17, 18 & 23.

Commissioners Ross asked for any interested persons to make comment or protest. No comments were made.

Road Items:
Mr. Nielsen stated the road department has finished the paving on CR 93 in Rock Creek, and will start on CR 92 in Utahn

The oil test on the roto-mill product is 6.8 % oil. The county is hauling about 200 ton per day of the roto-mill product to a county road west Myton. The road department intends to use some of the product to enhance the parking lot at the Duchesne Cemetery.

Mr. Nielsen informed the commission that the road department will not be paving for a week in July in order to chip the newly paved roads in the Tabiona area.

At the request of Tabiona Town they extended the paving project from the church to the State Highway 35. Tabiona Town will pay for the extended pavement.

Commissioner Peatross asked if cooking oil that is collected in the grease traps in the kitchen of the Justice Complex could be disposed of at the landfill. Mr. Nielsen stated that yes the oil could be mixed with sand and disposed of at the landfill.

Highland Development - Amendment to Water Bond & Amount  Motion: Upon request by Highland Development Commissioner Peatross made a motion to amend the bond to a letter of credit and reduce the amount from $450,000 to 406,618.75. The exact amount originally agreed to. This includes the 25% contingency as called for in the ordinance. The letter is to be received on or before July 2, 2003. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

(note: the letter of credit was changed back to a bond and received by Teresa Nielsen, Planning & Zoning on July 2nd)

Other Business:
John Green, Court Executive Eighth Judicial District presented the contractual agreement between Duchesne County and the Administrative Office of the Courts. The agreement is for bailiff services to the Eight District Court. The court contract does not cover all court costs. Compensation exceeded the specified amount by $1,300.00 last year. Mr. Green stated the cause could be that there is a current trend of more offenders going to trial.

Commissioner Ross also reviewed the lease agreement. Mr. Green will sent-up a meeting with their accountant to review the contract.
The agreement for bailiff services will be presented for signature as an agenda item next week.
   
Georg Adams, Fire and Emergency Management stopped in to inform the commission that there are a couple of problems with the plans for both the extension on the road shop and the EOC building. The architect is working on it. The bid opening may have to be delayed.

Bookmobile Library Funding Issues
The estimated costs for the county bookmobile library for 2004 are much higher than 2003. (see attachment in the Clerk's Office)

Commissioner Ross has concerns regarding school district reimbursement. Clerk/Auditor Diane Freston will get past payment information for review.

Auditor's Office - Tax Adjustments - Vouchers
Approval of June 23, 2003 Commission Minutes  The minutes of June 23rd were reviewed and will be approved during next weeks commission meeting.

Vouchers: Deputy Clerk/Auditor Becky Norris presented vouchers #84008 - #84044 totaling $113,147.31 for approval.
Motion: Commissioner Stradinger made a motion to approve the vouchers. Commissioner Peatross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye
