MINUTES FOR REGULAR COMMISSION MEETING HELD MAY 12, 2003
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross

Others Present:  Road Supervisor Douglas Nielsen, Roosevelt City Mayor Lloyd Burton, and Carol Casey taking minutes

Prayer: Commissioner Ross
Pledge of Allegiance

Road Items:  Mr. Nielsen stated that the road department is currently working on 4,000 South.  They will gravel and prime the road in preparation for future asphalt.

Commissioner Ross asked Mr. Nielsen if he had information regarding funding from the Historical Society for the Bridgeland Bridge restoration.  Mr. Nielsen stated he would have the information for next Monday morning work meeting.

Motion:   Commissioner Stradinger made a motion to accept the tax adjustment.   Commissioner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of May 5, 2003 Commission Minutes
The minutes of May 5th were reviewed and corrections made.

Motion:   Commissioner Stradinger made a motion to approve the minutes as corrected.  Commissioner Peatross second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Vouchers:   Deputy Clerk/Auditor Becky Norris presented vouchers #83481- #83589 totaling $200, 085.45 for approval.

Motion:   Commissioner Peatross made a motion to approve the vouchers.  Commissioner Stradinger second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Time Sheets:  Deputy Clerk/Auditor Leann Stewart presented the department head time sheets for review.

R & M Janitorial Agreement Amendment
Agreement entered into for janitorial service.  (refer to Clerk's Office)

Motion:   Commissioner Peatross made a motion to accept the amendment for janitorial services at the tan fair building.  Commissioner Stradinger second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Final Plat Approval - Duchesne Mini Ranches Phase I, Lots 1-55 Located in Section 17, 18, & 20 T4S, R4W USB&M
Mr. Clint Peatross presented the plat for review.  Mrs. Nielsen stated at the time the planning commisison reviewed it a portion of the already existing master plan for Utah Mini Ranches had to be withdrawn.  A new master plan was submitted under Duchesne Mini Ranches Phase I.

The county commission questioned the amendment of the master plan.  Originally the subdivision was listed under a different name and was to have water, now it is amended to be a dry subidvision.  Mr. Clint Peatross stated that the owner plans to supply water at a later date.  They want to sell the lots first.

The commission also reviewed the language onthe plat referring to the easement of one of the Class D Roads.  (Coyote Canyon Drive).

Attorney Uresk reminded the commission that their action to approve the subdivision will not vacate the counties interest in the Class D Road.

Motion:   Commissioner Peatross made a motion to approve the final plat for Duchesne Mini Ranches Phase I subject to the language change regarding the Class D Road easement.  Commissioner Stradinger second based on the existing county ordinance, which allows for dry subdivisions.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Consieration and Approval of Ordinance 03-210
An Ordinance amending titel 8 Chapter 12 Sections 8.12.040 & 8.12.050 of the Duchesne County Code pertaining to reckless buring and penalties.  (refer to Clerk's Office)

Resolution 03-10 Annexation of John Jorgensen Property in Johnson Water District  (refer to Clerk's Office)

Motion:   Commissioner Peatross made a motion to approve Resolution 03-10.  Commissioner Stradinger second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Sheriff's Department - Unclaimed Property
Duchesne County Sheriff Merv Gustin presented a list of unclaimed property he would like to turn over to search & rescue.  The property has been through the process of recovery by advertisement and has not been claimed.  (see attachment)

Motion:   Commissioner Stradinger made a motion that having gone through the required process for recovery the unclaimed property be donated to search & rescue.  Commissioner Peatross second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Consideration of Morning Agenda Items - Utah Retirement Systems Rate Change

Motion:   Commissioner Peatross made a motion that the county pick-up the 93% rate increase as requried by the state legislature for all Duchesne County employees  (see attachment).  Commissioner Stradinger second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Executive Session
Motion:   Commissioner Peatross made a motion at 2:20 PM to go into executive session to discuss pending or reasonably imminent litigation.  Commissioner Stradinger second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Motion:   Commissioner Peatross made a motion at 2:55 PM to go out of executive session.   Commissioner Stradinger second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Adjournment:  2:55 PM
