MINUTES FOR REGULAR COMMISSION MEETING HELD APRIL 28, 2003 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Road Supervisor Douglas Nielsen, John Wilkerson, Darin Wilkerson, and Carol Casey taking minutes.

Pledge of Allegiance

Consideration and Approval of Bids for Road Chips and Chipping Emulsion  The commission opened and reviewed two bids for the chipping oil emulsions during the morning work session.

1.  Koch Performance Asphalt - HFE - 90 Chipping emulsion

2.  Crown Asphalt - HFE - 90 chipping emulsion

    $176.00 All three locations

Motion:   Commissioner Peatross made a motion to accept the bid for HFE-90 chipping emulsion from Koch Performance Asphalt Company of Grand Junction Colorado.   Commissioner Stradinger second asking that the motion include information that no local companies submitted a bid.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

The commission opened and reviewed the one bid received for road chips:  Burdick Paving.   Road chips plus spreader @ $11.84/ton of road chips; Distributor turck @ $15.50/ton of chipping oil; Distributor truck @ $24.00/ton of flushing oil; and Transport chipper @ $75.00/hr transport.

Motion:   Commissioner Stradinger made a motion to accept the bid for road chips from Burdick Paving General Contractors.  Commissioner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

.....Roosevelt City Mayor Lloyd Burton, County Sheriff Merv Gustin, and Deputy Attorney Uresk joined the meeting.....

UBTA Basin Wide Calling
Commissioner Peatross read the following letter of support addressed to the Utah Public Service Commission.

To Whom It May Concern:

The commission of Duchesne County strongly supports the proposal for the extended area service (EAS) by UBTA-UBET Communications.  We represent a majority of the area that EAS would affect.  Seven out of ten exchanges are within Duchesne County.  There are times the citizens of our county have to call long distance to reach a neighbor, hospital, medical provider, or even the schools their children are attending. 

We as Duchesne County Commissioners know this will be a great value to the communities that we represent.

Discussion Regarding Code of Conduct for the Sheriff's Department.  The commission has reviewed the code.  They stated to Sheriff Gustin that if the commission were to ratify the policy he would by yielding some of his authority to the commission.

Commissioner Peatross and Commissioner Ross are in favor of the revised code.  Commissioner Peatross stated that peace officers should be held to a higher standard than other county employees.  Commissioner Stradinger stated that she feels that the code of conduct conflicts with constitutional issue of right to privacy and ude process provisions.   She expressed concern that rather than create an atmosphere of good it will invite snitching and ill will among employees. 

Consideration and Approval of 2003 Beer License Renewal for Bluebell Store  The application for renewal from Bluebell Store has the Sheriff's Office approval.  Motion:   Commissioner Peatross made a motion to approve the beer license renewal for Bluebell Store.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Auditor's Office - Tax Adjustments - Vouchers

Approval of April 21, 2003 Commission Minutes
The minutes of April 21, were reviewed and corrections made.

Motion:   Commissioner Stradinger made a motion to approve the minutes as corrected.   Commissioner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Vouchers:   Deputy Clerk/Auditor Becky Norris presented vouchers #83343-#83413 totaling $163,463.45 for approval.

Motion:   Commissioner Peatross made a motion to approve the vouchers.   Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:   Commissioner Stradinger made a motion to accept the tax adjustments.   Commissioner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Time Sheets:  Deputy Clerk/Auditor Leann Stewart presented department head time sheets for signature.

Executive Session - The commission determined that the subject of the meeting did not fall under the criteria for an executive session.

Mr. Lawrance Twitchell and Terry Greene representing Utah State Parks and Recreation and Mr. Bob West of RS West Real Estate discussed the purchase of private property by Parks and Recreation.  The property is near the Starvation Lake.

The county has a policy of no net loss.  Mr. Greene stated there could be areas in teh county large enough for a land exchange.
