MINUTES FOR REGULAR COMMISSION MEETING HELD MARCH 24, 2003 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Road Supervisor Douglas Nielsen, Deputy County Attorney Roland Uresk, Roosevelt City Mayor Lloyd Burton, Phil Johnson Uintah Basin Standard, and Carol Casey taking minutes.

Pledge of Allegiance

Road Issues:  The recent snow storm slowed the work on the roads in Pinion Ridge.  While they waited for the mud to dry up, the road department worked in the Pleasant Valley area.

Commissioner Stradinger discussed using larger signs at the landfill to inform the public of the hours and days they are open.  She also discussed remaining open one Saturday a month during the winter to enhance services to the public.

Mr. Nielsen stated that anyone wishing to pick-up trash along the county roads as service projects may obtain the large garbage sacks at the road department office.

Mr. Nielsen stated that the summer hours are effective April 7 thru October 25th.  The landfill will be open from 8:00 AM to 5:00 PM Monday through Saturday.  They will be closed for all state and federal holidays.

Community Clean up - Free Dump Days at the Landfill
Mr. Nielsen and the commisison set the free days at the landfill for county wide spring clean-up.

Duchesne County  April 19 - 26
Wasatch County    April 28 - May 5

Roosevelt City requested that May 5th and May12th be available to coordinate with their city clean-up program.

Consideration and Approval of Resolution 03-06
A resolution recognizing a Class "D" Road
(Contact Clerk's Office)

Motion: Commissioner Peatross made a motion to accept Resolution 03-06.  Commissioner Stradinger Second. Motion Carried. Roll Call Vote: All Commissioners Voting Aye.

Consderation of Morning Agenda Items
Commissioner Ross stated that the commission had received one written application as advertised for the position of fair board secretary.  That person will come before the commission next Monday for an interview.

Disbursement of Revitalization Funds to Communities
Commissioner Ross read a list of disbursement of the revitalization funds.

Tabby Valley Recreational Special Service District $50,000
Roosevelt Recreational Program $75,000
Roosevelt City (2nd & final payment for fire equip) $40,000
Future Duchesne County Projects $50,000

Motion: Commissioner Peatross made a motion to accept the list as read. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of 2003 Beer License Renewal for Defa's Dude Ranch  The application by Defa's Dude Ranch has been reviewed and approved by the sheriff's department.

Motion: Commissioner Stradinger made a motion to approve the renewal for Defa's Dude Ranch. Commissioner Peatross Second. Motion Carried. Roll Call Vote: All Commissioners Voting Aye.

Auditor's Office - Vouchers - Tax Adjustments - Department Head Time Sheets - Personnel Issues - Finances

Vouchers:   Deputy Auditor Becky Norris presented vouchers #83029 - 83075 totaling $166,708.47 for approval.

Motion: Commissioner Stradinger made a motion to accept the vouchers.  Commissioner Peatross Second. Motion Carried. Roll Call Vote: All Commissioners Voting Aye.

Approval of March 17, 2003 Commission Minutes
The minutes were reviewed and corrections made.

Motion: Commissioner Stradinger made a motion to accept the minutes with corrections. Commissioner Peatross Second. Motion Carried. Roll Call Vote: All Commissioners Voting Aye.

Time Sheets:  Deputy Clerk/Auditor Leann Stewart presented the department head time sheets for review.

Other Business - Surplus Sale
The commission discussed the disposal of broken itmes of no value.

Motion: Commissioner Peatross made a motion that items of no value be disposed of at the county landfill. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

2:10 PM Recess Until the 3:00 PM Public Hearing

3:00 PM Public Hearing - Vacation of Class "B" Road in T1S, R5W Sec. 20   This hearing was originally scheduled March 17th.  The commission asked that it be continued until today.  Mr. Kim Bailey came in before the hearing.  He stated that his mother and father had paid someone to build the road in 1974.  His family has maintained the road.  The road belongs to him not Mr. Taylor and he is requesting that the county vacate the road.  Mr. Bailey has not information on how the road became a county Class "B" road.  The commission asked Mr. Bailey to stay for the hearing if possible because of his direct involvement in any discussion or decision that is made.

Present:   The commission, Deputy Attorney Uresk, Newell & Maxine Christensen, Attorney Stephen Foote, Attorney John Beaslin, Kim Bailey, Lynn & Alice Taylor, Larry Taylor, Ty Taylor and reporting for the Uintah Basin Standard Phil Johnson.

Attorney Uresk presented a brief history of the disputed road and a map for review.  He stated that the road vacation was requested by Alice & Lynn Taylor.

Commissioner Ross informed the group that the hearing today will be recorded.

Mr. John Beaslin, representing the Taylors stated that the road was built over thirty years ago by the Bailey family.  There is not record of request for it to be a public road.   The road should never have been put on a county map as a Class "B" road.

Mr. Foote, an attorney representing the Christensens state that "if the county vacated the road and allows the Taylors to lock a gate on the road his client will be denied access to his property."  He also stated "the action is unconstitutional, it damages the value of the property making the property impossible to sell resulting in uncompenstated damage to the Christensens."  The title company will become involved also because they insure the properyt based on the access.  This jeopardizes the credibility of the ocunty for road map accuracy," he stated.

Commisisoner Stradinger asked the parties invlolved if they could meet together and reach an agreement.

Commissioner Ross suggested that they work together to reach an agreement that is satisfactory for all three.

County Attorney Uresk stated that written comment on the road issue will be received by the commission until April 14th.
