MINUTES FOR REGULAR COMMISSION MEETING HELD FEBRUARY 24, 2003 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross Stradinger, Commissioner Lorna Stradinger, and Commissioner Kent Peatross.

Others Present:  Road Supervisor Douglas Neilsen, Roosevelt City Mayor Lloyd Burton, Shauna Hoffman, Bob Session, Veline Elliott, John Jorgensen, and Carol Casey taking minutes.

Prayer: Commissioner Peatross
Pledge of Allegiance

Road Issues:  Mr. Nielsen presented payment request No. 4 from Horrocks Engineers for design engineering services on the Bridgeland Bridge project No. BHO-LC13(4) in the amount of $3,383.13 for approval.

Motion:   Commissioner Peatross made a motion to accept partial payment request No. 4 inthe amount of $3,383.13.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Mr. Nielsen also presented partial payment request No. 19 from Horrocks Engineers for design engineering services on the Arcadia Road in the amount of $72,898.87 for approval.

Motion:   Commissioner Stradinger made a motion accept payment request No. 19 in the amount of $72,898.87.  Commissioner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Mr. Nielsen reminded the commission of the meeting with Mr. Phil Huff to discuss the Lake Fork Bridge on March 5th at 10:00 AM.

Mrs. Shauna Hoffman discussed the issue of widening Cobble Stone Road for pavement.  Some of the property owners are not willing to give an easement for a 66 ft. right-of-way.   Mr. Session stated that heavy equipment working on the ater line have not had problems making the turn before crossing the bridge.  Mr. Session also asked why the county could not pave the existing road without widening it.  Mr. Nielsen stated that the added length of a 70 ft. dump truck and pup makes it impossible to make the turn on the existing 34 ft. wide road.

Commissioner Ross stated that when the county paves a road they like to upgrade the road with 66 ft. right-of-ways.  This makes the road more accessible for snow removal.

The commission had further conversation regarding the need in the future for wider roads and easements for the roads.

The commission discussed the possibility of usin only the dump trucks to haul the asphalt to the lay-down machine.  There is an issue of additional time and expense in hauling the asphalt in the dump trucks without the pups.  The commission and Mr. Nielsen will take this under advisement.  When they reach a decision Mr. Nielsen will contact Mrs. Hoffman.

Consideration and Approval of 2003 Beer License for Fruitland Store  The application for a Class "A" beer license has been reviewed and approved by the county sheriff's department.

Motion:  Commissioner Peatross made a motion to approve the 2003 beer license for the Fruitland Store submitted by Mr. Shannon Johnson.   Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Other Business
Appointment of Duchesne County Water Conservancy District Board Member
  Motion:  Commissioner Peatross made a motion that after interviewing the six applicatns Mr. Craig Thomas be appointed fill the unexpired term of newly elected Commissioner Kent Peatross.  Commissioner Stardinger second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Discussion Regarding Carpet for Administration Building
Mr. Lefler, Maintenance Department, wanted to check with the commisison on exactly which areas of the building were to receive new carpeting.  Commissioner Ross stated that the carpet in the offices is in good condition and does not need replacing at this time.

Motion:  Commissioner Stradinger made a motion to have this discussion again in next weeks commission meeting after they have had time tor review the types of carpet.  Commissioner Peatross second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

2:00 PM Public Hearing - Johnson Water District to Annex Certain Properties in Sec 4, T3S, R2W, in the Ioka Area
Property owner John Jorgensen stated that he did not want all his property annexed into the district.  He stated that as long as he owns the property it will not be accessed and will be used as agricultural only.  He wants the area alongthe roadway to be annexed.

After discussion between Mr. Jorgensen and Johnson Watre District they agreed to annex a forty-acre deep strip along the roadways with the exception of the property owned by a relative.

2:15 PM Public Hearing - Request to Vacate Class "D" & "B" Roads in Sec. 26, 33, 35, 36, T1S, R5W & Sec. 4, T2S, R5W all Located in the Talmage Area.  Mrs. Rather commented that the reason they petitioned the county to vacate the roads is they have a problem with hunters coming onto their property and hunting next to their home.  After reviewing the map and taking public input the commission decided that the road in Section 26 should not be vacated.

Fire Protection Agreement - Tabiona Town
Motion:
  Commissioner Peatross made a motion to accept the fire protection agreement with Tabiona Town for fire protection in the amount of $1,000.00 per year.  (see attachment).  Commissioner Ross second.  Motion carried.  Roll Call Vote: Both Commissioners Voting Aye.

Approval of February 17, 2003 Commission Minutes
The minutes were reviewed and corrections made.

Motion:  Commissioner Peatross made a motion to accept the minutes as corrected.  Commissioner Ross second.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Tax Adjustment - Auditor

Motion:   Commissioner Peatross made a motion to accept the tax adjustment submitted by the auditor.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Vouchers:   Deputy Clerk/Auditor Becky Norris presented vouchers #82671- #82783 totaling $283,607.09 for approval.

Motion:   Commissioner Peatross made a motion to accept the vouchers.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.
