MINUTES FOR REGULAR COMMISSION MEETING HELD FEBRUARY 3, 2003 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross Stradinger, Commissioner Lorna Stradinger, and Commissioner Kent R. Peatross.

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, and Clerk-Auditor Diane Freston taking minutes.

Pledge of Allegiance

Resolution #03-03  Commissioner Ross read the folowing resolution which had been prepared by Attorney Herb Gillespie at Commissioner Ross's request.

RESOLUTION 03-03

BE IT RESOLVED by the County Commission of Duchesne County, Utah, as follows:  On behalf of the citizens of Duchesne County, Utah, we express our sympathy to the families of the brave men and women who lost their lives in the Columbia Space Shuttle on Saturday, February 1, 2003.

All of us grieve with you, as does our whole nation.

Diverse in background but unified in high purpose, Commander Rick Husband, William McCool, Kalpana Chawla, Michael Anderson, David Brown, Laurel Clark, and Ilan Ramon of Israel stood for all that is good and great in our nation and the world.

Choosing opportunity over security, challenge over comfort, and faith over fear, they dared soar to the stars in pursuit of knowledge, peace and cooperation for mankind.  The heights they reached lifted us all, and their departure, while full of sorrow, adds their names to the honor roll of heroes and pioneers in whose tracks the course of human progress and dignity has been marked out.

We thank God that there are men and women such as these who fearlessly blaze the trail of human aspirations and inspire us all to arise out of the mundane and mediocre and reach for the heights in our own lives.

UNANIMOUSLY PASSED, and expressing the love and respect of all of the people of Duchesne County, Utah, this 3rd day of February, 2003.

DUCHESNE COUNTY BOARD OF COUNTY COMMISSIOENRS

Motion:   Commissioner Peatross made a motion to accept the resolution as read.   Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Road Items:  The commissioners and Mr. Nielsen read the following community request for a 4-way stop in Mt. Home at 21,000 W. 6750 N. at the intersection of Roads #99 & 113.  (see attached).

After discussing the issue it was recognized that there was a potential safety problem on the said road.  The commission decided to have a public hearing on March 3rd at 2:00 pm to take ocmment onthe following proposed plans.  Plan "A" putting ina   4-way stop and plan "B" putting stop signs on the road running east and west.  This would require a 2-week notice being posted and calls being made to citizens in the area.

Commissioner Stradinger asked Mr. Nielsen about a letter of complaint on county road #29 in teh Utah Mini Ranches area.  (see attached).  The road has deep ruts due to the mud and the property owners are affraid of damaging their vehicles.   Mr. Nielsen stated that he looked at the road and in his opinion the developers of the area have covered the drains along the ocunty road at the intersections where subdivision roads approach the county road.  They have also neglected to obtain approach permits where the roads connect to the county road.  He said that when the roads dry up the county road department would grade and fix the drainage.  It would only make the road worse to try to do anything at this time.

Mr. Nielsen reported that the road department worked Sunday to take care of the snowfall in the county, some places having received up to four (4) inches of new snow.

Mountain West - Tax Issues
Deputy Attorney Roland Uresk said that Mr. Duncan had called him and would like consideration in the form of a reduction in taxes on his propane tanks that were audited by the state tax commission.  He said that he did not know he had to report the tanks if they were not on his lot and feels that the state going back three (3) years in taxes is a pretty stiff tax.  The commission discussed the issue and several options.  It was decided that in as much as the best interest would be served for the county by not imposingundue hardships to small businesses that two (2) years taxes would be required and that the reamining one (1) year would be forgiven for Mountain West Propane Company.

Motion:   Commissioner Stradinger made a motion to abate the off site propane tank portion of the escaped personal property taxes for Mountain West Propane Company for the year 2000.   Commissioner Peatross second.  Motion carried. Roll Call Vote:   All Commissioners Voting Aye.

Diana Manning - Tax Issues
This is a follow up from January 27, 2003 meeting.  The commission reviewed Mrs. Manning's request for a five-year deferral period as per the Utah State Code.  Mrs. Manning stated that she was below pvoerty level in income, 67 years old and the property had been inherited along with unpaid taxes.  She does not want to lose her mothers home, and because of a pending divorce she had been court ordered to not sell, mortgage or dispose of any property until the divorce is final.  The Commission discussed their options.

Motion:   Commissioner Stradinger made a motion to abate penalty and interest of the delinquent taxes and give Mrs. Manning a deferral for the balance of $3,073.66 (not counting the amount to the treasurer today) to be paid by March 1, 2004 along with the current taxes.  When Mrs. Manning signs the agreement the tax adjustments will be made.  Commissioner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Consideration and Approval of Contract Renewal - Karen Allen  Deputy Attorney Roland Uresk stated that Attorney Karen Allen would like to extend her contract for one more year at the same price and agreement.  Her contract calls for a one (1) year extension with the commission approval.

Motion:   Commissioner Peatross made a motion to extend Attorney Karen Allen's contract for the year 2003 and thanked her for her dedicated service to the county.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote: All Commissioners Voting Aye.

Consideration and Approval of County Purchase of the Old Neola School Site

Motion:   Commissioner Stradinger made a motion that in as much as a verbal agreement was made last week on the purchase of the Old Neola School Site that Deputy Attorney Roland Uresk will send the seller the apprpriate papers to sign.  Upon Signatures the ocunty will release the agreed amount of $3,000.00 for the property.  Commissioner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Consideration and Approval of Proposal for Services as Consultant for County Plan - David Allison
Deputy Attorney Roland Uresk presented the commission with the proposed agreement between Duchesne County and David Allison Consulting for services in regards to updating the Duchesne County General Plan.  (contract on file in Clerk's office)

Motion:   Commissioner Peatross made a motion to accept and approve said agreement anticipating that the work will be ocmpleted by May 312, 2003 even though the contract calls for completion by July 1, 2003.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Consideration and Approval of Ordinance 03-201 Amending  Title 12, Chapter 12-04, Duchesne County Code (Also known as the Cattleguard Ordinance).  (Ordinance on file in Clerk's office)

Motion:   Commissioner Stradinger made a motion to approve Ordinance 03-201.   Commissioner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Consideration of Morning Agenda Items
LSTA Grant Approval -
Lorie Evans, County Librarian presented and requested approval of the FY2002-2003 Library Services & Technology Act Grant in teh $6,500.00 with a county match of $1,380.00.  (see attached).

Motion:   Commissioner Peatross made a motion to accept and approve the LSTA Grant as presented by Lorie Evans, Librarian.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of January 27, 2003 Commission Minutes
The minutes were reviewed and corrections made.

Motion:   Commissioner Stradinger made a motion to accept the minutes with corrections.   Commisisoner Peatross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Auditor's Office - Vouchers - Tax Adjustments - Department Head Time Sheets - Personnel Issues - Finances
Leann Stewart brought in Department Head Time Sheets for the Commission to sign.

Vouchers:   Deputy Auditor Becky Norris presented vouchers #82493-82555 totaling $124,860.24 for approval.

Motion:   Commissioner Peatross made a motion to accept the vouchers.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:   Both Commissioners Voting Aye.
