MINUTES FOR REGULAR COMMISSION MEETING HELD JANUARY 13, 2003 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S. Ross Stradinger, Commissioner Lorna Stradinger, and Commissioner Kent R. Peatross.

Others Present:  Road Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston and Carol Casey taking minutes.

Prayer: Commissioner Peatross
Pledge of Allegiance

Road Items:  Mr. Nielsen stated that the road department is currently working on Road #49 in the Myton area.  They will be starting on Road #4 in Fruitland next.

Mr. Nielsen informed the commission that the new pickups will be arriving in a few days.

Commissioner Ross stated that he would like to have Stoney Monks in the GIS department put all the roads up to the 1997/99 aerial maps including BIA roads and Roads on trust lands on a disk.

Discussion and Approval MOA with Robert K Weidner for 2003  Robert Weidner represents rural public lands in Utah before the Administration and Congress and is actively consulting and lobbying activities on behalf of Duchesne County in Washington, D.C. (see attachment)

Motion:   Commissioner Peatross made a motion to accept the agreement with Robert K Weidner in the amount of $11,000 for year 2003.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Morning Agenda Item - Cooperative Agreement with USU Extension (see attachmentMotion:  Commissioner Peatross made a motion to accept the agreement with USU Extension for educational work.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Other Business
Commissioner Ross stated that having received Commissioner Peatross's resignation from Duchesne County Water Conservancy Board the commission will advertise for and appoint another person to fill the Commissioner's un-expired term.

Final Plat Approval for Bluebell Estates - Lots 1-9 Section 15, T2S, R3W Located in the Bluebell Area  Mrs. Nielsen presented the final plat for commission review.   She stated the planning commission has given a favorable recommendation.  The health department has also given approval for septic systems.  Upper Country Water is available and the subdivision connects to County Road #137.

Motion:   Commissioner Peatross made a motion to approve the final plat for Bluebell Estates.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Final Plat Approval for Majestic Elk Meadows - Lots 1-9 Section 36, T1S, R3W Located in the Cedarview Area  Mrs. Nielsen presented the final plat for commission review.  The planning commission has given a favorable recommendation.

Motion:   Commissioner Peatross made a motion to approve the final plat for Majestic Elk Meadows.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

2:00 PM Public Hearing - Johnson Water Proposed Annexation - Section 28 T3S, R2W 5.30 Acres near Myton  Present:  Commissioner Ross, Commissioner Peatross, Johnson Water District Trustee Bud Steffens, Clerk/Auditor Diane Freston

Commissioner Ross opened the hearing, there were no comments opposing the proposed annexation.   The public hearing was closed.

Consideration and Approval of Motor Vehicle Fees Contract - Assessor Greg Garff  Mr. Garff presented the contract for commission review.  He explained that the fees are referred to as "title 41 fees".

Motion:   Commissioner Peatross made a motion to accept the contract for collection of motor vehicle fees with the Utah State Tax Commission.  Commissioner Ross second.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Auditor's Office - Vouchers - Tax Adjustments - Department Head Time Sheets - Personnel Issues - Fiannces

Vouchers:   Deputy Auditor Becky Norris presented vouchers #82283-82365 and pre-draw #82282 totaling $172,405.87 for approval.

Motion:   Commissioner Peatross made a motion to accept the vouchers.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Approval of January 6, 2003 Commission Minutes
The minutes were reviewed and corrections made.

Motion:   Commissioner Peatross made a motion to accept the minutes with corrections.   Commissioner Ross second.  Roll Call Vote:  Both Commissioners Voting Aye.

Motion:   Commissioner Peatross made a motion to accept the assessor's tax adjustment.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Motion:   Commissioner Peatross made a motion to amend the board assignments made in commission meeting on January 6th.  The E-911 will be assigned to Commissioner Peatross because it ties in with Emergency Management.  Commissioner Ross second.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.
