MINUTES FOR REGULAR COMMISSION MEETING HELD DECEMBER 2, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne.

Others Present:  Deputy County Attorney Roland Uresk, Road Supervisor Douglas Nielsen, Tammy Pierce, Charmaine Hurley, Jean Liddell, Mike Barneck, Bud Steffen, and Carol Casey taking minutes.

Road Issues:  Doug Nielsen
Mr. Nielsen stated that this summer the road department processed 47,000 tons of asphalt in 47 working days.  The project began June 11, 2002.  The county now has 7.9 miles of new pavement, and 19.6 miles of overlay.  They have chipped, flushed, and striped 33 miles.  There was also 33 miles of shoulder work done by the road department this summer.

The road crew has been working on County Road #49 northeast of Myton.

The commissioner Ross discussed the road 510 North 0 East going to the crusher site and onto SR 121.  Doug said he would ask Surveyor Jerry Allred to GPS the road and determine property owners for future addition to the B road system.  Commissioner Ross stated that the commission, Lamar Long, and John Wills discussed a fence in the right-of-way in a subdivision north of Mr. Longs.  Mr. Long agreed to remove the fence from the right-of-way when anyone ants to build a road in the subdivision to county standards.

Surplus Auction Proposal - Peatross Auction Company
Motion:
  Commissioner Thyane made a motion to accept the proposal by Peatross Auction Company for contract services for the surplus sale on the second Saturday in April.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Discussion Regarding Water Disposal Inc.
Tammy Pierce, and Charmaine Hurley asked for guidance in addressing the continuing problems of odor from the disposal ponds owned by Water Disposal Inc.

Attorney Uresk stated that according to court findings the Duchesne County Ordinance did not allow for a five-year limitation on the conditional use permit.  If the conditions are not met the permit could be revoked.  He advised Mrs. Pierce and Mrs. Hurley to continue documenting when odors are worse and days when vapors are present.

Johnson Water District - Annexation of parcel 2810-1 in the Myton Area  Mr. Bud Steffen presented a proposal to annex 5.38 acres in Sec. 28, T3S, R2W into Johnson Water District.  The location on the map does not match the location of the home.  The property adjoins the existing Johnson Water District boundaries.

Motion:   Commissioner Thayne made a motion for Johnson Water to provide a resolution and a public hearing of intent for the annexation of Sec. 28, T3S, R2W in Johnson Water District.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Mr. Jim David has property near the Ravolla Dugway in Arcadia.  He the stopped in to ask why he has not been ocntacted by an engineering firm regarding the proposed realignment. 

Commissioner Ross stated that the right-of-way issues are to be addressed by Horrocks Engineering.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues - Time Sheets  Vouchers:   Deputy Clerk/Auditor Becky Norris presented vouchers #81799 to #81853 totaling $120,319.28 for approval.

Motion:   Commissioner Ross made a motion to accept the vouchers.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:   Commissioner Thayne made a motion to accept the assessor's tax adjustments.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of November 25, 2002 Commission Minutes -   The minutes were reviewed.   Motion:  Commissioner Ross made a motion to accept the minutes with corrections.  Commissioner Thayne second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Morning Business - Beaver Duncan
Motion:
  Commissioner Thayne made a motion to reduce the escaped personal property tax owed by Mr. Duncan to one-year.  Commissioner Ross second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
