MINUTES FOR REGULAR COMMISSION MEETING HELD OCTOBER 28, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, Clerk-Auditor Diane Freston and taking minutes Deputy Clerk/Auditor Carol Casey

Pledge of Allegiance

Road Issues:  Mr. Nielsen presented five copies of the cooperative agreement for the design engineering of the Lake Fork Bridge Project No. BRO-LC13(5) for review.   The commission reviewed the agreement.  They signed and directed Carol Casey to return the five copies to Philip G Huff Region Three Project Manager, UDOT.  A check fo the 20% matching amount of $37,866.00 should also be mailed to the UDOT Comptroller's Office.

Motion:   Commissioner Thayne made a motion to accept the agreement with Horrocks Engineering for design engineering on Project No. BRO-LC13(5) in the estimated amount of $174,330.00.   Duchesne County will pay the matching 20% in the amount of $37,866.00.   Commissioner Ross second.  Roll Call Vote:  All Commissioners Voting Aye.

Mr. Nielsen also presented five copies of the partial payment request No. 15 for design engineering services on the Arcadia Road Project No. STP-1544(1)5 in the amount of $42,816.91.  An updated progress report showing status of work through September 30, 2002, accompanied the payment request.  Four signed copies are to be sent to Mr. Greg Searle, UDOT Project Manager District 6 Headquarters.

Motion:   Commissioner Ross made a motion to accept payment request No. 15 in the amount of $42,816.91.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Mr. Nielsen stated that Horrocks Engineers requested that the county provide a dozer to build a pad for a subcontractor to do the geo-technical work on the Arcadia Road Phase II.   The commisison granted permission for the construction of the pad.

Mr. Nielsen stated that the road department is currently doing shoulder work on County Roads #64, 54, 57, & 58.  The road striping will start tomorrow.

Motion:   Commissioner Thayne made amotion to abandon all public interest in all Class B & Class D Roads which are requested and advertised and are listed above leaving in place the valid existing rights to properties accessed by those roads.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

American Legion Boy's State Presentation
Vernon Peterson, American Legion Ninth District Commander, and Executive Secretary of Boy's State Bob Jones introduced Tim Abbott who recently attended boy's state and was elected Lieutenant Governor Tim is a senior at Duchesne High and the son of Jay and Helen Abbott.  Mr. Abbott related his hands on experiences at boy's state.   He also presented a speech honoring the verteans.  (see attachment).   Mr. Abbott then presented plaques from the American Legion to Sheriff Stansfield honoring the sheriff's department and Officer Rick Coil for service.

Alarik Myrin stopped in to verify for the record that his memory of a past commission meeting when he and the commission discussed the sprinkling system crossing the road is correct.  Mr. Myrin talked former commission John Swasey and Mr. Swasey remembers making a motion to allow the sprinkler to cross the road going through his fields.  The motion Commissioner Thayne made earlier was repeated for Mr. Myrin.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues - Time Sheets  Vouchers:   Deputy Clerk/Auditor Becky Norris presented vouchers #81369 to #81439 totaling $89,439.95 for approval.

Motion:   Commissioner Ross made a motion to approve the vouchers.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Time Sheets:  Deputy Clerk/Auditor Leann Stewart presented department head time sheets to the commission.

Approval of October 21, 2002 Commission Minutes - The minutes were reviewed.  Motion:   Commissioner Ross made a motion to accept the minutes with corrections.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Final Board of Equalization Adjustments - Assessor
Request for Board of Equalization for Utah Mini Ranches has past the cut of date.  The property owners did not preparet he necessary paperwork.  A letter of denial will be sent along with a state appeal form.

Motion:   Commissioner Ross made a motin to accept the Board of Equalization Adjustments as presented by Assessor Greg Garff.  (see attachment).   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of Resolution #02-13 and #02-14 and Agreement for the Myton Housing Authority and the Roosevelt Housing Authority to Expand into the County.

RESOLUTION NO. 02-13
A RESOLUTION APPROVING AN INTERLOCAL COOPERATIVE AGREEMENT WITH THE MYTON CITY HOUSING AUTHORITY DBA HOUSING AUTHORITY OF THE UINTAH BASIN

WHEREAS, the Housing Authority is empowered Under Title 09, Chapter 04, Section 609, Subsection (h) of the Utah Annotated, to "utilize, contract with, act through, assist and cooperate or deal with any perosn, agency, institution, or organization, public or private for the provision of services, privileges, works, or facilities, or in connection with its projects"; and

WHEREAS, the Housing Authority was legally established by the Myton City Council for the purpose of aiding in the provision of safe, decent and sanitary dwellings for low-income persons and families with children, including senior citizens, minority and disabled individuals; and

WHEREAS, Duchesne County Commission, having given due consideration to the needs of their rsidents, desires and request; that the Housing Authority provide its services to Duchesne County for the purpose of aiding in the provision of safe, decent and sanitary dwelling for low-income persons and families with children, including senior citizens, minority and disabled individuals; and,

WHEREAS, the Myton City Housing Authority DBA Housing Authority of the Uintah Basin administers a Section 8 Rental Assistance Program and the Duchesne County Commission has determined that these rental assistance programs are needed in Duchesne County, and the County desires that the Myton City Housing Authority DBA Housing Authority of the Uintah Basin provide their services in Duchesne County; and,

NOW THEREFORE BE IT AGREED AS FOLLOWS:
Section 1.
  The Interlocal Cooperative Agreement with Duchesne County, Utah, dated October 21, 2002, is in the best interest of the Myton City Housing Authority DBA Housing Authority of the Uintah Basin and is hereby approved.

Section 2.  The Chairman and the Board of Commission of Duchesne County is hereby authorized to execute and deliver said Agreement for and behalf of the Duchesne County, Utah.

Section 3.  The officers, agents, and employees of the Myton City Housing Authority DBA Housing Authority of the Uintah Basin are hereby authorized and directed to fulfill all obligations of the Housing Authority under the terms of the aforesaid Agreement.

Section 4.  Effective Date.  This resolution shall take effect immediately upon passage.

 

AGREEMENT

This agreement is entered into by and between the MYTON CITY HOUSING AUTHORITY, dba HOUSING AUTHORITY OF THE UINTAH BASIN (Housing Authority), a governmental entity, and DUCHESNE COUNTY, a political subdivision of the State of Utah.

WHEREAS, housing authorities are empowered under Title 09, Chapter 04, Section 609, Subsection (h), of the Utah Code Annotated, to "utilize, contract with, act through, assist, and cooperate or deal with any person, agency, institution, or organization, public or private, for the provision of services, privileges, works, or facilities, or in connection with its projects"; and

WHEREAS, the Housing Authority was legally established by the Myton City Council for the purpose of aiding in teh provision of safe, decent and sanitary dwellings for low-income persons and families with children, including senior citizens, minority and disabled individuals; and

WHEREAS, the Housing Authority administers a Housing and Urban Development (HUD), Section 8 Rental Assistance Program, along wiht other housing assistance programs; and

WHEREAS, the Duchesne County Board of Commissioners, on the 28th of October, 2002, adopted Resolution 02-13 (attached hereto) stating its desire to enter into an agreement with the Housing Authority to provide services for the purpose of aiding in the provision of safe, decent and sanitary dwellings for low-income persons, including senior citizens, minority and disabled individuals, in Duchesne County;

NOW THEREFORE BE IT MUTUALLY AGREED AS FOLLOWS:   This agreement shall exist perpetually, unless sooner terminated as provided herein.

It is not the intent of this agreement to create a new entity or agency, but to provide for the provision of services as set forth herein.

The Duchesne County Board of Commissioners, by this agreement, hereby authorizes the Housing Authority to administer it housing programs for the benefit of all qualified Duchesne County residents, once such expansion of its services is aproved by the Department of Housing and Urban Development (HUD).

The Housing Authority agrees to comply with all federal regulations as set forth in the Section 8 Rental Assistance Housing Choice Voucher Program or any other Housing Program it may administer, and to follow federal guidelines to ensure that all persons who may qualify have a reasonable opportunity to apply for housing assistance by publication of announcements, as well as by contacting those local human service organizations providing services to qualified individuals residing in Duchesne County.

The Duchesne County Board of Commissioners hereby requests that the Housing Authority revise its Administrative Plan, as allowed by HUD regulations at 24 C.F.R. 982.54 and 982.207, to allow for the equitable distribution of Section 8 Rental ASsistance vouchers between all communities it serves.  All applicants should be awarded priority based on an objective rating and ranking process.

All parties recognize and agree that nay property acquired by the Housing Authority, either real or personal, shallb e the property of the Housing Authority and shall remain the property of the Housing Authority upon the termination of this Agreement.

This Agreement is subject to the rules, regulations and provisions established by HUD, and is enteredinto pursuant to the laws of the State of Utah.

This Agreement may be terminated by either party upon 180 days written notice delivered to the Chairman of the Duchesne County Board of Commissioners and/or the Executive Director of the Housing Authority Board of Directors.  Notice shall be provided as follows:

..........Dave Howell & Dave Moore joined the meeting..........

Bureau of Land Management
Mr. Dave Howell, Director of the BLM Vernal Field Office, expressed concerns regarding a correspondence sent by the commission on October 21st.  The commission stated in the letter that the cooperative agreement has not been metin that all information regarding research management plans are not being sent ot the commission.   They also asked for ninety days to review data and reports on the RMP and to prepare an accurate response.  Mr. Howell appreciates the commission's involvement and will make available the necessary reports for their review.

Mr. Dave Moore, Land Use Planner stated that monthly information will be coming in from the Region Wide Planner Clayton Chidester.

Commissioner Ross brought up the issue of wild and scenic rivers and the impact on Duchesne County.

Commissioner Thayne discussed the cost of the Garner Canyon fire this summer.  The commissioerns feel that even the BLM was asked to be frugal on the costs there were instances when it seems expenses could have been watched more closely.
