MINUTES FOR REGULAR COMMISSION MEETING HELD AUGUST 26, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne.

Others Present:  Road Supervisor Douglas Nielsen, Ralph Madsen, and Carol Casey taking minutes.

Pledge of Allegiance

Road Items:  Doug Nielsen stated that the road department is paving in the Arcadia area by the Charley Hansen residence.  The road department was not able to do the additional paving on the Pariette Road or in Sharmel Acres.  They may be able to get back to those areas if the weather stays good.  Chipping the newly paved roads will start on September 3, 2002.

Commissioner Ross asked if there were plans to pave County Road #49 in the Hartford area.  Doug Nielsen answered that the road has not been prepared for asphalt.

Mr. Ralph Madsen addressed the commission and he stated, "I have constructed a road west of Duchesne for a property owner.  Road Supervisor Doug Nielsen told me he will not approve the road.  Before I started construction on the road Doug and I inspected the area and Doug told me that twenty-four feet of graveled road would be acceptable, and a variance could be granted because of the areas of solid rock".  Mr. Madsen also stated that he feels he is not being treated equally because there are other newly constructed subdivision roads in the county which do not meetin county codes for width, but were approved last year.  Mr. Madsen stated that all he is asking for is equal treatment.

Mr. Nielsen stated "I gave the specifications to Ken Bird and told him then that htye need to get the road as close to thirty feet wide as possible for county approval.  I would make allowances for the spots where the road goes across solid rock.  As for the other subdivisions, one subdivision is over ten years old and the others were approved before the county ordinance changed".  Mr. Nielsen also stated that the existing county roads that the road department works on are already in place an they are often not as wide as the county ordinance dictates they should be at this time.

...............Planning & Zoning Director Clayton Chidester, and Stoney Monks GIS department joined the meeting...............

Mr. Clayton Chidester, Planning & Zoning Director stated that the code was revised in August of 2000.  Any subdivisions started before then would not be held to the more stringent standards.  (Later in the afternoon after researching the subdivisions in question Mr. Chidester informed the commission that two of the four subdivision roads fell under early less stringent ordinances and two were done after the zoning ordinance was changed.)

Commissioner Thayne suggested that the commission accompany Mr. Nielsen to inspect the road on Thrusday, August 28th.

Consideration and Review of Contract for GIS services - Stoney Monks  The commission reviewed the contract for GIS service with Mr. Monks.

Motion:  Commissioner Thayne made a motion to accept the contract with changes for GIS service with Monks Cartography and Geographic Services.  Commissioner Ross stated that even though he is against entering into the agreement the majority voted yes.  "I will support the majority vote and I will second the motion".  Roll Call Vote:  All Commissioners Voting Aye.

Motion:   Commissioner Ross made a motion to accept the tax adjustment.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Vouchers:   Deputy Clerk/Auditor Becky Norris presented vouchers #80494 to #80586 totaling $70,461.03 for approval.

Motion:   Commissioner Thayne made a motion to approve the vouchers.  Commissioner Ross second.  Motion carried. Roll Call Vote:  All Commissioners Voting Aye.

Approval of August 19, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:   Commissioner Thayne made a motion to accept the minutes with corrections.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Personnel:   Personnel Director Judy Mutton presented a name for hire as evidence clerk at the Duchesne County Justice Center.

Other Buisness
The applications for the Board of Appeals were reviewed.  They will be appointed in next weeks commisison meeting.
