MINUTES FOR REGULAR COMMISSION MEETING HELD AUGUST 12, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne.

Others Present:  Road Supervisor Douglas Nielsen, Angela Eddington of the Uintah Basin Standard.

Pledge of Allegiance

Road Items:  Road Supervisor Douglas Nielsen stated he has received a request from Mr. Tom Mitchell for the county to restructure the drainage on the road near his property on the Strawberry River.  If the county is agreeable he will furnish the product and the balance of the work if the county could provide a grader for one day.   The commission advised Supervisor Nielsen to supply the grader as requested.

Commissioner Thayne stated that the gate on County Road 351 & 352 Sundown Ridge in the Fruitland area is locked.  Mr. Nielsen stated that he has been trying to contact the owner but he is out of town.  Mr. Nielsen will follow-up when the owner returns.

Mr. Nielsen and the ocmmisison discussed the transfer of Class C mileage in Roosevelt City to Class B in Duchesne County.  The section is approximately 1.25 miles from a point at the "Gulch" to the south edge of the city boundary.  Both Duchesne County and Roosevelt City are presently receiving Class B and C credit simultaneously.  As a result Duchesne County will gain 0.50 in paved Class B Mileage and a loss of 0.75 in paved Class C mileage to Roosevelt City.  An agreement between Roosevelt City and Duchesne County establishing street maintenance responsibility was presented for review.  (see attachment)

Motion:   Commissioner Ross made a motion to accept the agreement between Rosoevelt City and Duchesne County.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Mr. Nielsen stated that Inland had donated water and Jim Nebeker donated a water truck to help with the grading of the Pareitte Road.  They will continue as lond as the water is available.

Mr. Nielsen also stated that 31,000 tons of asphalt has been put down as of todya.   Chipping will start approximately September 3rd.

Consideration and Decision on Fencing Old Town Sites Within the Coutny  Subsequent to the morning discussion the commisison determined it would be beneficial for the county to have a use agreement dranw up with specific language outling the counties position.

Motion:   Commissioner Thayne made a motion to table the discussion until information can be gathered.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

...............Joe Bistryski, Bob West, Deputy County Attorney Roland Uresk, and Clayton Chidester of Planning & Zoning joined the meeting...............

Final Plat Approval - North Town Subdivision, Located in the Roosevelt Area  Planning & Zoning Director Clayton Chidester presented the final plat of North Town Subdivision for review.  Culinary water and sewer from Rosoevelt City is available as well as power, telephone and natural gas.

Motion:  Commissioner Thayne made a motion to approve North Town Subdivision.  Commissioner Ross second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

GIS - Stoney Monks
Motion:
  Commissioner Thayne made a motino to accept the unsolicited bid proposal from Stoney Monks of Monks Cartography and Geographic Services if everything is legal.  Commissioner Ross asked Attorney Uresk if the Coutny may properly accept the proposal from Monks Cartography and Geographic Services without going through the procedure of advertising.  Attorney Uresk asked for a few minutes to review the counties policies on unsolicited bids before giving an opinion.  Commissioner Thayne withdrew his motion, and to allow Attorney Uresk time to review the proposal.  (see attachment)

Other Business
Commissioner Thayne informed the other commissioners he has received word from Personnel Director Judy Mutton that as a result of the ltter sent to Blue Cross/Blue Shield by the ocmmisison the insurance company is going to refund the $7,000 bileld in error by Blue Cross/Blue Shield nad paid by county for 2002 dental insurance billings.

Personnel Director Judy Mutton submitted a name for the domestic violence office assistant position.

Mr. LeRoay Pectol stopped in to discuss his rental units in the county.   Mr. Pectol would like to have the units qualify for federal funding.   Commissioner Ross suggested that he contact the Myton Housing Authority.

GIS
Attorney Uresk returned with his opinion regarding the GIS proposal from Stoney Monks.

Attorney Uresk stated he has reviewed the procurement code.  The code does not apply to the county and the county needs to put together our own policy.

Motion:  Commissioner Thayne motioned to accept hte unsolicited bid from Monks Cartography and Geographic Services.  Motion carried.  Further discusison.  Commissioner Ross stated that even though there is no procurement policy in place, he does not see the advantage to the contracting of the GIS department.  Commissioner Ross feels that for the reasons of services, price, and availability there could be a distinct disadvantage.  Commissioner Ross stated that in his poinion he feels the bid should be offered to the public.  "And therefore I will vote no".

Commissioner Thayne stated that he feels the advantage is the county can increase and expand capcaity to do GIS.  Private enterprise will always do a better job, stated Thayne.  It will cut the county budget plus private buisness generates more tax for the county.  Roll Call Vote:  Two Commissioner Voting Aye.  Commissioner Ross Voting Nay.

Auditor's Office-Vouchers-Tax Adjsutments-Personnel Issues-Time Sheets  Vouchers:  Deputy Clerk/Auditor Becky Norris presented vouchers #80289 to #80417 plus #80288 reissued totaling $227,877.63 for approval.

Motion:  Commissioner Thayne made a motion to approve the vouchers.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of August 5, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:  Commissioner Thayne made a   motion to accept the minutes with corrections.  Commissioner Ross second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of July 29, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:  Commissioner TRoss made a   motion to accept the minutes with corrections.  Commissioner Thayne second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
