MINUTES FOR REGULAR COMMISSION MEETING HELD AUGUST 5, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne.

Others Present:  Road Supervisor Douglas Nielsen, John Jorgenson, and representing Basin Western Inc., Dennis Hatch and Micahel Mascaro

Road Items:  Supervisor Douglas Nielsen stated that the road department is currently working on Cresent Road, they will reach Roosevelt City limits by the middle of this week.

Dennis Hatch stated that Basin Western Inc. is a crude carrier in the Basin.  They have 68 carriers transporting oil.  The problem is traveling to the locations on the dirt roads with the empty trailers.  The washboard roads are taking a toll on the trailers.  It is taking two hours to pull a trailer over a thirty-four mile road.   As a carrier Basin Western must keep the cost down.  The extra time involved traveling these roads is making it hard to see a profit.

Mr. Nielsen stated that normally the graders available to work on the county roads do so after a rainstorm, due to the dry conditions they have not been able to work this summer.   Grading the dirt roads without water will only make them worse.

The commisison suggested that Mr. Nielsen try to free up a county water truck in order for the graders to maintain the roads.  They also suggested he inquire with the oil companies in the area to see if they would be interested in donating some water for the roads.

Mr. John Jorgenson has concerns about the work Mr. Arnold is performing on a right-of-way on Coutny Road #62.  In Mr. Jorgenson's opinion he is creating a dangerous situation on the east side of the road.  He feels it is a narrow road and now has a steep embankment making it so two cars cannot pass at the same time.  The Commission asked Mr. Nielsen to address the issue.

Commissioner Thayne asked Mr. Nielsen if theere might be enough paving material left to do some work on Coutny Road #242 in Pleasant Valley.

Commissioner Ross stated he also hopes they will be able to do the paving they planned on the Parriett Road.  Mr. Nielsen stated that he will keep the two requests in mind.  It will depend on how much asphalt is left after the projects on the east side of the county are finished.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues - Time Sheets

Tax Adjustments - Assessor
Mrs. Stacey Bateman came before the commission requesting that property she purchased to be reinstated on greenbelt.  She had filled out the greenbelt application and mailed it to the assessor's office.  Mrs. Bateman neglected to fill out one of the papers requiring a notarized signature.  The commission feels that an error in signing the proper paperwork is not sufficient reason impose the roll back tax.   Deputy Assessor Virginia Allred informed the commission there is no other encumbrance against the property.

Motion:   Commissioner Ross made a motion to accept the tax adjustment in the amount of $2,286.93 for property serial numbers 99079 & 99080.  Commissioner Ross second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Vouchers:   Deputy Clerk/Auditor Becky Norris presented vouchers #80182 to #80287 totaling $171,277.00 for approval.

Motion:   Commissioner Thayne made a motion to approve the vouchers.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

2:00 PM Approval of Resolution 02-07 - Upper Country Water Anenxation  (see attachment)
Motion:  Commissioner Thayne made a motion to accept Resolution 02-07 with the amendment of the legal description plus the account numbers.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Other Business:  The Television Agreement between Duchesne County, Uintah County and Alfred Stringham has been signed by Duchesne County.  Uintah County requested Duchesne County remove the Recreational District from the agreement before they sign it.  Uintah County is now reviewing the agreement again.

Commissioner Stradinger informed the commission that she is unable to fill her position on the hospital board at this time.

Motion:   Commissioner Thayne made a motion to appoint Commissioner Ross to the hospital board.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Bid opening of preliminary analysis of energy and water usage for county buildings.   The commisison opened and reviewed the four bids submitted.  #1.   Professional Engineering Services - No overall bid jsut hourly rates for engineers - Prinicpal Engineer $85.00 per hour.  Draftsperson $45.00 per hour.  Project Engineer $60.00 per hour.  Clerical $32.00 per hour.  #2.  Presstek - $6,000.00.  #3.  Quantum Group Engineering - $3,000.00.  #4.  Olsen & Peterson Counsulting Engineers, Inc. - $23,700.00  (The commission motioned to accept the bid from Quantum Group in the amount of $3,000 during a meeting in Roosevelt on August 7, 2002.)

3:00 PM - Executive Session - Pending Litigation
Motion:
  Commissioner Thayne made a motion to go into executive session to discuss pending litigation.  Commissioner Ross second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Motion:   Commissioner Thayne made a motion to go out of executive session.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Determination on Vacating Mountain Home Town Site Streets  Motion:  Commissioner Ross made a motion not to vacate streets of longtime established town sites .   Sighting historical value as well as uncertainty of future growth as reasons for the decision.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
