MINUTES FOR REGULAR COMMISSION MEETING HELD JULY 8, 2002
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne.

Others Present:  Road Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston, Ilene Jensen, Lee Carter, Duchesne City Mayor Clint Park, Helen Park and Angela Eddington representing the Uintah Basin Standard.

Pledge of Allegiance

Road Issues:  Doug stated the road department will finish paving in Cedarview today.  They paved the access road to the Cedarview Cemetery.

The road department will start work on Crescent Road from State Route 121 to Roosevelt City boundary.

Commissioner Thayne has been contacted by an eagle scout interestedin placing road signs as a scout project in Mountain Home townsite.  He will contact Doug to make arrangements.

Commissioner Stradinger discussed problems with dust on a section of road near the Bill Johnson residence in the Hanna/Tabby Swale area.  Doug stated that when they finish the paving project for this summer he will have a truck deliver some gravel to help with the dust.

Review of Horrocks Engineering Work Plan and Cost Estimate for Arcadia Road Phase II
Doug stated the cost estimate from Horrocks for engineering on Arcadia Road Phase II is $230,835.  The county would pay 7% and federal highway will pay the rest.   (see attachment)

Motion:   Commissioner Ross made a motion to accept the work proposal for design and engineering service for the estimated $230,835.00 on Arcadia Road Phase II, Project STP-1544(2)14 from Horrocks Engineering.  Commissioner Thayne second.  Roll Call Vote:  All Commissioners Voting Aye.

Determination of Process for Land Appraisal and Right-of-Way Acquisition for Arcadia Road Phase II
The commission discussed using a firm with experience in rural areas.

Motion:   Commissioner Thayne made a motion to hire Free and Associates.  Commissioner Ross second.  Roll Call Vote:  All Commissioners Voting Aye.

Duchesne City Road Issues - Mayor Clint Park
Mayor Park presented a letter he received from the Ducehsne Volunteer Fire Fighters.  The letter is asking Duchesne City to contribute to the cost of asphalt on the street in front of the fire station.  The fire fighters are asking for reimbursement in order to purchase fire-fighting equipment.

Commissioner Stradinger stated that the commission had made the decision to asphalt the street because the weed department is across the street.  The funds are coming for CIB grants. 

The commission asked Georg Adams to attend the city council meeting to verify the transaction.  (This issue will be readdressed in the morning commission work meeting on July 29th).

Mayor Park and the commission discussed the sewer hook-up for the sale barn at the fair grounds.  The fair board asked that the city wave the fee for the hook-up.  The city will wave the fees, and the ocunty will buy the pipe.

Annexation to Upper Country Water - Ilene Jensen
Mrs. Jensen presented a request for annexation of twenty-one parcels of land.  The parcels were withdrawn when Upper Country Water District was formed.   A public hearing will be held for comment on the annexation August 5, 2002.

NOTICE OF INTENT TO ANNEX
RESOLUTION 02-06

A RESOLUTION DECLARING THAT IT IS IN THE BEST INTEREST OF THE AREA AND THE RESIDENTS CONCERNED THAT THE DUCHESNE COUNTY UPPER COUNTRY WATER IMPROVEMENT DISTRICT BE ENLARGED AND EXTENDED BY THE ANNEXATION OF A TRACT OF LAND ADJACENT THERETO AND PROVIDING THAT NOTICE OF INTENTION BE PUBLISHED FIXING THE TIME AND PLACE OF HEARING FOR ALL PERSONS TO BE HEARD RELATIVE TO SAID ANNEXATION.

WHEREAS, the Board of County Commissioners of Duchesne County, state of Utah, in its regular session assembled this 8th day of July, 2002, did receive written petition made and executed by property owners of an area adjacent to the Duchesne County Upper Country Water Improvement District; and,
WHEREAS, the petition prays that property adjacent to the District be annexed to the Duchesne County Upper Country Water Improvement District; and,
WHEREAS, the provisions of Title 17A, Chapter 2, Utah Code Annotated, (1953) as amended (particularly Section 17A-2-332 and 17A-2-333) provided the procedure whereby areas can be anenxed to this District.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF DUCHESNE, STATE OF UTAH:

Section 1.  That the public health, safety, and convenience will be enhanced by the extension of the boundaries of the Duchesne County Upper Country Water Improvement District and the annexation of the following described area into the said District, to wit:

Section 2:  The area and the property owners and residents thereof, when and if annexed into the Duchesne County Upper Country Water Improvement District, shall be entitled to and subject to the same privileges, obligations and restrictions as the area and the property owners and residents now embraced within the said District which has heretofore been created by this honorable body.  The area sought to be annexed into and included within the District shall be governed by the Board of Trustees of the District to the same extent as the District as it now exists.

Section 3:  The Board of Coutny Commissioners of Duchesne County, State of Utah, will meet in official meeting at the Duchesne County Building on August 5, 2002, at the hour of 2:00 p.m., (such time being not more than forty (40) nor less than twenty-one (21) days after the first publication fo the Board's notice of its intention to annex an area to the Duchesne Coutny Upper Country Water Improvement District), at which time all interested parties may appear before the Board of County Commissioners and be heard either in support of, or in opposition to the said annexation.  Any taxpayer within the District to the area proposed to be annexed to the District may, on or before said date of hearing above mentioned, submit a written protest against the proposed annexation to the District, signed by the taxpayer, which portest shall be filed with the County Clerk of Duchesne County.  Any such written protest should indicate the reason for, provided for by Section 17A-2-304, Utah Code Annotated (1953), as amended, and all other laws pertining thereto.

Motion:   Commissioner Ross made a motion for the district to proceed with Resolution 02-06 - Notice of Intent to Annex.  Commissioner Thayne second.  Roll Call Vote:  All Commissioners Voting Aye

Discussion on Grasshopper Problem in Duchesne County
Mr. Carter stated that he has had a grasshopper problem for several years.   Last year the grasshoppers had an extreme hatch on the adjoining property.   Mr. Carter tried sparying his property last year but it did not help because they fly in from the other property.  Mr. Carter would like the county to consider spraying, and also what can he do when his neighbors refuse to use measures to control the pests.

Commissioner Thayne will contact another county with grasshopper problems to see if the property owners received assistance.

Consideration of Ordinance Requesting Background Checcks for Employee Purposes  Postponed until July 15th commission meeting.

Auditor's Office-Vouchers-Tax Adjustments-Personnel Issues-Time Sheets  Vouchers:  Deputy Clerk/Auditor Andrea Higbee presented vouchers #79914 to #79969 and predraw #79913 totaling $97,697.34 for approval.

Motion:  Commissioner Ross made a motion to approve the vouchers.  Commissioner Thayne second.  Motion carried. Roll Call Vote:  All Commissioners Voting Aye

Approval of July 1, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:  Commissioner Thayne made a motion to accept the minutes with corrections.  Commissioner Ross second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Treasurer Adjustment
IRP fees charged by the state and distributed to Duchesne Coutny in error, $6,451.10 on United Parcel Service.  Fees to be refunded to UPS.

Motion:   Commissioner Ross made a motion to accept the treasurer's request for refund.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
