MINUTES FOR REGULAR COMMISSION MEETING HELD JUNE 24, 2002
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Acting Commission Chairman Guy R. Thayne, and Commissioner Larry S. Ross.  Commissioner Stradinger absent.

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, Clerk/Auditor Diane Freston, and Alma Richins.

Road Issues:  Doug reminded the commission of a meeting Wenesday, June 26th with UDOT and Rex Harrison of Horrocks Engineers regarding the Bridgeland Bridge.   The meeting will be in conference room one at the county admin building.

Doug read aloud a letter he received from UDOT Region Three Director Tracy Conti, regarding the speed limit study on SR-121 in Neola.  (see attachment).   The evaluation consisted of a speed limit study and field review in the vicinity of the school crosswalk.  UDOT's reply is that the study indicated that changes to the speed limits are not recommended at this time.  The field review confirms this recommendation.  UDOT strongly believes that the community should seek additional law enforcement if there is a speed violation problem.

Doug reported that the paving on roadby the Johnson Water office is complete.

This commisison received a "thank you" note from Ralph & Velma Dart.

We would like to say "thank you" for such a beautiful road.  The road department has done a grand job.  They were very efficient, kind, and friendly.   Thanks to everyone!  We appreciate it and we will certainly enjoy it.   -Ralph and Velma Dart.

Doug informed the commisison that he had checked on the speed bump issue on the Sumner road.   The only bump he observed is on the BIA right-of-way.  Commissioner Ross directed Doug to talk with Mr. Labrum to see if he put the bump there, if so to please remove it.

Auditor's Office-Vouchers-Tax Adjustments-Personnel Issues-Time Sheets  Vouchers:   Deputy Clerk/Auditor Becky Norris presented vouchers #79686 to #79745 totaling $268,837.86 for approval.

Motion:   Commisisoner Ross made a motion to approve the vouchers.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Department Head Time Sheets:  Leann Stewart presented the time sheets for review.

Motion:   Commissioner Ross made a motion to accept the tax adjustments.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Independent Audit Report for the Year Ending December 31, 2001 - Mike Miles & Kirk Seeley
Mr. Miles presented the report.  He noted that the county is in good financial condition.  He also noted that the auditing staff had done a very good job.

Motion:  Commissioner Ross made a motion to accept the report from Seeley, Aycock & Associates.  Motion carried.  Roll Call Vote:   Both Commissioners Voting Aye.

2:30 P.M. - Public Hearing - Vacation of Sec 18 Mt. Home Townsite, Adams Ave. east between First East and Second East, and Second East north between Adams Ave and Washington Ave.
Planning & Zoning Director Clayton Chidester advised the commission that he had a written protest to the vacation from adjoining property owner Kim Lindsay.   He is in the process of developing his property in the town-site.

Mr. Lindsay called the commission chambers to advise them he was unable to attend the meeting but he would like Mr. Chidester to represent him.  Mr. Chidester informed the commission that Mr. Lindsay has visited his office on June 21st.  Mr. Lindsay informed Teresa he was not contacted by mail of the intention to vacate the roads in Sec 18.  (see attachment)

Mr. Farnsworth advised the commission that Mr. Lindsay has access to his property on two sides.  Second East, First East, and Park Ave.  Mr. Lindsay also has access to develop another street.  Mr. Farnsworth pointed out that the roads he requested to vacate are of no use because they are wetlands.  There is a pond on the east end of Adams Avenue.

Attorney Uresk stated that this is just a hearing today to gether information and Mr. Lindsay's comments will be taken into consideration. 

Mr. Farnsworth asked about responsibilities for fencing the property.   Attorney Uresk stated that the developer is responsible for providing adequate fences.

2:30 PM Public Hearing - Vacate Class "D" Roads in Tabby Shadows 1 & 2 T3S, R7&8W - Deep Creek Investment.
Mr. Beckwith addressed the commission.  He stated that Deep Creek Investments proposes to vacate the class D roads outlined on the map in order to maximize and develop deer and eld habitat.  The intent of this project is to reduce motorized access, but not to land lock those property owners located in the area.  They all hve private easements.

The Division of Wildlife Resources will be working with Deep Creek Investments on this project and have provided a letter of support.
