MINUTES FOR REGULAR COMMISSION MEETING HELD JUNE 17, 2002
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross.

Commissioners Absent:  Commissioner Guy R. Thayne attending the Harmony meeting.

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, John Gardner, and Alma Richens.

Road Issues:  Doug informed the commission that the road department is currently working in the Myton area.  Mitchell Construction is mixing 800 to 900 tons a day of asphalt.

Myton City has requested forty tons of gravel for the city pavilion.  Myton City will transport the gravel.

Motion:   Commissioner Ross made a motion to sell forty tons of gravel @ $3.00 a ton to Myton City.  Myton City will make arrangements to haul the gravel.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Doug discussed paving some streets in the Myton City Cemetery.  They will pave about half the streets in the cemetery.  The other half will be graveled.

The commission and Doug discussed maintenance on the south and north ends of State Street in Roosevelt where the road meets the city limits.  Roosevelt City and the county share the resonsibility for the street in those areas.  Commissioner Ross directed Doug to meet with Roosevelt City to discuss deeding their interest to the county in order for the county to propertly maintain the road.

Doug stated that the road department is paving near Ralph Dart's residence; they will be working their way north.

Attorney Uresk informed the commission that Mrs. Sumner reported there is still a portion of a speed bump in the road at 11,000 North.  Any class "D" road the road must be open with no speed bumps or closed gates.

Ratification of the 2002 Delinquent Tax Sale
Commissioner Stradinger questioned Attorney Uresk regarding the Lew Diaz property.  Mr. Uresk stated he could find no evidence of error by the county.   The treasurer's office used the address they received from the owner.  Mr. Diaz claims he did not receive a tax notice for five years.  Commissioner Stradinger and Attorney Uresk noted that it is suspect that he notifies the treasurer's office two days after the sale.

Motion:   Commissioner Ross made a motion to ratify the 2002 Delinquent Tax Sale.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Insurance Coverage for the Children's Justice Center - John Gardner  During the construction period of the justice center the county carried insurance on the building.   After the construction was complete the commisison directed Judy Mutton to take the justice center off the ocunty insurance program.  The commission believed the Children's Justice Center was a seperate entity and could provide its own insurance.   The county acts as a vehicle for justice center grant money to pass through.

Mr. Gardner stated, the building is owned by the ocunty and the county could be liable.   The county is responsible for any condition that needs to be fixed or repaired.

Judy asked if there was anyone maintaining the building at this time.  Mr. Gardner answered that they do not have a person designated to take care of the building at this time.

Commissioner Ross commented that it was not the intention of the ocunty to own the building.  The intention was that the county be resonsible for receiving the money and dispersing it where it needs to be.

The commission made a phone call to UBAG Director Lori Brummond to clarify responsibility issues.  Mrs. Brummond stated because the grant was obtained under Duchesne County liability insurance was obtained during the building process.  The insurance was then allowed to lapse.  Mrs. Brummond suggested that because the county will retain the builing if it were to become vacated the county should carry the insurance.

Commissioner Stardinger asked who should be resonsible for the maintenance on the justice center building.  Mrs. Brummond stated that UBAG has started a depreciation fund to take care of repairs.

Commisison meeting adjourned temporarily for the 2:00 P.M. tele-conference of the Duchesne/Wasatch Bluebench Landfill Special Service District Board.

Reconvened at 2:15 P.M.

Auditor's Office-Vouchers-Tax Adjustments-Personnel Issues-Time Sheets.  Vouchers:  Deputy Clerk/Auditor Andrea Higbee presented vouchers #79609 to #79685 totaling $88,124.83 for approval.

Motion:   Commissioner Ross made a motion to approve the vouchers.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Building and Grounds Manager Mike Lefler, stopped in to discuss the revitalization progress ont he blue fair building.  The repair work on the asphalt has been done.  Mike is in the process of reviewing bids for sheetrock and exterior painting.
