MINUTES FOR REGULAR COMMISSION MEETING HELD JUNE 3, 2002
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, and Commissioner Guy R. Thayne.  Commissioner Ross absent.

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, Lamar Long, John Wills, John Whitman, Jerry Lisonbee and Rick & Alisse Coil.

Pledge of Allegiance

Road Issues:  Doug informed the commission that he had received information from Rex Harrison of Horrocks Engineers that the BIA has signed the MOU on the Arcadia Road.

Doug also stated that the purchase of the Myton Landfill will be finalized next week.

Commissioner Stradinger informed Doug that she had a request for pavement on the Parriett Road, County Road #33 in the Pleasant Valley area from Alton Moon.  Doug stated that the road is scheduled to receive another mile of asphalt this year.

Consideration and Approval of Fair Ground Maintenance Contract - Jerry Lisonbee   Jerry and the commission reviewed the contract and agreed to extend the contract for three years with a one hundred dollar raise each year.  Insert:

Motion:   Commissioner Thayne made a motion to accept the maintenance and operations as written in the contract.  Motion carried.  Roll Call Vote:   Both Commissioners Voting Aye.

Consideration of Fence Removal from County Right-of-Way - Lamar Lond and John Wills
Attorney Uresk informed the commission that the Cottonwood Creek Estates subdivision was approved in 1982.  Both Mr. Wills and Mr. Long own property in the subdivision.

Mr. Long owns property on both sides of the road.  A number of years ago he fenced the property off for livestock use.  There has not been any problems with the fence until now.  Mr. Wills would like to have the fence moved back off the county right-of-way.

Mr. Wills stated that he is going to reopen the road in order sell lots.

Mr. Long stated that he would remove the fence, but he wants the road to meet county subdivision standards.

Mr. Wills stated that when the subdivision was put in the road was bonded by the county.

Attorney Uresk informed the commission that the old ordinances are not clear as to who is responsible for developing the road.  He would like some time to research this issue before a decision is made.  The issue will be rescheduled.

Dispute of 2002 Tax Sale - Rick & Alisse Coil
Mr. Coil addressed the commission .  He stated that he wishes to contest the sale of property VDP-0037 at the May 30, 2002 tax sale.  Mr. Coil asked that the property originally sold to him be returned.  (see attachment)

Mr. Coil stated that during the sale standards and guidelines were set which Auditor Diane Freston strictly followed.  When the auditor received no higher bids she would announce sold.  In this particular case the bidder then stated that she should have been given more time to respond and that she had been bidding all along.  The auditor asked for a determination from Commissioner Ross, he responded that the bidding should continue.

Clerk/Auditor Diane Freston noted that the bidder was late with her resonse and she had called the bidding closed an announced sold to Mr. Coil.

Attorney Uresk informed the commission that in order to make a fair decision we need to have a response from the other bidder.

A decision will be made in this matter after the other bidder has had a chance to respond in next weeks commission meeting.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues - Department Head Time Sheets
Vouchers:
  Clerk/Auditor Diane Freston and Deputy Clerk/Auditor Andrea Higbee presented vouchers #79386 to #79496 totaling $408,045.54 and predraws #79384 & $79385 totaling $11,480.00 for approval.

Motion:   Commissioner Thayne made a motion to approve the vouchers.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Tax Adjustment - Assessor

Motion:   Commissioner Thayne made a motion to accept the tax adjustments by the Assessor.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Approval of May 20, 2002 Commission Minutes - The minues were reviewed and corrections made.

Motion:   Commissioner Thayne made a motion to accept the minutes with corrections.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Time Sheets - Deputy Clerk/Auditor Leann Stewart presented the department head time sheets for review.

Morning Agenda Matters - Attorney Uresk stated that Pinion Forest Service District asked to borrow $5,000 on a tax anticipation note.

Motion:   Commissioner Thayne made a motion to do a tax anticipation note in the amount of $5,000 for administration costs to Pinion Forest Service District.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Division of Wildlife Resources Road Closure on DWR Lands on Tabby Mountain  Clayton Chidester stopped in earlier in commission meeting to report on this agenda item.  He stated that the Public Land Use Committee recommended the agreement be rewritten to extend it for four years with a two-year review period and no sunset clause.

Randall Thacker informed the commission that the proposal has been before the land use committee.   The committee has given a favorable recommendation, after having had good input from neighboring property owners.  Insert:

Motion:   Commissioner Thayne made a motion to accept the agreement with the Division of Wildlife Resources.  Motion carried.  Roll Call Vote:   Both Commissioners Voting Aye.
