MINUTES FOR REGULAR COMMISSION MEETING HELD MAY 20, 2002
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Acting Chairman Larry S. Ross, and Commissioner Guy R. Thayne.  Commissioner Stradinger is attending a public lands conference.

Others Present:  Road Supervisor Douglas Nielsen, Scott and Jerilynn Adams, and Pat Ford.

Pledge of Allegiance

Road Issues:  Doug informed the commission that the roads in the Roosevelt area will soon be ready for paving.  They are also preparing the roads in Sharmel Acres and will pave them if time and funding are available.

The department is working in the Tabiona area catching up on some roads there.

Commissioner Ross asked Doug to check on the status of the MOU with the BIA with Vernon Palmer.

Commissioner Thayne reminded Doug the issue of selling Myton Landfill needs to be resolved.  Doug will check with Attorney Uresk to see if he had completed the necessary paperwork.

2002 Beer License Renewal - Defa's Dude Ranch
Motion:
  Commissioner Thayne made a motion to renew the beer license for Defa's Dude Ranch for 2002.  Motion carried.  Roll Call Vote:   Both Commissioners Voting Aye.

Tax Deferral - Scott Adams
Mrs. Adams stated there seems to be confusion regarding the proper recording of the deed to the Adams property.  The billing has been going to a grandparent who in the past had paid them as payment for work being done by Scott.  The Adams were not aware the taxes were delinquent until a notice was placed on the property.   Treasurer Colene Nelson has put together a monthly payment schedule for the next year of $290.58.  Because of the mix-up in recording the deeds Mrs. adams would like the comission to forgive the penalty and interest. 

Commissioner Thayne suggested that the Adams and Mrs. Nelson go to the recorders office to check to see why the tax information was not being sent to them.

Commissioner Ross stated that if the county amde a mistake in recording, a reduction can be made.

Jeremy Scoolie telephoned the commission and stated that his property in Bandana Ranch is going to the tax sale.  Mr. Schoolie would like the commission to allow him more time to pay his taxes.  Mrs. Nelson advised the commission that the property does not have a home on it and is listed as recreational.  Commissioner Ross informed Mr. Schoolie that because he does not live on the property the county must follow the rules, he has until 10:00 AM on May 30th to pay his taxes.

1:30 Public Hearing - Zone Change Request, Cedar Mountain Subdivision Lots 31 & 32, Changing from A-5 to Commercial  Mr. Ford informed the commission that he wishes to build storage units and establish a dry storage area on the lots.  Mr. Chidester stated that the zone change has received a favorable recommendation from the Planning Commission.

Motion:   Commissioner Thayne made a motion to accept the zone change for Cedar Mountain Subdivision Lots 31 & 32.  Motion carried.  Roll Call Vote:   Both Commissioners Voting Aye.

.....Edmund Bench, and Darrell Gillman joined the meeting.....

Mr. & Mrs. Adams and Colene Nelson returned from the recorders office.   The Adams home sits on two different lots.  There wer two deeds to be recorded by the mortgage company for the Adams property.  The land office made the mistake and the deed with the correct address was no recorded.  The tax bills have been going to a grandparent who is now deceased.

Motion:   Commissioner Thayne made a motion to accept the tax deferral as suggested by the Treasurer, and to allow the Adams to make payments of $290.58 for twelve months.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Soil Conservation District Progress Report
Mr. Bench, chairman of the Soil Conservation District Board reported on the activities for the past fiscal year.

Mr. Bench stated that this year to date, 65 cooperators have met with the board and 47 conservation plans have been approved.  The district installed 54 systems treating over 1800 acres and saving approximately 6100 tons of salt from going into the river systems.  There is a total of $1,744,000 conservation dollars under 59 contracts.   The district also continues to support the PAWS-ON education program.

Mr. Bench is here today to also remind the commission of the $5,000, which the county appropriates each year for the Soil Conservation District.

Motion:   Commissioner Thayne made a motion for the County Auditor to issue a check in the amount of $5,000 to the Soil Conservation District to be distributed to various programs.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

The commission and Mrs. Freston discussed the Alfred Stringham contract, we are still waiting for Uintah County to complete the contract.  Mr. Stringham is repairing the television wites and purchasing new equipment and needs payment as agreed by both Duchesne and Uintah county.

Motion:   Commissioner Thayne made a motion to advance Mr. Stringham another $10,000 and for Commissioner Ross to contact Uintah County to match the payment.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Auditor Diane Freston reminded the commission that it is time to renew the contract with Jerry Lisonbee for maintaing the arena, horse stalls and livestock area.  She also noted the UBAG contract has not be returned for signature.  Furthermore one department has made an inappropriate purchase of county shirts.  Commissioner Ross stated that he will discuss the purchase with the department head.

Vouchers:   Clerk/Auditor Diane Freston and Deputy Clerk/Auditor Andrea Higbee presented vouchers #79292 to #79383 totaling $117,262.93 for approval.

Motion:   Commissioner Thayne made a motion to approve the vouchers.  Motion carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Motion:   Commissioner Thayne made a motion to accept the tax adjustments by the Assessor.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of May 13, 2002 Commission Minutes -  The minutes were reviewed and corrections made.

Motion:   Commissioner Thayne made a motion to accept the minutes with corrections.   Commissioner Ross second.  Motion carried. Roll Call Vote:   All Commissioners Voting Aye.

Personnel Issues - Judy Mutton
Judy presented information from Utah Retirement Systems regarding contributory on no contributory status for the county.  The commission asked that she have a representative from Utah Retirement meet with them.

Other Business
Fire Marshall Gerog Adams presented a list of old fire trucks used by the various fire departments in the county.  The old trucks are to be donated to the cities with the understanding that it's their responsibility to license them.

Commissioner Ross related that the county has received $64,000 from the State Olympic Fund.
