MINUTES FOR REGULAR COMMISSION MEETING HELD APRIL 29, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, and Clinton Peatross.

Road Items - Supervisor Douglas Nielsen
Doug presented bids for HFE-90 chipping emulsion for the 2002 season.   There were two bids:

Koch Performance Asphalt $155.00 per ton, from the Grand Junction Plant
Crown Asphalt $160.00 per ton, from Wood Cross

There were three bids for freight quoted within a 20-mile radius of Roosevelt Utah:

Crown Woods Cross 25 us ton minimum $21.85
Crown Woods Cross 35 us ton minimum $19.72
Koch Grand Junction 25 us ton minimum $26.11
Iowa Grand Junction 25 us ton minimum $21.00

Motion:  Commissioner Thayne motioned to accept the bid of $155.00 for HFE-90 chipping emulsion from Koch Performance Asphalt, and the bid of $21.00 for transport from Grand Junction Colorado by Iowa Tanklines, Inc.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Discussion of Television Site Lease
Attorney Uresk informed the commission that he had faxed a ltter to Janice & Allen White regarding the lease site, and his calculations of monies owed.  Mr. Uresk is waiting for a response from the Whites.

Consideration of Former Roosevelt Senior Center as Surplus Property  The commission and the attorney discussed the proper policy for the county to advertise property as surplus and to sell it as such.  Commissioner Stradinger directed Attorney Uresk to prepare a policy applying to realtors.

Motion:  Commissioner Ross motioned for the county to consider the former Roosevelt Senior Center surplus property.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:   All Commissioners Voting Aye.

Utah Mini Ranches - Water System Bond Approval Phases 6 & 7  Mr. Steed advised the commisison that Utah Mini Ranches whishes to bond with the county for $42,000.  The bond will allow for an extension of approximately 10,000 feet of new water line along with another 35,000 gal storage tank.

Commissioner Stradinger asked if sufficient water was purchased from Duchesne City to supply the subdivision.  Mr. Steed replied that there are seventy-seven hook-ups now and the extension will be for an additional one-hundred.   The added storage tank will insure an ample supply of water.

Commissioner Thayne questioned Mr. Chidester as to whether the county had a copy of the agreement with Duchesne City to provide water to Utah Mini Ranches.   Mr. Chidester will check to see if a copy is on file.

Commissioner Thayne also questioned the reason for bonding the water lines.

Attorney Uresk explained that the county requires subdivisions to have all improvements or to post a bond to complete the improvements.  In the case of Utah Mini Ranches they need to post a bond for an extension of the water system.

Commissioner Ross asked if any fire hydrants were available in teh subdivision.  Mr. Steed informed the commission that they had installed one, but the state had required that Mr. Steed remove it because it was not in the master plan.   Mr. Peatross stated that he talked with county fire marshal Georg Adams and he had given them a waiver because of the proximity of the fire department.  (See update to this conversation in other business minutes ofr May 6th)

Motion:  Commissioner Ross motioned to approve the water system bond for phases 6 & 7 in the amount of $42,000.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Commissioner Ross received a ltter from Questar stating that they are reviewing the working agreements with Duchesne County.

Clayton Chidester, Planning & Zoning Director presented the agreement between Duchesne City and Utah Mini Ranches regarding water purchased for the subdivision.   Commissioner Thayne expressed concern because the agreement is for 135 acre feet of water a year.  The State of Utah takes the position of one acre-foot of water per four-member family per year.  Commissioner Ross is ocncerned that the subidvision may not meet the state fire code per day.  Commissioner Thayne suggested that Mr. Chidester relay the commissions concerns to the Planning and Zoning Commission. 

Approval of April 22, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:  Commissioner Thayne motioned to accept the minutes with corrections.  Commissioner Ross second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Tax Issues:  Donald Hatch - Mr. Hatch was unable to attend.  He will reschedule next week.

Aging Department:  Mrs. Brummond was unable to attend.  This agenda item will reschedule for next week.

Auditors' Office - Vouchers - Tax Adjustments - Personnel Issues.  Vouchers:  Deputy Clerk/Auditor Andrea Higbee presented vouchers #79057 to #79133 totaling $112,766.37 for approval.

Motion:  Commissioner Thayne motioned to approve the vouchers.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
