MINUTES FOR REGULAR COMMISSION MEETING HELD APRIL 22, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne

Others Present:  Road Supervisor Douglas Nielsen, Troy Cooper, Clayton Chidester, Travis Stewart, Laurie Brummond, Irene Hansen, Tom & Melody Bird.

A teleconference regarding the Severance Tax Bill vetoes by Governor Leavitt was held at 1:00 pm.  The counties participating in the teleconference were:  Duchesne, Uintah, Daggett, and Garfield.  The teleconference was a strategy session to have Severance Tax Bill H152 considered before the House and Senate for override of the Governors veto.  The county commissioners from the participating counties will contact as many legislators as possible before the legislature meets on April 24th.

Public Hearing - Zone Change, Travis & Tonya Stewart Zone Change from A-5 Agricultural to a A-2.5 Acre Agricultural Zone.  SW1/4 of Sec. 11, T2S, R2W USB&M.
Clayton Chidester, Planning & Zoning Director presented a map of the proposed zone change.  Mr. Chidester stated that they have health department approval for a water well and the survey meets county ordinances.

Commissioner Stradinger asked Mr. Chidester to explain the process for health department approve of a well before the water is tested to see if it meets the standards for culinary purposes.

Motion:  Commissioner Thayne Mortioned to approve the zone change for Travis & Tonya Stewart.  Commissioner Ross second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Bid Awarding for County Fair Buildings
The bids were opened and reviewed in the morning work meeting

Motion:  Commissioner Thayne motioned to award the bid for the open shed to Ivie Construction for $27,425.60 minus $4500.00 for a 4" cement floor making the bid $22,925.60.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:  Commissioner Ross motioned to award the 25 X 50 expansion of the sale barn to C & T Construction for $22,500.00.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Tax Deferral - Tom & Melody Bird
Mr. Bird requested a one year deferral to pay his taxes.   He stated that he has been out of work, but he is now working and will be able to bring the taxes current.  Commissioner Ross asked if the property has his home on it.   Mr. Bird answered that it did.

Motion:  Commissioner Thayne motioned to grant a one-year deferral to Tom & Melody Bird with monthly payments of $246.28 for one year.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Tax Deferral - Donald Hatch
Mr. Hatch not present due to illness.  The deferral will be addressed next week.

Road Items - Supervisor Douglas Nielsen
Doug presented a progress report on the Arcadia Road project No. STP 1544-(1)-5 and a request for funding the Bluebell Connector Road, Route 1576, SR 87 to SR 121 prepared by Rex Harrison of Horrocks Engineering.  Mr. Harrison will take the two documents to the joint highway committee at the annual meeting in St. Geroge on April 23, 2002.

The propoesed Bluebell Connector Road begins at approximately 3000 West 1500 North, then proceeds east and south for a distance of 2.8 miles before connecting to SR 121.

Commissioner Stradinger addressed a letter the commission received from Mountains West Ranches.  (see attached)  The letter regards the illegal dumping in Sec. 13, T3S, R6W.  Doug will ask the sheriff's department to investigate.  Doug will place a no dumping sign in the area.

Commissioner Thayne presented a letter from the Assessor Greg Garff.  The letter contains an appraisal of the former Myton landfill property owned by the county.  The valuation of parcel 2778-0001 is $5100.00 this is based on current market value.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues.  Vouchers:  Deputy Clerk/Auditor Becky Norris presented vouchers #78992 to #79056 and predraw #78991 totaling $44,447.74 for approval.

Motion:   Commissioner Ross motioned to approve the vouchers.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of April 15, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:  Commissioner Ross motioned to accept the minutes with corrections.  Commissioner Rhayne second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
