MINUTES FOR REGULAR COMMISSION MEETING HELD APRIL 8, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne.

Others Present:  Road Supervisor Douglas Nielsen, Deputy Attorney Roland Uresk, Gil Mitchell, and Deputy Clerk/Auditor Carol Casey

Road Items - Supervisor Nielsen
Doug presented a draft MOU on the Arcadia Road project to the commission for review.

Doug also informed the commission that the week of disposing waste at no charge at the landfill is April 27 - May 4, 2002

Commissioner Ross stated that Myton City Mayor Cooper requested help from the county with the cost incurred from Pleasant Valley residents using the dumpsters in Myton City.  The commission determined that this is a Myton City issue.

Commissioner Thayne has received a request for dumpster services for some residents in the Fruitland area.  Commissioner Thayne will relay the information to the local dumpster service, who in turn can contact the residents requesting service.

Mr. Gil Mitchell advised the commission that he has received a firm offer to buy his hot mix batch plant.

Commissioner Stradinger asked if Mr. Mitchell desired to be let out of his contract.  Mr. Mitchell answered that if the sale went through he would like to be released.

The commission will take Mr. Mitchell's request under advisement.

Motion:  Commissioner Thayne motioned to extend the discussion until 3:30 to allow time to confer with all interested parties.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Discussion and Approval of 2002 Tax Sale Rules - Diane Freston.  Motion:  Commissioner Thayne motioned to accept the public notice of the 2002 Tax Sale Rules.  Commissioner Ross second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye

Discussion and Approval of Resoltuion No. 02-03 - A Resolution Establishing the 2002 Tax Sale Methods, Rules & Procedures & Allocating Administrative Costs to Delinquent PropertiesMotion:   Commissioner Ross motioned to accept Resolution No.  02-03.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of April 1, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion: Commissioner Thayne motioned to accept th eminutes with corrections.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

 2002 Beer License Renewals - Rock Creek Ranch & Bluebell Store

Motion:  Commissioner Ross motioned to approve beer license renewals for Rock Creek Ranch & Bluebell Store.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

LSTA Federal Grant for Duchesne County Library - Lorie Evans   Miss Evans informed the commission that the funds from the LSTA grant willb e used to purchase computer upgrades and software.

Motion:  Commissioner Ross motioned to accept the LSTA Federal Grant int he amount of $6,000.  Commissioner Thayen second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Television Transmitter Site Lease Agreement  - Janice White
Mrs. White informed the commission that the family is selling the property where the television transmitter is located.  In the past the transmitter lease payment schedule has not been adhered to.

Because the lease has a term of ninety-nine years, and dut to rapid changing technology the commission and Mrs. White discussed adding a clause to the contract that states the county has the option to cancel at the commission's discretion.   Mrs. Whie asked for time to discuss the contract change with her husband.

Motion:  Commissioner Ross motioned for the county to pay the monies past due for lease of the television transmitter site located on the White's property as calculated by Deputy Attorney Uresk.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Tax Deferral - Dennis Lee
Treasurer Colene Nelson represented Mr. Lee.  Mrs. Nelson informed the commission that Mr. Lee thought the mortgage company was paying the taxes.  Mr. Lee is now five years behind in taxes and in danger of losing his home.  Mr. Lee is disabled and out of work.  He would like to hav a deferral and make payments in order to bring the taxes current. 

Deputy Attorney Uresk informed the commission that the treasurer's proposal for payment falls within county policy.

Motion:  Commissioner Thayne motioned to follow the treasurer's advice and grant a one-year deferral to Mr. Lee.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Library Paint Bid
The commission received one bid from Young Brothers Painting Contractors.   Itemized as No. 1 - Patch cracks in ceiling and walls and paint - $8986.00.   No. 2 - Replace all sheetrock on ceiling texture, patch walls and paint $22,665.00.   No. 3 - Replace insulation if needed $8,140.00.

The commission ruled the bid not acceptable.

Motion:  Commissioner Thayne motioned that after advertising the job twice and receiving unacceptable bids that Commissioner Ross contact a painter and makea rrangements to get the job done.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

National Library Week Proclamation  - Lorie Evans
Librarian Lorie Evans, and Susan Merrill, bookmobile and library, presented the National Library Week Proclamation.

Motion:  Commissioner Ross motioned to recognize April 14-20th as National Library Week.  Commissioner Thayne second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Upper Country Water - Resolution 02-04
Motion:
  Commissioner Ross motioned to approve the notice of proposal for annexation received from Upper Country Water District.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues  Auditor Diane Freston presented a request from Altamont City to back taxes on the property bought for the fire station.  The commission directed her to send a ltter to Altamont City requesting that they bring the taxes current before the May Tax Sale.

Vouchers:  Deputy Clerk/Auditor Andrea Higbee presented vouchers #78796 to #78907 and predraw #78795 totaling $188,698.25 for approval.

Motion:  Commissioner Thayne motioned to approve the vouchers.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Miss Higbee discussed transferring the credit card service to another bank for payment convenience. 

Motion:  Commissioner Thayne motioned to transfer the credit cards to Zions Bank.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

3:30 Resume Commission Meeting
The commissioner further discussed the matter of Mr. Mitchell asking to be released from his contract to supply hot mix this year for the coutny.  If Mr. Mitchell sells his hot plant he will withdraw his bid.  In that event the second in line for low bid will be awarded the contract.  However if the sale does not go through Mr. Mitchell will honor his contract.

Commissioner Ross stated that $15,000 has been appropriated from the Permanent Community Impact Fund Board to help finance the preparation of an energy efficiency study on three buildings owned by the county. The county needs to proceed with an advertisement for an engineer to do the study.
