MINUTES FOR REGULAR COMMISSION MEETING HELD APRIL 1, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM IN DUCHESNE, UTAH

Commissioners Present:  Commissioner Larry S. Ross and Commissioner Guy R. Thayne, Commissioner Lorna Stradinger absent

Others Present:  Road Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston, Clint Peatross, Joan Steed, Teresa Nielsen Planning and Zoning, and Deputy Clerk/Auditor Carol Casey

Road Items:  Supervisor Nielsen
Doug informed the commisison that he had talked with Mr. Rex Harrison of Horrocks Engineers regarding the Arcadia Road project.  (this is in reference to minutes of March 25th)  The Federal Highways Administration informed Mr. Horrocks that BIA funding will work for the local match on county STP funds after design and right-of-way.  The county will pay 6.77% on the balance of the STP funds needed for construction.  The commission is still concerned about the possibility of change orders even though they must sign if any occur.  There is the possibility that more STP funding could be obtained from UDOT to help cover the cost of change orders.

Commissioner Ross inquired as to where the progress was on the Lake Fork Bridge.  Doug replied that Mr. Harrison expected it to be at least six months to complete environmental studies.

Doug informed the commisison that the road department is currently graveling roads on North Myton Bench and Road #59 in Arcadia.

Road Bond - Mini Ranches Phase VI
Mr. Clint Peatross and Joan Steed presented the subdivision improvements performance bond in the amount of $53,606.25 for phases VI & VII.  This will be the third bond on roads in the subdivision.  Mrs. Steed informed the commission this is the first step in the obtaining plat approval from the planning commission.  The sales on the other five phases have reached 64% and they would like to start selling in phases VI & VII.

Commissioner Thayne expressed his concerns regarding water supply for all the lots.

Mrs. Steed stated that they have adequate water for seventy-five connections.

Commissioner Ross questioned Teresa Nielsen of planning and zoning as what is needed for the planning commisison approval.

Mrs. Nielsen stated that Mini Ranches was on the agenda, but was taken off because they do not have health department approval yet.

Commissioner Ross asked if any of the roads in the subdivision have received gravel.  Mr. Peatrss stated not at this time, but some culverts are in place.

Commissioner Ross reviewed the road bond stating that the $53,606.25 is for road base and six inches of gravel twenty-foiur feet wide in Phase VI & VII.

Motion:  Commissioner Ross motioned to approve Bond No. 871374S.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Motion:  Commissioner Ross motioned to accept the tax adjustments submitted by the assessor.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Approval of March 18, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:  Commissioner Ross motioned to accept the minutes with corrections.  Roll Call Vote:  Both Commissioners Voting Aye.

Vouchers Clerk/Auditor Diane Freston presented vouhcers #78734 to #78794 totaling $95,718.89 for approval.

Motion:  Commissioner Ross motioned to approve the vouchers.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Time Sheets:  Deputy Clerk/Auditor submitted the department head time sheets for review.

Discussion and Approval of Resolution 02-02-Appointing a Representative to the UACIM Membershikp Meeting - Judy Mutton

Insert:

Motion:  Commissioner Ross motioned to appoint Commissioner Thayne as the Duchesne County representative at the UACIM membership meeting.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Tax Issues - Owen B Williams
Mr. Williams owes three years taxes on his property.  Mr. Williams and his wife have had large medical expenses.  Mr. Williams is here to ask the commission to wave the penalty and interest and to make arrangements ofr payments with the treasurer to catch up the taxes.

Motion:  Commissioner Ross motioned to forgive the $421.15 in penalty and interest.  Mr. Williams will pay to the treasurer's office a payment of $150.00 a month until the taxes are brought current.  Motion Carried.   Roll Call Vote:  Both Commissioners Voting Aye.

Motion:  Commissoner Ross motioned to contribute $1,000.00 to the Utah Opera for the Five Day Education Outreach Program.  The check will be sent to the Duchesne County Area Chamber of Commerce.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.
