MINUTES FOR REGULAR COMMISSION MEETING HELD MARCH 25, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne

Others Present:  Deputy County Attorney Roland Uresk, Road Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston, Peter Grundfossen BLM, WR Pastore, G. Ched Pastore, Charlotte & Lynn Christensen, Stanley Whaley, James & Twila Calhoun, Dale Gines, Gordon Moon, Mac Reber, Dixie Jones, Sara Kelle, and Deputy Clerk/Auditor Carol Casey.

Discussion and Approval of Memorandum of Agreement with BLM and Duchesne County
Mr. Peter Grundfossen, BLM, presented the MOA for review.
Motion:  Commissioner Thayne Mortioned to accept the memorandum of agreement with the BLM as written.  Commissioner Ross second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.  (see attachment in Clerk's Office)

Road Items:  Supervisor Douglas Nielsen
Bid Opening for Road Chips and Distributor Truck
The two bids received are:

Paul Young Construction Item #1 road chips $9.20 per ton from the Fruitland Pit.
  Item #2 (no bid)
Burdick Paving Item #1 road chips $9.25 per ton from the Myton Pit.
  Item #2 distributor truck and operator $14.00 per ton.

Motion:  Commissioner Ross motioned that because of the distance from the Myton pit to Roosevelt to accept the higher bid from Burdick Paving for road chips and distributor truck and operator.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Commissioner Ross asked Doug if he had information regarding the MOU on Arcadia Road Phase II.  Doug relayed information from his conversation on Friday March 22nd with Mr. Rex Harrison of Horrocks Engineers.  Duchesne County will pay 6.77% local match on all S.T.I.P. from UDOT before they will release the funds to BIA.   FHWA & UDOT are checking to see if BIA funds could be used for this match.   As for over run's, the county will have to sign off on any change orders, and construction engineering is part of construction and will be funded 50/50 by BIA.

Rights of Way Issures - Weathering Heights
Dixie Jones acting as spokesperson for gorup from Weathering Heights informed the commission that the Hanna Water & Sewer District is interested in delivering water to the residents of Weathering Heights.  The main problem is that there is no workable utilities easement.  The county surveyor has given an estimate of cost for a survey and plat map of about $4,500.  The residents of the subdivision are requesting county help with the cost of the survey.

Attorney Uresk informed the commission that the illegal property division was done over twenty years ago, there needs to be a designation of where the road-ways are.  As for county help the only purpose that would justify paying for the survey is the overall issue of it being an unapproved division.  The county could extend the funds to remedy the problems if it is in the counties interest, and in doing so the county would be setting precedent.

Commissioner Ross suggested that the property owners put up a sixty-six foot road right-of-way with a utilities easement included in the right-of-way and deeded to the county.  This does not mean that the county will build a road it just means that there would be a utilities easement.

Commissioner Thayne reminded the group that deeding an easement to the county would not mean that the county is going to build a road in the near future, it just means there will be a road and utilities righ-of-way.

Several members of the group from Weathering Heights stated that there are easements on their deeds but they don't match with neighboring lots.  The easements are in the name of the former owner Mr. Larry Maxwell.

Rex Harrison, Horrocks Engineers stated they reviewed the easements and deemed them inconsistent and not workable.  Mr. Harrison feels that even if a water line is run future development is still a problem, the subdivision needs a legal access.

Motion:   Commissioner Ross motioned that if the property owners provide an agreement with a sixty-six foot right-of-way for a road, the ocunty will pay surveying costs.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Hanna Sewer and Water Bonding and Rights-of-Way
Rex Harrison of Horrocks Engineers represented Hanna Water District.  Mr. Harrison presented a map of the district outlining the route the line will take and the size of pipe to be used.  Mr. Harrison also had information relevant to the number of utility crossings.  (see attachment in Clerk's Office)

Mr. Harrison stated that Hanna Water District would like to arrange an agreement with the county to allow the contractors to do their work, and release the bond after the final inspection.  The bond would be in the $30,000 to $50,000 range.

Commissioner Ross suggested that the district work out the agreement with the county.  Mr. Harrison and Attorney Uresk will prepare the document and present it for commission review.

Mr. Harrison reviewed the information Doug had presented regarding the MOU with the BIA on the Arcadia Road project.

Television Translator Service Agreement - Alfred Stringham
In as much as the TV contract has been awarded to Alfred G. Stringham, arrangements for his contract need to be made.  His contract is for $110,000 being split 50/50 with Uintah County.  Roland will prepare the contract.  Both Uintah and Duchesne counties will make an upfront payment of $10,000 each.  The remaining amount will be paid monthly by both counties.  Commissioner Thayne will contact Uintah County regarding their portion of payment to Mr. Stringham.

Motion:   Commissioner Thayne motioned to advance a payment of $10,000 to Mr. Stringham for television translator maintenance.  Commissioner Ross second.  Motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Approval of March 18, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:   Commissioner Ross motioned to accept the minutes with corrections.   Commissioner Thayne second.  Roll Call Vote:  All Commissioners Voting Aye.

Maintenance Truck Discussion
This agenda item was discussed in the morning work meeting and a motion was made then to allow Mr. Mike Lefler of the maintenance department to use a county vehicle to travel to and from work.  The motion follows

Motion:   Commissioner Ross motioned to allow Mr. Lefler to take home a county maintenance vehicle for use of county emergency's and to have the county vehicle policy changed to state such.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Discussion and Approval of the 2002 Surplus Sale;
Motion:
  Commissioner Thayne motioned to approve the 2002 surplus sale to be held April 13th.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commisisoners Voting Aye.

Motion:   Commissioner Ross motioned to approve the rules for the 2002 tax sale.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Vote Aye.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues. 
Vouchers
Clerk/Auditor Diane Freston presented vouchers #78661 to #78733 totaling $84,680.59 for approval.

Motion:  Commissioner Ross motioned to approve the vouchers.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Discussion and Approval of Ordinance 02-183 Adopting Model Codes
Motion:
  Commissioner Thayne motioned to approve Ordinance 02-183 as amended.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

The commission discussed the beer license renewal for Fruitland Store.  When Shannon Johnson submits the lease documents a beer license can be issued.
