MINUTES FOR REGULAR COMMISSION MEETING HELD FEBRUARY 25, 2002 BEGINNING AT 1:00 PM IN THE COMMISSION BOARD ROOM IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne.

Others Present:  Road Supervisor Doug Nielsen, Deputy Clerk/Auditor Carol Casey.

 Road Items:  Supervisor Doug Nielsen:
Mr. Nielsen reported that the Memorandum of Understanding with the BIA concerning the Arcadia Road Project has not arrived.  Commissioner Ross suggested that Mr. Nielsen contact Rex Harrison of Horrocks Engineering regarding the MOU.

Commissioner Thayne stated that he had received a request to grade the road at Kelsey Corner.  The road is not a county and is not maintained by the county, but it has been graded periodically in the past.  Mr. Nielsen stated that he will have the grader take care of it while he is in the area.   The commission discussed the possibility of adding the road at Kelsey Cornerto the county system.  Mr. Nielsen stated that some of the residents living on the road are not in favor of it being added to the county road system.

Appointment of Board Members to Special Service District #2
There were three applications submitted for the Special Service District No. 2 seat.

The commission reviewed the applications from Don Winterton, Keith Goodspeed, and Ted Kappen.  Terry Fieldsted has requested to be reappointed to his position on the board.

Motion:  Commissioner Ross motioned to reappoint Terry Fieldsted to the Special Service District No. 2.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Commissioner Stradinger opened nominations to fill the vacant seat on the board of Special Service District No. 2.  Don Winterton and Ted Kappen were nominated.  Commissioner Thayne motioned that nominations cease Commisisoner Ross second.  Roll Call Vote:  Two Commissioners Voting for Don Winterton, One Commissioner Voting for Ted Kappen.  Don Winterton will fill the position on the board for Special Service District No. 2.

The Commission stated that Deputy Uresk should review the organization rules for Special Service District No. 2.

Approval of February 11, 2002 Commissioner Minutes - The minutes were reviewed and corrections made.

Motion:  Commissioner Ross motioned to accept the minutes with corrections. Commissioner Thayne second.  Roll Call Vote:  All Commissioners Voting Aye.

Darrell Grant stopped in to discuss some problems he has encountered while traveling on county roads crossing tribal lands to the U.S. Forest.  Mr. Grant would like some clarification on stopping on the road to look at wildlife, allow the kids to ride their bikes or horses, and taking pictures.  The commission directed him that as long as he stays within the road easement he is not in conflict with the Rights-of-Way Agreement.

R & M Janitorial Services - Contract for Janitorial Service
Motion:  Commisisoner Thayne motioned to accept the contract.   Commissioner Ross second.  Roll Call Vote:  All Commissioners Voting Aye.

2002 Beer License Renewal - Hanna Lounge
Motion:  Commisisoner Thayne motioned to approve the renewal of the 2002 beer license for Hanna Lounge.  Commissioner Ross second.  Motion Carried.   Roll Call Vote:  All Commissioners Voting Aye.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues - Tax Adjustment - Assessor - Treasurer

Motion:  Commissioner Thayne motioned to accept the tax adjustments submitted by the assessor and treasurer.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Vouchers:  Deputy Clerk/Auditor Andrea Higbee presented vouchers #78267 to #78397 totaling $377,246.19 for approval.

Motion:  Commissioner Ross motioned to approve the vouchers with correction to voucher #78381 to USDA Rural Development installment loan payment and payoff for the landfill cell-liner.  Commissioner Thayne second.  Motion carred.  Roll Call Vote:  All Commissioners Voting Aye.

Agreement for Legal Services with Deputy Attorney Roland Uresk
Motion:  Commisisoner Thayne motioned to accept the agreement for legal services between Duchesne County and Deputy Attorney Roland Uresk.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
