MINUTES FOR REGULAR COMMISSION MEETING HELD FEBRUARY 11, 2002
BEGINNING AT 1:00 PM IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH 

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne.

Others Present:  Road Supervisor Doug Nielsen, County Attorney Herbert Gillespie, Benny Saiz, Doug and Wendall Adams, Deputy Clerk/Auditor Carol Casey.

Road Items - Supervisor Doug Nielsen
The road department is currently working on three locations in the county.  They are working on County Road No. 59 near the Johnson Water Office, County Road No. 64 in Arcadia and County Road No. 156 in Hancock Cove.

2002 Disclosure Statement - County Attorney Herbert Gillespie
Pursuant to the Utah Public Officers' and Employees' Ethics Act and the County Officers and Employees Disclosure Act, Attorney Gillespie submitted disclosures of actual, potential and possible conflicts of interest between public duties as Duchesne County Attorney and personal interests.  (The disclosures are on file for review in the clerk's office).

Benny Saiz - Tax Issues
Mr. Saiz informed the commission that he is the owner of Roosevelt Bowl.  He sold the bowling alley a few years back and the new owner was supposed to pay the taxes each year.   Mr. Saiz recently repossessed the bowling alley and during a conversation with Treasurer Colene Nelson he learned that the taxes have not been paid for five years.   Mr. Saiz requested that the commission consider waiving the penalty and interest.

Commissioner Ross responded that it is difficult as a commission to give tax adjustments, they affect every entity of the county.

Commissioner Thayne asked if the notice was properly addressed.  The seller can request from the treasurer's office that a copy of the tax notice be sent to them.

Deputy Attorney Uresk advised the commission they are within the state code because of granting such requests in the past and as the Board of Adjustment may wave the penalty and interest.

Commissioner Thayne stated Duchesne County has historically waved the penalty and interest.

Motion:   Commissioner Thayne motioned to wave the penalties for Mr. Saiz.  No one second the motion.  Motion carried.  Roll Call Vote:   Commissioner Thayne and Commissioner Stradinger Voting Aye, Commissioner Ross Opposed.

Final Plat Approval - North Fork Ranchettes - Lots 1-8, Sec. 1, T1N, R9W, USB&M Located in the North Fork Area.
Director of planning and zoning Clayton Chidester, and Doug Adams presented the plat for commission review.  Mr. Adams stated that underground telephone and power are available and the subdivision is fenced from public grazing ground.  The subdivision has health department approval for water and sptic.  The water will be obtained from two wells.

Mr. Chidester advised the commission that the final plat for North Fork Ranchettes has a favorable recommendation from the planning commission with all members voting aye.

Motion:   Commissioner Thayne motioned to accept the final plat for North Fork Ranchettes.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

2002 Beer License Renewal - Fruitland Store, Rock Creek Store/Bed & Breakfast, Hanna Country Store, Swains, and Uintah Cutter Association.
Motion: 
Commissioner Ross motioned to issue beer license renewals to Rock Creek Store/Bed & Breakfast, Hanna county Store, Swains and Uintah Cutter Association.  Because of a previous unlawful activity denied the application for renewal from Devon Johnson owner of the Fruitland Store.  Commissioner Thayne second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Consideration and Approval of an Agreement with R & M Janitorial Services for the Administration Building.
The contract is not completed.  Approval will be rescheduled for February 25th.  The commission expressed their gratitude to Mr. Jerry Argyle for job well done.  Mr. Argyle stepped in as a temporary janitor until the contract for janitorial service is awarded.

Motion:  Commissioner Thayne motioned to accept the tax adjustments submitted by the assessor and treasurer.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

The commission reviewed a letter sent from Rachel Smith stating that she moved in 2001.  She did receive the notice of property value & tax change but never received the actual bill.  She is requesting that the penalty and interest be waved from her taxes.

Motion:  Commissioner Thayne motioned to deny the tax adjustment request from Rachel Smith.  Commissioner Ross second.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of February 4, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion:  Commissioner Thayne motioned to accept the minutes with corrections.  Commissioner Ross second.  Roll Call Vote:  All Commissioners Voting Aye.

Vouchers:  Deputy Clerk/Auditor Becky Norris presented vouchers #78156 to #78266 totaling $147,942.58 for approval.

Motion:  Commissioner Thayne motioned to approve the vouchers.  Commisisoner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Adjournment:  2:30 P.M.
