MINUTES FOR REGULAR COMMISSION MEETING HELD JANUARY 28, 2002 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy Thayne

Others Present:  Deputy Attorney Roland Uresk, Road Supervisor Douglas Nielsen, Deputy Clerk/Auditor Carol Casey.

Road Issues - Supervisor Douglas Nielsen
Mr. Nielsen presented the three bids for product and services for the year 2002 paving project.  (See Attached Bids)

Motion:  Commissioner Thayne motioned to accept the low bid from Ned B Mitchell Construction for $631,673.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Mr. Nielsen presented a plat for a new right-of-way alignment on County Road No. 59 on North Myton Bench.

Motion:  Commissioner Ross motioned to accept the realignment of County Road No. 59 west for approximately three quarters of a mile.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Dean Peterson Right-of-Way Easement with Duchesne County.  Attorney Uresk explained that Mr. Peterson signed a Right-of-Way Easement which should have been between Mr. Peterson and the developer with an agreement by the developer to install a gate across the road on the property line between the Ostler and Peterson parcels. In addition the developer agreed to build a fence two hundred feet long on both sides of the gate.  The easement was deeded and recorded directly to Duchesne County without the county commission or Mr. Nielsen’s knowledge.

Motion:  Commissioner Thayne motioned to reject the right-of-way easement located on the following described property; T4S, R6W USB&M Sec. 5, because it does not meet the county requirements for a county road.  The county will record a deed transferring the easement back to Mr. Peterson. Commissioner Ross will prepare a letter of explanation to Mr. Peterson.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

The commission and Doug discussed a request for road improvement on County Road No. 60 on the Ioka Bench. The commission directed Clayton Chidester to respond with a letter regarding the county process for a road to be put on the list for improvement.

Commissioner Stradinger asked Mr. Nielsen if he would contact the person responsible for cutting trees and leaving debris on the side of the road on State Road No. 35 in the Utahn area.

 Agreement for Legal Services with Deputy Attorney Roland Uresk

Motion:  Commissioner Ross motioned to approve the agreement for legal services with Deputy Attorney Roland Uresk with corrections made in the morning work meeting.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Agreement for Legal Services with Public Defender Karen Allen

Motion:  Commissioner Ross motioned to approve the agreement for legal services with Karen Allen as public defender with corrections made in the morning work meeting.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Adoption of State Mileage Reimbursement Rate

Motion: Commissioner Thayne motioned to adopt beginning January 1, 2002 the state mileage reimbursement rate.  Commissioner Ross second.  Motion carried.

Nikki Moon, Miss Duchesne County – Discussing her Platform of Organ Donation with the Commission

Mrs. Bistrisky introduced Miss Duchesne County, Nikki Moon, to the commission.  Nikki  stated that she is going to the Miss Utah contest this year and has chosen tissue donation as her public service project.  The reason for her choice is that a member of her family received a tissue transplant.  Had he not been able to have the transplant he would have lost an arm. Nikki feels it is important to reach the community with information on tissue and organ donation. She plans to present information at the schools, on a web site, and by placing flyers throughout the county. She hopes to make people more aware of the benefit of tissue donation.

Commissioner Thayne suggested to Miss Moon that she have flyers and donor cards available during her presentations.

Commissioner Ross also suggested that the county could designate a time or day for public awareness.

Approval of January 21, 2002 Commission Minutes -  The minutes were reviewed and corrections made.

            Motion:   Commissioner Ross motioned to accept the minutes with corrections.  Commissioner Thayne second. .  Roll Call Vote:  All Commissioners Voting Aye.

            Vouchers:  Deputy Clerk/Auditor Andrea Higbee presented vouchers #78015 to #78119 totaling $250,540.78 for approval.

            Motion:  Commissioner Thayne motioned to approve the vouchers.  Commissioner Ross second.  Motion carried. Roll Call Vote:  All Commissioners Voting Aye.
