MINUTES FOR REGULAR COMMISSION MEETING HELD
JANUARY 14, 2002 BEGINNING AT 1:00 P.M. IN THE
COMMISSION BOARD ROOM IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Lorna Stradinger, Commissioner Larry S. Ross, and Commissioner Guy R. Thayne

Others Present:  Road Supervisor Douglas Nielsen, Cindy Warr, Rod Bateman, Deputy Clerk/Auditor Carol Casey

Road Issues - Supervisor Douglas Nielsen
Doug presented payment request No.  10 in the amount of $3,477.65 for engineering services provided by Horrocks Engineering on the Strawberry River Bridge replacement project.

Motion: Commissioner Ross motioned to approve payment request No. 10. Commissioner Thayne second. Motion carried Roll Call Vote: All Commissioners Voting Aye.

Doug also presented final payment request No. 11 from Horrocks Engineering for the Strawberry River bridges in the amount of $8,383.17. This payment authorizes the release of escrow and contract closure.

Motion: Commissioner Thayne motioned to approve payment request No. 11. Commissioner Ross second. Motion carried Roll Call Vote: All Commissioners Voting Aye.

Commissioner Thayne discussed the county assisting Roosevelt City with street improvements. The projects include improvement of 2nd South Street to Constitution Park by providing approximately 5,684 ton of gravel to widen the street to forty four feet. The second project entails roughing in a road off the hill behind Uintah Basin Vet Clinic. The last project would be paving the cemetery streets and a small section of 800 South between State and 100 East. The city submitted two options for the cost of the 2nd South State Street to Constitution Park project. Option No. 1 consists of 250 loads of gravel, 250 truck hours and 40 hours grader time totaling $32,550.00. Option No. 2 150 loads of gravel, 150 truck hours and 30 hours grader, totaling $19,960.00. Roosevelt City will contribute $10,000.

The commission decided that it would be best to use the road department general funds for the Roosevelt City project. Commissioner Thayne reminded Doug that there may not be enough funds to take care of other needs for the county. Doug answered that it would be close; that the Roosevelt projects would use over half the budget.

Motion: Commissioner Thayne motioned to approve option No.1 for 5,684 ton of gravel that will provide six inches of gravel for the forty four foot road on 2nd South at a cost of $32,550. Roughing in the road off the hill for approximately $8,000.00. Roosevelt City will reimburse $10,000.00 and pay for all of the paving on 800 South, east of the cemetery. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Cindy Warr & Rod Bateman - Tax Issue

Cindy Warr purchased property at the auditor’s delinquent tax sale. Because of civil litigation with the previous owner she was not able to take possession of the property until December 27, 2001. Cindy feels she should not have to pay taxes for the time she was unable to use the property. .

Attorney Uresk explained that the county does not deliver possession, just the legal title. The property was a forced sale because the landowner did not pay his taxes.

Ms. Warr also feels that the taxes are too high, she states that the home on the property is in bad condition. The commission suggested that she work with the assessor’s office to get a proper valuation. She may check into green-belt eligibility for the property and the possibility of taking down the existing building or declaring it an agricultural building which would also help lower the taxes.

Awarding of Television Translator Maintenance Contract
Motion: Commissioner Ross motioned that after meeting with Uintah County Commission the Duchesne County Commission accept the application from Alfred G. Stringham for television maintenance subject to final negotiations. Commissioner Thayne second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Approval January 7, 2002 Commission Minutes - The minutes were reviewed and corrections made.

Motion: Commissioner Thayne motioned to accept the minutes with corrections.  Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Vouchers:  Deputy Clerk/Auditor Andrea Higbee presented vouchers #77848 to #77967 totaling $172,169.58 for approval.

Motion: Commissioner Thayne motioned to approve the vouchers. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.
