MINUTES FOR REGULAR COMMISSION MEETING HELD DECEMBER 31, 2001 BEGINNING AT 10:00 A.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R Thayne, Commissioner Larry Ross, and Commissioner Lorna Stradinger.

Others Present:  Road Supervisor Douglas Nielsen, Chris Denver, Tammie & Bill Pierce, Charmaine Hurley, Ed Whicker, and Deputy Clerk/Audiotr Carol Casey.

Road Issues:  Doug informed the commission that the road department will be back in full-force on Wednesday January 2nd.

Commission Decision Regarding Water Disposal Inc.
On October 10, 2001 the Duchesne County Planning & Zoning Commission denied Water Disposal Inc. renewal of the conditional use permit to continue use of the open ponds.  Objectionable odors affecting the community have been the points of contention. 

Water Disoposal Inc. appealed the decision of the planning commission to the county commission.

Commissioner Thayne stated that the commission studied all the information and comments submitted to them regarding air quality at the Water Disposal Inc. ponds.

Commissioner Ross stated the ten findings of facts and conditions concerning the county commissions decision as to the appeal area as follows.

  1. Disposal of production water from producing oil wells in Duchesne County is a necessity for the industry.

  2. Odor at the disposal ponds and in the surrounding communities has increased in recent years and all parties agree that unpleasant odors affect the quality of life and other values.

  3. Water Disposal Inc. has attempted to control odors emitted from it's open ponds.  Unpleasant odors persist to a greater degree during warmer days and nights, but are present to a lesser degree as temperatures cool.

  4. Controlling the odor is unlikely, evidenced by Water Disposal Inc. processes previously attempted that were unsuccessful.

  5. On February 20, 2001 the county commission wrote a letter to the Division of Oil, Gas and Mining supporting Water Disposal Inc.'s intent to convert an abandoned oil well to an injection well if all Division of Oil, Gas and Mining regulations are met.  A letter dated August 31, 2001 from the division notified Water Disposal Inc. that the injection well is approved.  A letter dated December 20, 2001 to Water Disposal Inc. identifies the stipulations as to use of the well.  (Well identification #1-32A1)

  6. With well permit approval in place Water Disposal Inc. can pump water from the existing ponds down the well as stated by Water Disposal Inc.  In the October 10, 2001 planning commisison meeting and the February 12, 2001 letter to the county commission stating that if the well is permitted the water in the ponds would be pumped down the well.  Water Disposal Inc. stated that this would be the best solution to the problem.

  7. In the December 17, 2001 public meeting iwth the county commission, Water Disposal Inc. stated that the water levels in the ponds had dropped about two feet due to evaporation this year.  Mr. Denver estimated that about 356,000 barrels of water remain in the ponds.  The injection well permit calls for a 2,900 P.S.I.G. injection pressure into the receiving zone from 8,200 feet to the 9,060 feet well depths.  The commission does not project the amount of barrels injected per/day.   Four factors may influence the injection rate:  1.  New water being received per/day.  2.  Barrels of water being injected from the ponds in relation to the time frame set to empty the ponds.  3.  evaporation rate from ponds.  4.  Temperatures that my inhibit pumping from the ponds.

  8. It is ordered that the ponds will be drained within a twelve-month period beginning March 1, 2002.  The one year stipulation is in keepoing the Duchesne County Ordinance #17-52.

  9. All rehabilitation of pond sites will be accomplished by following regulations R649-9-7 of the Division of Oil, Gas and Mining and under the direction fo the division.

  10. The Duchesne County Commission upholds the decision of the planning and zoning commission in light of the injection well capabilities and commitments previously identified as findings.

Motion:  Commissioner Stradinger motioned to accept the findings of facts and conditions as read by Commission Ross.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:  Commissioner Ross motioned to award the 25 X 50 expansion of the sale barn to C & T Construction for $22,500.00.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Approval of December 17, 2001 Commission Minutes -   The minutes were reviewed and corrections made.

Motion:  Commissioner Ross motioned to accept the minutes with corrections.  Commissioner Stradinger second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues

Vouchers:  Vouchers #77656 to #77741 totaling $420,890.19 were presented for approval.

Motion:  C ommissioner Ross motioned to approve the vouchers.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Tax Adjustment - Assessor

Appointment of Weed Board Member
The appointment will be rescheduled for January 7th commission meeting.

Television Translator Maintenance Contract
The contract will be awarded after the coutny commission has had an opportunity to meet with the Uintah County commission

Opening and Decision of Bids for Custodial Supplies
Bids were submitted from Waxie with a bid total of $215.13 and Smiley's Inc.'s bid total of $169.84.

Motion:   Commissioner Stradinger motionted to accept the low bid from Smiley's Inc. for custodial supplies.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting.
