MINUTES FOR REGULAR COMMISSION MEETING HELD DECEMBER 10, 2001 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R Thayne, Commissioner Larry Ross, and Commissioner Lorna Stradinger.

Others Present:  Road Supervisor Douglas Nielsen, Deputy Clerk/Auditor Carol Casey.

Road Issues:  Doug reviewed an e-mail he received on 12/10/01 from Horrocks Engineering to Vernon Palmer, BIA, regarding the status of the Arcadia Road project.

Vernon, I thought I would drop you a note and ask how the Cooperative Agreement for the Duchesne County Arcadia Road is progressing?  Please advise me of the project status, we will need to update the environmental document when the schedule is reactivated.  -Rex Harrison P.E. Horrocks Engineers.

Vernon Palmers answer:

Rex, our Indian Self Determination Officer, Carolyn Richards has developed a draft MOU.  I am reviewing it now and will e-mail you a final draft copy next week.  I know that we went through this exercise before but this porject was handed over to Carolyn recently because it will ultimately end up as a 93-638 construction contract with the U&O Tribe. -Vernon Palmer, BIA

The commisison discussed the federal rules on hiring an engineer for the Lake Fork and Bridgeland Bridge projects.

Doug reported that because of weekend snow storms the road department has been out pushing snow on the last two Sundays.

Consideration of the Public Defender Proposals for 2002-2003  The commission received and reviewed four applicatons for the public defender position.  One proposal was disqualified because of lack of experience with felony prosecutions.  The remaining three, Karen Allen, David Cunningham, and Bret Benson will be interviewed on December 11, and December 19, 2001.

Motion:   Commissioner Ross motioned that after reviewing the applications for for Public Defender interviews with the three eligible applicants be set for December 11 and Decmber 19,2001.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Terms for Fair Board Executive Commettee Members

  1. Policy Statement
    A.  Duchesne County Commission finds that there must exist a policy governing the assigning of board members to the Duchesne County Fair Board Executive Committee.
    B.  Duchesne County Commission finds that in balancing the interest of the county, the several boards, the public and in the interest of all parties there should be a term in all boards that are assigned by the Duchesne County Commission.
    C.  Duchesne County finds in adopting this policy, it is the intent of the Duchesne County Commission to be as comprehensive as possible in addressing the terms in all boards thru out the county.
    D.  One term of consecutive service is four years.
    E.  Chair, Vice Chair, and Secretary will be chosen form and by the Executive Committee.

  2. First Round of terms starting January 1, 2002
    A.  Position A two years, ending December 31, 2004
    B.  Position B four years, ending December 31, 2006
    C.  Position C four years, ending December 31, 2006

The current chairperson will stay on as a paid advisor this year, and her two associates will fill seats A and B.   Position C will be advertised for.

Motion: Commissioner Stradinger motioned to put into affect the Fair Board Executive Committee Member Policy for Duchesne County and that we advertise and appoint the C position.   Mrs. Casper will remain with the fair board one more year during transition in an advisory position with pay.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:   Commissioner Ross motioned to accept the tax adjustments.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:   All Commissioners Voting Aye.

Approval of December 3, 2001 Commission Minutes -  The minutes were reviewed and corrections made.

Motion:   C ommissioner Ross motioned to accept the minutes with corrections.   Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Vouchers:   Deputy Clerk/Auditor Andrea Higbee presented vouchers #77355 to #77479 totaling $855,882.63 for approval.

Motion: Commissioner Stradinger motioned to approve the vouchers.  C ommissioner Ross second.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Department Head Time Sheets - Leann Stewart
Leann presented the time sheets for review.

Walt Donaldson - Division of Wildlife Resources presented the 2001 contractual in-lieu tax payment (PILT).  The payment is for 76,676.59 acres @ .50 an acre on land the Division of Wildlife Resources owns in Duchesne County.  The check is in the amount of $38,388.29.

Recess 2:00 P.M. until 7:00 P.M. budget sessions

Duchesne County Tentative Budge - 2002 hearing -
At 7:00 PM the County tentative budget hearing began with Commissioner Thayne conducting.  Those in attendance were Commissioners Guy Thayne, Larry Ross and Lorna Stradinger, Clerk/Auditor Diane Freston, Recorder Carolyne Madsen, Douglas Nielsen, Ron Johnson, Jerry Allred, Jack Wood, Travis Mitchell, Lorie Evans, Ted Kappen, Edythe Larson, Art Taylor, Susan Wardle, and Leslie Whiting.

Commissioner Thayne welcomed those in attendance to the meeting and asked that the auditor go through the budget.  Auditor Diane Freston explaine dthe General Fund, B-Road Fund, Library Fund, Duchesne County Solid Waste Fund, Duchesne/Wasatch Blue Bench Landfill Special Service District, Municipal Building Authority Fund, Capital Projects Fund and Grant Trust Fund.  A few questions were asked.  Ted Kappen commended the commission on the budget being less dollars than the 2001 budget.  Art Taylor said he was plased with the budget.  He also stated that he felt that the Sheriff's Department was doing an excellent job and said that safety, liberty and freedom have their price.
