Approval of August 13, 2001 Minutes:
Commission Minutes of August 13th were reviewed and corrections made.
Motion: Commissioner
Stradinger motioned to accept the minutes with corrections. Commissioner Ross

Road Items: Doug
presented a request for Contract Modification No. 2 on Strawberry River Bridges from
Horrocks Engineering in the amount of $1469.70 for irrigation supplies.
Commissioner Thayne stated that the engineer company
made the mistake and should be responsible for the cost of reducers and valves for the
irrigation lines.
Doug stated that the four-inch risers were put in as per
construction plans.
Commissioner Ross asked if there is a return value on
the four-inch risers. Doug answered there should be.
Motion: Commissioner
Stradinger motioned that the request for payment in the amount of $1469.70 be denied.
The reasons are. No. 1 The commission assumes there is an exchange
value for the four-inch riser valves. No. 2 As an engineering firm, Horrocks
should have been aware that an engineering mistake was made. Commissioner Ross
second. Roll Call Vote: All Commissioners

Doug informed the commission that the road department
has finished chipping in the county. 700 tons of oil and 7,800 tons of chips were
used to complete the job. Approximately forty miles of county roads were chipped in
eight working days.
Commissioner Stradinger stated that the drainage
problems at the Duchesne County Welcoming Center have been addressed. Irene Hansen
from the chamber of commerce will contract Burdick Paving to get an estimate on paving the
parking area.
Commissioner Stradinger asked Doug ifth eparking area
for the Fruitland Special Service District had been paved yet. Doug replied not yet
but Burdick Paivng has agreed to do so.
Commissioner Thayne asked if the county followed a
policy when selecting roads for pavement. Doug answered that they generally try to
connect pavement to pavement. Commissioner Thayne believes the county should put
pavement to serve homes not just connect pavement to pavement.

Amendment - Caroline Estates Phase II - Darcy Hicken Request to amend
Lot 9, Caroline Estates Phase II. Located in the Hancok Cove area.
Teresa Nielsen from the planning and
zoning office explained that the Mr. Robert West of R.S. West Enterprises, the owner of
the subdivision has split Lot 9 creating Lot 9A changing the subdivision to ten lots.
Normally a subdivision with ten lots or more is required to have approval by the
state but because there is water and electricity available it makes the subdivision exempt
from state requirements.
The proposed lots have health
department approval. The planning commission discussed the possibility of the septic
system drain field of Lot 9 encroaching on Lot 9A. Mr. West assured the planning
commission that the drainage could not encroach upon the neighboring lot becaus of ledge
rock. The planning commission has given a favorable recommendation with all members
voting aye.
Because the building permit was
issued for Lot 9 construction has started on a home and is near completion. Attorney
Uresk informed the commission that the building permit is good for Lot 9. Lot 9A
will not be able to obtain a building permit under the current ordinance.
A description has been recorded in
the recorders office, which has changed the original approved plat. The deed and the
revisionwere recorded before receiving the planning commissions approval.
The Commission believes the reason
behind creating this subdivision split is financial and shows lack of planning and respect
for the county ordinances. The amendment should have been completed prior to the
legal descriptions being recorded. According to county ordinances the plat revision
created an illegal subdivision.

Commissioner Stradinger motioned to deny the plat amendment for Caroline Estates
Phase II. Commissioner Ross second. Motion carried. Roll

Development of a Water
Users Web Site - John Swasey
John Swasey addressed the commission. The Bureau of Reclamation has
designated money to develop a water users web site. Students from the University of
Utah have helped developed a site which will give real time data of the amount of water
flowing in the ditches and canals from the Duchesne River.
A line with a direct connection to
the internet at all times and an IP number is needed. A connection to the county T-1
line would allow the web site in Richfield to call the web site here to activate the radio
to collect the data. This would consist of one page of information to be downloaded
each day. It will enable water users to look at the amount of water in their ditches
and order project ater anytime thru the web site.
Commissioner Thayne asked if this
project could be expanded in the future to cover other water sources in the Basin.
John answered in the affirmative, if someone wanted to they could.

Commissioner Thayne asked Troy
Sherrick what the charges for the State T-1 line are and if it would be a problem to
connect to it. Troy answered it is no problem to connect the line the cost is $7.00
a month. The commission would like to see the project expanded in the future
to include the other water sources in county.

Administrative Fees for
Northeastern Cousneling Center - Roosevelt Project
Kyle Snow and Ron Perry from Northeaster Counseling discussed the
administrative fees for the new counseling center.
Kyle stated that it should be minimal
cost to the county because Northeastern Counseling has done most of the leg work for this
project.
Commissioner Stradinger stated that
she would like to not charge a fee because the county is ultimately resonsible for repairs
at the center. The center is facing some financial difficulties and if Northeastern
Counseling Center were to fail financially Duchesne County would be resonsible for the
center's payroll.
Mr. Perry stated that if they could
get the fees waved they could use the funds for information systems and other things
needed internally.
Commissioner Thayne pointed out that
the commission charges administrative fees to all those who receive grants and loans
through Duchesne County.
Commissioner Ross stated the county
pays a grants person to review the grants. Considering the added debt service
through Duchesne County reviewing all documents and issuing checks for the next twenty
years for a fee of $1000 is not a bad deal.
Motion:
Commissioner Stradinger motioned to wave all administrative fees for Northeastern
Counceling. Motion failed.
Motion:
Commissioner Ross motioned to collect $1,000 for administrative fees to provide
services for closing the loan and making payments. Motion carried. Roll
Call Vote: Two Commissioners Voting Aye. Commissioner Stradinger
Voting Nay.
The commission reviewed a deed for a
thirty-foot county right-of-way from Snookes Roberts to Duchesne County for the road to
Roberts Roost. The deed has been recorded in the Recorders Office.

Discussion of Contributing Fill Dirt for
Uintah Basin Medical Center
Attorney Uresk advised that when the county addressed the issues of donation
of fill dirt to UBMC we must be careful not reestablish a liability issue.
Commissioner Ross quoted from the Section 4 of the
description of use of B Road Funds which states that equipment purchased with B &
C funds may be leased from the road department to another department or agency using the
rental rate established by the current cost reference guide for construction equipment.
The commission has since reviewed the UDOT rules for
using B Road Funds.
The county could enter into a lease agreement with the
hospital but it would cost UBMC the same amount of cash as any other equipment they
leased.
There is fill dirt available for donation to UBMC.
Commissioner Ross suggested thatt he commission determine what the cost will be to
transport the fill dirt to UBMC then appropriate funds from the general fund to the road
department for th cost of transportation. The turkcs will be paid for out of these
funds.
Attorney Uresk informed the commission they could do
this if they designate the amount is to benefit the community and tax payers of teh
county.
Motion: Commissioner
Ross motioned to appropriate from the county general fund $3000 to move approximately 1250
cubic yards of fill dirt to the UBMC construction site. Roll Call
Vote: Two Commissioners Voting Aye. Commissioner Thayne Voting Nay -
reason being that the commissioner does not want to compromise the 501C3 status of the
hospital.
Commissioner Stradinger read aloud an e-mail Doug
received from Scott Nay, UDOT/Office of Program Development regarding paving cemetery
roads.
This e-mail will servce to document our phone
conversation earlier this afternoon. Although it is not expressly stated in
regulation, it is my opinion that Class B money can be spent for construction or
maintenance of cemetery roads. The regulation list construction and maintenance of
alleys as a permissible use in Section IV, 1-K and I believe cemetery roads would be
considered int eh same category. It is important to remember however, that mileage
for both alleys and cemetery roads in not eligible to be included as Class B and C mileage
used as a basis for funding.
