MINUTES FOR REGULAR COMMISSION MEETING HELD AUGUST 6, 2001 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commissioner Larry S. Ross, and Commissioner Lorna Stradinger.

Commissioners Absent:   Commission Chairman Guy R Thayne.

Others Present:  Supervisor Douglas Nielsen, Deputy Clerk Carol Casey, Susan Hamilton, and Clayton Chidester.

Approval of July 30, 2001 Minutes -  Commission Minutes of July 30th were reviewed and corrections made.

Motion:   Commissioner Ross motioned to accept the minutes with corrections.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Road Items:  Doug reminded the commission they are to inspect the Strawberry River Bridges with Rex Harrison of Horrocks Engineers tomorrow morning August 7th at 9:00 AM.

Doug presented the payment request no. 4 in the amount of $21,864.56 from Horrocks Engineers for work on Project No. BRO-LC13(2) Bridge Replacements - Strawberry River.  The work is over 68% finished at this time.

Motion:   Commissioner Ross motioned to pay the request in the amount of $21,864.56.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Doug informed the commission he had received a Draft Memorandum of Understanding on the Arcadia Road Project from the BIA, Phoenix office.

The county is under pressure to keep the STP funding and needs to formalize the agreement as soon as possible.

Commissioner Stradinger informed Doug that she had received a phone call from Mr. Retallick.  Mr. Retallick has some concerns about the county using B Road Funds to pave the cemetery roads and for the gravel used at the Altamont School.  Mr. Retallick also thought that his road was scheduled for pavement this summer.

Doug answered that the paving of the Upper County cemeteries was paid for out of the Special Service District fund.  The 1800 tons of gravel was donated to the school district by order of the county commission.  Doug stated that Mr. Retallicks road was only to be considered for paving if there was time and money left after the other designated roads were finished in the project area.  Doug talked with Mr. Retallick a month ago and informed him then that there would not be enough funds to pave the road.

Commissioner Ross stated that the county donated the gravel to the school district.  Commissioner Ross will prepare a letter of response to Mr. Retallick.

Clayton Chidester approached the commission.  He stated that the planning commission would like to be released from the job of touring the roads in the county nominated for paving.   The planning commissions opinion is that since the road department is doing road improvement in county regions each year the road tour is no longer necessary.  The commission stated that there are twelve hundred miles of road in the county.  It is good to have the planning commission make recommendations.  The commissioners would like to meet with the planning commisison regarding this matter.  Clayton will arrange a meeting with the county commission and the planning commission an hour before the next planning meeting on September 5th.

Ordinance No. 01-190 - Zone Change - Julian Robinson
Susan Hamilton a real estate broker is representing Mr. Robinson today.   Clayton informed the commission that the planning commission has given a favorable recommendation with all members voting aye.

AN ORDINANCE CHANGING THE ZONING FROM A/R-1 (AGRICULTURAL/RECREATIONAL), A 5-ACRE ZONE, TO RR (RURAL RESIDENTIAL), A 1-ACRE ZONE

WHEREAS Duchesne County has adopted a zoning ordinance, zoning portions of the county for various uses, and
WHEREAS a property owner has petitioned the county to change the zoning for use from A/R-1 (Agricultural/Recreational), a 5-acre zone, to RR (Rural Residential), a 1-acre zone on a parcel of property located in Section 29, Township 2 South Range 5 West, USM., and
WHEREAS the matter has been brought before the Duchesne County Planning and Zoning Commission, and
WHEREAS the Planning and Zoning Commission has held a public hearing on said zone-change request and after due consideration recommends that the zone change be granted and
WHEREAS the Duchesne County Commission has had a full discussion of the matter in a public meeting, and
BE IT HEREBY ORDAINED as follows:
The current zoning of A/R-1 (Agricultural/Recreational), a 5-acre zone, is changed to RR (Rural Residential), a 1-acre zone for the following parcel of properyt described as follows:
Township 2 South, Range 5 West U.S.M.
Secion 29:
  Beginning at the Northwest corner of the NE 1/4 NW 1/4 of said section; thence East 330.17 feet; thence South 746.58 feet; thence Westerly to a point on the West line of the NE 1/4 NW 1/4, said point being 734.99 feet from the Northwest corner of the NE 1/4 NW 1/4; thence North 734.99 feet to the point of beginning.   EXCEPT:  Beginning at the Northeast corner of W 1/2 W 1/2 NE 1/4 NW 1/4; thence South 481.58 feet to the true point of beginning; thence West 165 feet; thence South 265 feet, more or less, along the existing fence line to a point on the East line of the W 1/2 W 1/2 NE 1/4 NW 1/4; thence North 265 feet, more or less, to the true point of beginning.  Containing 4.33 acres, more or less.

Motion:   Commissioner Ross motioned to apporve the zone change.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Ordinance No. 01-188 - Zone Change - Mike & Carrie Mascaro  Mrs. Mascaro presented a plat map to the commission for review.  She stated that water is available and she had approval for a septic system.  Clayton informed the commission that the planning commission has given a favorable recommendation with all members voting aye.

Section 6: 
Beginning at a point on the West right of way of old U.S. Highway 40, said point being North 75*04'13" East 948.26 feet from the SW corner of the NE 1/4 of the NW 1/4 (lot 3); Thence South 45*46'41" West 347.71 feet to the South line of said NE /14; Thence South 89*50'44" West 16.36 feet along said South line to an existing fence; Thence North 2*56'01" West 121.29 feet along said fence and extension thereof; Thence North 27*36'15" East 167.58 feet; Thence North 45*46'41" East 120.24 Feet; Thence South 44*12'49" East 154.78 feet to the point of beginning, containing 1.00 acres.

Motion:   Commissioner Ross motioned to approve the zone change.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Change of Time for Setting Agenda Items to Commission Meetings  Clayton asked that the commission change the deadline for setting the agenda from Wenesdays at 5:00 PM to Thursday because of the problems with scheduling items which are voted on in the monthly planning commission meeting.  He stated that the planning commission meets on Wednesday nights.  The items needing to go before the county commission have to wait until the following week to get on the agenda.  This makes the public have to wait another 10 days for a commission approval.

Motion:   Commissioner Ross motioned to change the setting agenda time to Thursday 12:00 noon.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Auditor's Office - Vouchers - Tax Adjustments - Department Head Time Sheets
Vouchers:
  Deputy Clerk/Auditor Carol Casey presented the vouchers #74326 to 74414 totaling $120,533 for approval.

Motion:   Commissioner Ross motioned to approve the vouchers.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.
