MINUTES FOR REGULAR COMMISSION MEETING HELD JULY 30, 2001
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner Larry S. Ross, and Commissioner Lorna Stradinger.

Others Present:  Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston, Deputy Clerk Carol Casey, Sherm Richens, and Gordon Snow.

Pledge of Allegiance

Road Items:  Doug reported that the road department has laid nine miles of new asphalt and over sixteen miles of asphalt overlay in the upper country.  The total asphalt mixed was 36,255 tons.  The Altamont, Bluebell and Altonal cemeteries received over 1,200 tons of asphalt.

Doug informed the commission that a wheel roller can be rented from Cate Equipment for $1,100.00 a week to roll the chips.  The roller will be needed for three weeks.   This is the best price available.  and the commission agreed to the rental.

Commissioner Thyane questioned why the department had stopped short with the paving on the road by Doug Miles.  Doug answered that they ran short on several roads in the area.

Doug informed the commission that Mr. Swasey from the school board had stated that the school district will pay for mixing the oil for the Altamont School parking lot project.

Commissioner Thayne advised Doug that the barrow pit along the road by Max Farnsworth's residence is holding water and needs to have a backhoe dig a drain.

Jim Lindsay's issue of road ownership was discussed by Commissioner Ross and Commissioner Stradinger.  Commissioner Stradinger stated that the attorneys are working for an out of court settlement.  If an agreement can't be reached Mr. Lindsay is prepared to take the issue to court.

Approval of July 23, 2001 Minutes -  Commission minutes of July 23rd were reviewed and corrections made.

Motion:   Commissioner Ross motioned to accept the minutes with corrections.   Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Ordinance 01-187 - Sherm Richens - Zone Change
Mr. Richens stated that he is asking for the zone change in order to sell the one-acre parcel with an older home on it.  Clayton informed the commission that the home is connected to Roosevelt City water and sewer.  The Planning Commission Board has given a favorable recommendation for the zone change.

Motion:   Commissioner Stradinger motioned to approve Ordinance 01-187.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

AN ORDINANCE CHANGING THE ZONING FROM A/R-1 (AGRICULTURAL/RECREATIONAL), A 5-ACRE ZONE, TO RR (RURAL RESIDENTIAL), A 1-ACRE ZONE

WHEREAS Duchesne County has adopted a zoning ordinance, zoning portions of the county for various uses, and
WHEREAS a property owner has petitioned the county to change the zoning for use from A/R-1 (Agricultural/Recreational), a 5-acre zone, to RR (Rural Residential), a 1-acre zone on a parcel of property located in Section 28, Township 2 South Range 1 West, USM., and
WHEREAS the matter has been brought before the Duchesne County Planning and Zoning Commisison, and
WHEREAS the Planning and Zoning Commission has held a public hearing on said zone-change request and after due consideration recommends that the zone change be granted and
WHEREAS the Duchesne County Commission has had a full discussion of the matter in a public meeting, and
BE IT HEREBY ORDAINED as follows:
The current zoning of A/R-1(Agricultural/Recreational), a 5-acre zone, is changed to RR (Rural Residential), a 1-acre zone for the following parcel of proeprty described as follows:
Township 2 South, Range 1 West U.S.M.
Section 28:
  Beginning at a point which is North 1748.69 feet from the Southeast Corner of said section, said point being on the East line of the SE 1/4 of said section; Thence South 89*35'15" West 354.00 feet along a chain link fence and extensions thereof; Thence North 123.00 feet parallel with said East line; Thence North 89*35'15" East 354.00 feet along an existing chain link fence and extensions thereof to said East line; Thence South 123.00 feet along said East line to the point of beginning, Containing 1.00 acres, said parcel being subject to the existing county right of way.

Ordinance 01-189 - Wendy & Jerry Strebel - Zone Change
Mrs. Strebel addressed the commission.  She stated that they would like to sell their home and one acre.  Clayton informed the commission that the planning commisison had given a favorable recommendation with two members voting nay.  The two members have concerns about Hanna water availability.

Commissioner Stradinger also expressed her concerns about the availability of the service lines from Hanna Water.

The connection from Hanna Water has been purchased for the lot created by the zone change.  Wendy stated that the existing hom currently has well water and an approved sewer system. 

Motion:  Commissioner Ross motioned to approve Ordinance No. 01-189.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

AN ORDINANCE CHANGING THE ZONING FROM A/R-1 (AGRICULTURAL/RECREATIONAL), A 5-ACRE ZONE, TO RR (RURAL RESIDENTIAL), A 1-ACRE ZONE

BE IT HEREBY ORDAINED as follows:
The current zoning of A/R-1(Agricultural/Recreational), a 5-acre zone, is changed to RR (Rural Residential), a 1-acre zone for the following parcel of proeprty described as follows:
Township 1 South, Range 8 West U.S.M.
Section 13:
  Lot 33, Farm Creek Mini Ranches.

Ordinance 01-185 - Joe & Joan Steed - Zone Change
Mr. Steed informed the commission that the property was zoned five and ten acre lots when he purchased it.  He would like to change the zoning to 2.5 acre.   Clayton informed the commission that the planning commisison has given favorable recommendation.

Commissioner Stradinger stated she could not be part of the motion because of a possible conflict of interest.

Motion:  Commissioner Ross motioned to approve Ordinance No. 01-185.  Motion Carried.  Roll Call Vote:   Commissioner Ross and Commissioner Thayne Voting Aye.

AN ORDINANCE CHANGING THE ZONING FROM A/R-1 (AGRICULTURAL/RECREATIONAL), A 5-ACRE ZONE TO A (AGRICULTURAL), A 2.5-ACRE ZONE

WHEREAS Duchesne County has adopted a zoning ordinance, zoning portions of the county for various uses, and
WHEREAS a property owner has petitioned the county to change the zoning for use from A/R-1 (Agricultural/Recreational), a 5-acre zone, to A (Agricultural), a 2.5-acre zone on a parcel of property located in Sections 4, 5, 6, 7, 8, 9, 16, 17, 18, 19 and 20, Township 4 South. Range 4 West, USM., and
WHEREAS the matter has been brought before the Duchesne County Planning and Zoning Commisison, and
WHEREAS the Planning and Zoning Commission has held a public hearing on said zone-change request and after due consideration recommends that the zone change be granted and
WHEREAS the Duchesne County Commission has had a full discussion of the matter in a public meeting, and
BE IT HEREBY ORDAINED as follows:
The current zoning of A/R-1(Agricultural/Recreational), a 5-acre zone, is changed to A (Agricultural), a 2.5-acre zone for the following parcel of proeprty described as follows:
Township 4 South, Range 4 West U.S.B. & M.
Section 4:
  Beginning at the Southeast corner of said section, thence North a distance of 1871.58 feet along the West secion line; thence South 51*0' East a distance of 1400.00 feet; thence North 57*40'29" East a distance of 3325.93 feet to a point on the East line of the West half of the East half of said section; thence South 0*47'55" East a distance of 2640.47 feet to the Southeast corner of said West half of said East half, thence South 88*36'22" West a distance of 3936.91 feet to the point of beginning.  Section 5:  The South half;  Section 6:  The South half of the Southeast quarter;  Section 7:   All; Section 8:  All; Section 9:  The West half, EXCEPT: beginning at a point being North 16*30'08" East 4617.07 feet from the Southwest corner of section 9; thence North 80*38'45" West 500.00 feet; thence North *9'21'15" East 346.00 feet; thence South 80*38'45" 500.00 feet; thence South 9*21'15" West 436.00 feet to the point of beginning.  ALSO EXCEPTING:   A50 foot right of way.  Section 16:  The Northwest quarter; and the Northwest quarter of the Southweat quarter; Section 17:   All; Section 18:  All; Section 19:  The North half; Section 20:  The East half; the East half of the West half; the West half of the North West Quarter.  Approximately 4510 acres.

Approval of Performance Bond for Utah Mini Ranches Phase II - Joe Steed  Mr. Steed presented a performance bond from Developers Surety and Indemnity Co.  The bond is in the amount of $64,181.25.  This bond will be for graveled roads in Utah Mini Ranches Phase II.  The conditions for the bond are the same as the bond for Phase I.  There will be a twelve-month waiting period after the completion of the roads before the county accepts the road.  (see attachment)

Commissioner Stradinger stated she could not be part of the motion because of possible conflicting interests. 

Motion:   Commissioner Ross motioned to accept the bond in accordance with the Ducehsne County Code 16.28.050, Guarantee of Improvements, the bond or irrevocable letter of credit of 125% of the estimated costs.  The bonded amount to cover Phase II will be $64,181.25.  Motion carried.  Roll Call Vote:   Commissioner Ross and Commissioner Thayne Voting Aye.

Ordinance 01-186 - Snow Construction - Zone Change
Mr. Snow is asking for a one-time split of 2.5 acres with an older home on the lot.  Clayton informed the commission that the lot has Roosevelt City water and an established septic system.  The request has been before the planning commission and received a favorable recommendation.

Motion:   Commissioner Ross motioned to approve Ordinance No. 01-186.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:   All Commissioners Voting Aye.

Section 13:
  The East 310 feet of the N 1/2 of the NE 1/4.

Final Plat Approval for Coventry Cove Phase4-Gordon Snow
Mr. Snow presented the plat to the commission for review.

Motion:  Commissioner Stradinger motioned to approve Coventry Cove Phase 4 Subdivision.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Agreement with Altamont City of Building Inspection Services - Karl Mott  Karl presented the agreement with Altamont City for building department services as building inspector.

Motion:  Commissioner Ross motioned to accept the agreement with Altamont City.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Commissioner Stradinger asked Karl if he would follow-up on a county request for clean-up of a lot in Neola.

Commission Meeting Resumed 2:45  A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF DUCHESNE COUNTY, UTAH, AUTHORIZING AND APPROVING THE EXECUTION OF AN ANNUALLY RENEWABLE LEASE AGREEMENT DATED AS OF AUGUST 1, 2001, BY AND BETWEEN SAID COUNTY AND THE MUNICIPAL BUILDING AUTHORITY OF DUCHESNE COUNTY, UTAH (THE "AUTHORITY");  AUTHORIZING THE EXECUTION BY SAID COUNTY OF SUBLEASE AGEREMENTS BY AND BETWEEN SAID COUNTY AND THE TOWN OF ALTAMONT, THE COUNTY AND CITY OF DUCHESNE, AND THE COUNTY AND ROOSEVELT CITY; AUTHORIZING THE EXECUTION OF GROUND LEASES BY AND BETWEEN THE AUTHROITY AND THE COUNTY, THE AUTORITY AND THE TOWN OF ALTAMONT, AND THA AUTHORITY AND CITY OF DUCHESNE; AUTHORIZING THE ISSUANCE AND SALE BY THE AUTHORITY OF ITS TAXABLE LEASE REVENUE BONDS, SERIES 2001 IN THE AGGREGATE PRINCIPAL AMOUNT OF $1,100,000; AUTHORIZING THE EXECUTION BY THE AUTHORITY OF A MASTER RESOLUTINO, SECURITY DOCUMENTS, AND OTHER DOCUMENTS, AND OTHER DOCUMENTS REQUIRED IN CONNECTION THEREWITH; AUTHORIZING THE ACQUISITION OF PUBLIC SAFETY EQUIPMENT AND CONSTRUCTION OF FIRE STATIONS AND RELATED PUBLIC SAFETY IMPROVEMENTS; AUTHORIZING THE TAKING OF ALL OTHER ACTIONS NECESSARY TO THE CONSUMMATION OF THE TRANSACTION CONTEMPLATED HEREBY; AND RELATED MATTERS (see attachment)

Motion:  Commissioner Stradinger motioned to accept the resolution of the Board of County Commissioners of Duchesne County, Utah authorizing and approving the execution of an annually renewable lease agreement dated as off August 1, 2001 by and between said county and the Municipal Building Authority.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:  Commissioner Ross motioned to go out of the regular commission meeting and into the Municipal Building Authority meeting.   Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
