MINUTES FOR REGULAR COMMISSION MEETING HELD JULY 9, 2001
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, and Commissioner Lorna Stradinger.

Commissioners Absent:  Commissioner Larry S. Ross.

Others Present:  Deputy County Attorney Roland Uresk, Road Supervisor Douglas Nielsen, Deputy Clerk/Auditor Carol Casey, Beverly Park, and Therena Morrill for the Uintah Basin Standard.

Pledge of Allegiance

Approval of July 2, 2001 Minutes - Commissioner minutes of July 2nd were reviewed and corrections made.

Motion:   Commissioner Stradinger motioned to approve the minutes with corrections.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Road Items - Supervisor Douglas Nielsen
Doug reported that the had visited with Bill Wall the builder of a new subdivision on Tabby Mountain.  The Mt. Tabby Improvement Group was in alst week with complaints regarding dust and road damage cause by trucks hauling gravel he will make sure the dust on the road is watered down.  Doug also talked with the owner of the trucks and they are running legally on a county road.  Commissioner Tahyne stated that Mr. Lisonbee has reported there is very little road damage and no visible structural damage to the bridge.  Commissioner Thayne stated he would give this information to the miprovement group.

Doug presented payment request #3 from Horrocks Engineers for construction engineering costs on Strawberry River Bridges.  The payment is $27,564.71 contract No. 01-8272.

Motion:   Commissioner Stradinger motioned to pay the amount of $27,564.71 to Horrocks Engineering for engineering cost on Strawberry River Bridges.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Doug reported that the road department has over 21,000 tons of asphalt paving completed in the upper country.  Burdick Paving needs to relocate the hot plant for other commitments, and would like the road crew to work the next two Fridays in order to get finished.   The commission gave Doug their approval.

Commissioner Thayne informed Doug that he has received many calls from the public commending the road department on their work with the asphalt overlay in the upper country.

Commissioner Thayne stated he had been approached regarding the county donating dump truck, and driver time to help with paving the Altamont School parking lot.

Commissioner Stradinger asked who should be called when the bags used for cleanup along county roads are ready to be gathered.  Doug stated that the road department has bags to hand out to the organizations doing the cleanup, and will make arrangements to pick the bags up when they are full.

Uintah Basin Narcotics Strike Force Expanded Interlocal Cooperation Agreement - 2001   Motion:  Commissioner Stradinger motioned to go with the recommendations of Deputy Attorney Uresk to adopt the Uintah Basin Narcotics Strike Force Expanded Interlocal Cooperation Agreement - 2001.  Commissioner Thayne second.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Motion:   Commissioner Stradinger motioned to approve Resolution 01-08 adopting the Uintah Basin Narcotics Strike Force Expanded Interlocal Cooperation Agreement - 2001.   Commissioner Thayne second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Discussion on appointment of a member of DCWCD to the Public Lands Use Committee
The commisison discussed the need to have a member of the Duchesne Coutny Water Conservancy District int he Public Lands Use Committee.  The commission decided to make the appointment in commission meeting on July 16, 2001.

Moratorium on Burning within Duchesne County - Georg Adams

ORDINANCE NO. 01-184
AN ORDINANCE ESTABLISHING A MORATORIUM ON BURNING WITHIN DUCHESNE COUNTY DURIN HIGH RISK FIRE SEASON

WHEREAS, the county is experiencing extreme dry weather conditions and its resultant fire dange warnings this early int eh season; and,
WHEREAS, it is the opinion of the Duchesne County Commission that an extremely hazardous fire condition exists, constituting a direct threat to the safety of persons and property within the county if burning were permitted; It is hereby ORDAINED by the Board of County Commissioners, as follows;

  1. A fire moratorium is hereby extablished in Duchesne County extending to all private lands within the county.

  2. No fires may be set for the purose of clearing of unwanted grasses, brush or other unwanted matter.

  3. No fireworks shall be set off except under strict control in a non flammable controlled area.  Firework rockets are prohibited in all cases.

  4. Camp fires shall be strictly controlled and shall be in a fire pit.

  5. All campfires shall be extinguished to the extent that no hot coals remain when its use is no longer needed.

  6. Extra care shall be taken in windy conditions, so as to prevent any chance of the fire excaping the fire pit, and at no time shall the fire be left unattended.

  7. County residents and visitors are advised that fire restricitons exist on other lnads, under the jurisdiction of the responsible agency whether tribal, state, federal or local.  It is the citizens responsibility to inquire of these restrictions.

  8. Any fire caused from reckless burning shall be the responsibility of the person or persons starting the fire and those responsible persons shall bear the full cost of suppression.

  9. Said moratorium shall continue until further order of the Board of County Commissionrs, or October 31, 2001, whichever occurs first.

  10. The fire danger is immediate and the moratorium shall be effective immediately upon advertisement in the local newspaper and on the local radio stations.

Motion:  Commissioner Stradinger motioned to adopt Ordinance No. 01-184 with the Sunset Provision.  Commissioner Thayne second.   Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Commissioner Thayne read aloud a note he received from Mike Paupard asking for a skate park.

"We need a skate park in Duchesne really bad.  Tons of kids need a place to hang out.  OK?"

Vouchers:   The auditor's office presented vouchers #73997 to #74021 totaling $132,647.20 for approval.

Motion:   Commissioner Stradinger motioned to approve the vouchers.  Commissioner Thayne second.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Time Sheets:  Deputy Clerk/Auditor Leann Stewart presented the department head time sheets for signatures.
