MINUTES FOR REGULAR COMMISSION MEETING HELD JUNE 18, 2001
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner Larry S. Ross, and Commissioner Lorna Stradinger.

Others Present:  Road Supervisor Douglas Nielsen, Deputy County Attorney Roland Uresk, Deputy Clerk/Auditor Carol Casey, Beverly Park, Cheryl Searle, and John Maurer.

Road Items - Supervisor Douglas Nielsen
Doug stated that he had received a call from the Wasatch County Commission Secretary.  The secretary informed Doug that the commissioners would not be able to attend the landfill meeting on Wednesday the 20th and would like to reschedule the meeting.  Commissioner Ross asked Doug to reschedule the meeting for June 27th at 4:00 P.M.

Doug reported that the paving in the upper country is moving along.  They are paving near the Miles Ranch going toward Russ Lee's residence.

Burdick Paving offered the county enough leftover rejuvenating oil to do about a mile and a half on County Road #113 North from State Road 87.  Doug stated that the county paid Burdick Paving to spread the oil.

Commissioner Ross would like the road department to put down a twelve to fourteen foot strip of pavement at the Bluebell Cemetery while they are paving in the upper country area.

Motion:   Commissioner Stradinger motioned to pave with asphalt the road to and inside all the cemetieries in the county.  The road department will pave them when they are paving in the vicinity of each cemetery.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Commissioner Thayne mentioned that Duchesne City would like the parking lot at the visitors' center chipped and sealed.

Roland Uresk stated that the Chamber of Commerce willneed to send a letter to the county to formally request the improvements.

The commission suggested that in the mean time Doug get an estimate on the price of chip seal & fogging.  Commissioner Ross suggested Doug also get the price of a one-inch overlay of asphalt.

Approval of the Utah State Library Lease - Cheryl Searle
Mrs. Searle met with the commisison this morning in the work meeting.   The library lease was reviewed and changes were made to Sections 2, 7, & 8.   The amount of office space and a floor plan will be attached to the lease as exhibit A & B.  Commissioner Ross questioned th insurance coverage in case of fire or vandalism.  Mrs. Searle will add the necessary workage stating the State Library insurance will cover these two items.

Motion:   Commissionr Stradinger motioned to accept the State of Utah Department of Administrative Services Division of Facilities Construction Management Lease Agreement for the use of bookmobile services at the ocunty building at 50 East 100 South in Duchesne.   Motion second by Commissioner Ross.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Turner Petroleum Land Services - Oil & Gas Lease - John Maurer  Mr. Maurer is the representativie for Turner Petroleum Land Services.  Turner Land would like to obtain and oil and gas lease for a two-acre parcel of land owned by the county.  The county will receive a 1/6th interest payment for production in the amount of $150.  (see attachment)

Motion:  Commissioner Stradinger motioned to accept the oil and gas lease from Turner Petroleum Land Services for Sec. 27 T2S, R1W, USM.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Lindsay Road Discussion
Commissioner Thayne will not take part in the discussion because of personal and family interests.  The commission reviewed the map of the present road location and the old road prior to 1992.  The road accesses an oil well location owned by El Paso Gas and the residence of the Marcus Liddell family.  Mr. Lindsay is setting posts and intends to block the use of the road.  The commisison believes that the county and the property owners have several choices for recourse to Mr. Lindsay's actions.   The choices are...

The present location was agreed upon in 1992; therefore, the road was moved and a fence constructed.

The county and property owners oculd revert back to the old road location therefore depleting the value of the Linday property.

Take Mr. Lindsay to court, which is the least preferable.

Mr. Lindsay's actions will determine the county's response.

With El Paso Gas having an easement, and the prescriptive easement the Liddell family has, Mr. Lindsay will have difficulty legally blocking the access.  The Liddell family and El Paso Gas would have a reasonable chance of having the fence removed.

Discussion on County Clean up of Property in Neola
Attorney Uresk recommended that if the owners will not clean the property up the county proceed with the citation process.  If need be a court order can be obtained to allow the county to go in with euqipment and clean the property.  The clean-up cost would then be assessed to the property owner.

The commissione also discussed Duchesne County Ordinance No. 97-123, which states that any refuse generated in the county must be disposed of in the county landfill.

Approval of June 11, 2001 Minutes - Commission minutes of June 11th were reviewed and corrections made.

Motion:   Commissioner Ross motioned to approve the minutes with corrections.   Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:   Commisisoner Stradinger motioned to approve the tax adjustment.  Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Comissioners Voting Aye.

Vouchers:   Deputy Clerk/Auditor Carol Casey presented vouchers #73679 to #73799 totaling $375,360.23 for approval.

Motion:   Commissioner Ross motioned to approve the vouchers.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Adjournment:  3:15 PM
